Fulbright & Jaworski Announces Widow's Win in Long Battle Against Raytheon Company; Dallas Jury Awards $6.8 Million to Inventor's Widow for Failure to Pay Royalties
DALLAS--(BUSINESS WIRE)--Oct. 31, 2003--On October 30 in the U.S. District Court, a Dallas jury awarded Rockwall, Texas-resident Reba Mansell $6.8 million for Raytheon Company's failure to pay ten years of royalties on her late husband's invention, one of the world's first vehicle tracking systems using Global Positioning Systems (GPS) technology. Fulbright & Jaworski partners Karl G. Dial, Brett C. Govett and Senior Associate Jeff Kemp represented Mrs. Mansell in Reba Mansell v. Raytheon Company.
In a two-week jury trial in Federal Judge Barbara M.G. Lynn's courtroom, the jury affirmed Mrs. Mansell's case that Raytheon Company had failed to pay the four percent royalty on all sales of the automated vehicle location system which used GPS to track the location of fleet vehicles and "generations thereof." The late Don Mansell was one of the world's pioneers in using this technology.
"Raytheon did not believe Mrs. Mansell would ever challenge its refusal to pay what was promised, which was like a slap in the face to Mrs. Mansell. This GPS system was the legacy from her husband," said Karl G. Dial, one of the Fulbright & Jaworski trial lawyers who represented Mrs. Mansell.
Six months after Don Mansell's death in 1993, Mrs. Mansell sold their family-owned business, Auto-Trac, Inc., to E-Systems in exchange for the 4% royalty. E-Systems was merged with Raytheon in 1996. The contract with Mrs. Mansell also required her written consent if Auto-Trac was sold as a business unit. Raytheon violated its contract with Mrs. Mansell by selling to Orbital Science without Mrs. Mansell's consent.
"This was a case of a large company ignoring its obligations to pay for technology it acquired," said Brett C. Govett, also of Fulbright & Jaworski. "The jury in Judge Lynn's courtroom agreed."
Reba Mansell is a long-time resident of Rockwall, Texas. Her late husband, Don Mansell, brought cable TV to rural west Texas during the 1960s before he had the idea to develop a vehicle tracking system.
The defendant Raytheon Company (NYSE:RTN) is headquartered in Waltham, Mass., and provides defense, government and commercial electronics, space, information technology, technical services, and business and special mission aircraft. With more than 76,000 people worldwide, Raytheon reported $16.8 billion in sales in 2002.

If that were the case, they why has Judge Lynn scheduled a hearing for 11/24/03. If the files were destroyed, then Nokia's motion to unseal would be meaningless, and Judge Lynn would have ruled before now. IMO

Ever try picking up 84 by taking NY Thruway over Newburgh- Beacon Bridge. Avoids TZ Bridge mess and makes for a pleasant drive, especially this time of year. It is a longer route, though.
Nokia has never denied that they owe IDCC. They are asking the judge to unseal some or all of the "sealed documents" in the IDCC/ERICY case because they may affect the contract they signed with IDCC. The affect on arbitration is unclear at this time.
The next step will be a hearing on 11/24 at 4:30PM in Judge Lynn's court. Your guess is as good as any in speculating what will happen on this date.

I never considered an OB that low. If there was a rout in the stock, I guess it would be possible. Would that then be a routrageous bid (RB) LOL. Actually, I thought it would drop below $2.65 on Friday, so I had a bid in at that amount. I think I'll leave a standing order for abouit $2.60 and see what happens. Thanks for your thoughts.

Embracing McD theme tough for ad shops

The views were spectacular from the 33rd floor of the W Lakeshore Chicago Hotel on a cloudless, sunny late Tuesday afternoon.
But the buzz inside the hotel's rooftop nightclub was barely detectable as Michael Roberts, president of McDonald's USA, and Bill Lamar, chief marketing officer, McDonald's USA, attempted to interest a handful of Chicago journalists in the official American debut of the "I'm Lovin' It" global ad campaign this Monday, a date that means little now, because the fast-food giant opted to "sneak preview" the initial 60-second brand spot starting last Saturday.
Lamar showed three new spots to the assembled group--a family commercial and a Ronald McDonald spot, both produced by Heye & Partner in Unterhaching, Germany, with assistance from DDB/Chicago, and a Mighty Kids Meal spot from Leo Burnett starring skateboarder Tony Hawk.
On first viewing both the new family-themed and Ronald McDonald commercials look much like the launch brand spot--a blur of imagery with only fleeting references to the restaurant chain or its food. The specially themed lyrics in each spot--delivered in a forced hip hop style--do little to help draw in viewers.
The Burnett kids spot is a frenetically edited montage of images of a skateboarder in action with a very loud interpretation of the "I'm Lovin' It" theme song from Burnett's in-house music master Ira Antelis. But again the McDonald's connection is tenuous.
Earlier this month in Munich, Germany, McDonald's Global Chief Marketing Officer Larry Light said the unconventional campaign's chief purpose is to let people know McDonald's is changing. But the change has been a tough adjustment for DDB and Burnett, the fast-food giant's two long-time Chicago ad agencies, which had representatives at Tuesday's press event to show their support and help celebrate the American launch.
When this reporter remarked to DDB/Chicago Chairman and Chief Creative Officer Bob Scarpelli how far removed "I'm Lovin' It" is from "You Deserve a Break Today," DDB's seminal campaign for McDonald's decades ago, the DDB executive simply said "times have changed." But it was hard to miss the wistful note in his voice.
Burnett Chairman and Chief Creative Officer Cheryl Berman was on hand too, putting on a game face and a big smile. But for a veteran creative who made her mark with emotionally charged commercials that were gems of rich storytelling, she too clearly was struggling to get with the new hip ad program.
Marlena Peleo-Lazar, McDonald's in-house chief creative officer, said the "I'm Lovin' It" campaign will evolve from the fast-paced imagistic debut spots to a place where there is more genuine storytelling involved. Let's hope so. But it's hard to see how that will happen unless major stylistic changes are made.

...While selling into the rally was high on the agenda, so was buying technology "value" stocks. Leading the tech buys were the King of Prussia, Penn.-based wireless company, InterDigitial Communications (nasdaq: IDCC - news - people ), which took a beating this summer even as other stock prices in the wireless sector were doing well. Its stock price dropped about 39% this year to about $18. The company creates hardware and software products for wideband code division multiple access (WCDMA)--an air-interface protocol for 3G networks. Its stock price suffered this summer in part because of Nokia's (nyse: NOK - news - people ) mid-July request for arbitration with InterDigital over the amount of royalties it owes InterDigital for phones sold with InterDigital-patented technology since 2002. The good news, though, is that in August the company announced that it would buy back 2 million shares of its common stock. It also posted second-quarter net income of $3.16 million, a 27.4% improvement over the same quarter last year....
Lot of activity lately. Those on Yahoo board seem to think that it will be taken public again after it reaches profitability. Something to watch.
