A bill that cleared the U.S. Senate March 24 would expand scientific and medical research on cannabis and its compounds, including CBD.
S. 253, titled the Cannabidiol and Marihuana Research Expansion Act, is sponsored by Sens. Dianne Feinstein (D-Calif.), Chuck Grassley (R-Iowa) and Brian Schatz (D-Hawaii) and cosponsored by Sens. Dick Durbin (D-Ill.), Amy Klobuchar (D-Minn.), Thom Tillis (R-N.C.), Tim Kaine (D-Va.), Joni Ernst (R-Iowa), Kevin Cramer (R-N.D.), Jon Tester (D-Mont.) and Lisa Murkowski (R-Alaska).
The bill aims “to ensure that research on CBD and other potentially beneficial marijuana-derived substances is based on sound science while simultaneously reducing the regulatory barriers associated with conducting research on marijuana,” according to an announcement from Feinstein’s office.
Because cannabis containing more than 0.3% THC remains classified as a Schedule I drug under federal law, strict regulations continue to govern medical cannabis research and few cannabis-derived products have received approval from the U.S. Food and Drug Administration (FDA).
“Current rules and regulations make it hard for researchers to study how marijuana and marijuana-derived medications can best be used to treat various conditions,” Feinstein said in a public statement. “This important legislation will cut the red tape around the research process, helping get FDA-approved, marijuana-derived medications safely to patients.”
In addition to removing some of these barriers to research, S. 253 would also require the U.S. Department of Health and Human Services (HHS) and National Institutes of Health (NIH) to submit a report to Congress on the potential harms and benefits of cannabis use.
“This bipartisan bill is critical to better understanding the marijuana plant and its potential benefits and side effects,” Grassley said in a public statement. “It will empower the FDA to analyze CBD and medical marijuana products in a safe and responsible way so that the American public can decide whether to utilize them in the future based on sound scientific data. Researching marijuana is widely supported by my colleagues on both sides of the aisle, and it’s a smart step forward in addressing this current Schedule I drug."

U.S. Senate Unanimously Approves Marijuana Reform Bill On Same Day That House Schedules Legalization Vote.
The Senate on Thursday unanimously approved a marijuana bill—but not the federal legalization measure that advocates have been eagerly awaiting Senate Majority Leader Chuck Schumer (D-NY) to bring to the floor. Rather, it’s a modest bipartisan piece of legislation that’s simply meant to promote research into marijuana.
The bill—sponsored by Sens. Dianne Feinstein (D-CA), Brian Schatz (D-HI) and Chuck Grassley (R-IA)—is titled the Cannabidiol and Marihuana Research Expansion Act. It cleared the full chamber unanimously, without debate.
It would streamline the application process for researchers who want to study the plant and to encourage the Food and Drug Administration (FDA) to develop cannabis-derived medicines.
It would also clarify that physicians are allowed to discuss the risks and benefits of marijuana with patients and require the U.S. Department of Health and Human Services (HHS) to submit a report on those potential health benefits, as well one on barriers to cannabis research and how to overcome those obstacles.

Schatz said that the “medical community agrees that we need more research to learn about marijuana’s potential health benefits, but our federal laws today are standing in the way of us finding those answers.
“We are now one step closer to removing excessive barriers that make it difficult for researchers to study the effectiveness and safety of marijuana, and hopefully, give patients more treatment options,” he said.
An earlier version of the bill also unanimously passed the Senate in 2020. It was reintroduced in February 2021.

The U.S. House of Representatives plans to vote on a bill to federally legalize marijuana for the second time in history next week, congressional leadership confirmed on Thursday.
The body will take up the Marijuana Opportunity, Reinvestment and Expungement (MORE) Act, a bill sponsored by House Judiciary Committee Chairman Jerrold Nadler (D-NY). An earlier version of the measure cleared the chamber last session but later stalled in what was then the Republican-controlled Senate.
The legislation, which would remove cannabis from the list of federally controlled substances and promote social equity in the industry, cleared the Judiciary Committee again this session, and activists have been pushing for a floor vote this month.
Rumors of potential floor action next week began circulating on Wednesday, with sources telling Marijuana Moment that while nothing had been confirmed yet, the official vote scheduling appeared imminent based on high-level discussions they were familiar with.
Now, House leaders have officially placed the cannabis legislation on a list of bills they plan to take up on the House floor next week. The Rules Committee will officially take up the measure in a meeting on Monday afternoon to prepare it for floor action, including by determining which amendments will be allowed to advance for consideration.
The last time the MORE Act went to the floor in December 2020, it passed in a 228-164 vote, with just five Republicans joining their Democratic colleagues in advancing the reform. One of those five GOP members, Rep. Don Young (R-AK), died last week. He was one of bipartisan co-chairs of the Congressional Cannabis Caucus.
The move to hold another vote on the cannabis legalization bill comes weeks after congressional Democrats held a closed-to-press session at a party retreat that included a panel that largely centered on the reform legislation.

Two sources told Marijuana Moment that they’re aware of high-level discussions about bringing the MORE Act to the floor again next week, but nothing has been officially announced. The prohibitionist group Smart Approaches To Marijuana also signaled that they’re aware of talks to put the bill before the full chamber imminently.
In addition to descheduling marijuana, the MORE Act would further allow people with past convictions to have their records expunged and create a federal tax on cannabis with the revenue going to support community reinvestment and other programs.
It also contains language to create a pathway for resentencing for those incarcerated for cannabis offenses, protect immigrants from being denied citizenship over marijuana and prevent federal agencies from denying public benefits or security clearance due to its use.
Meanwhile, advocates and stakeholders are eagerly awaiting the formal introduction of a separate Senate legalization bill that’s being finalized by Majority Leader Chuck Schumer (D-NY) etc. Schumer recently said the plan is to file that bill—the Cannabis Administration & Opportunity Act (CAOA)—in April.
In Congress, a separate bill to tax and regulate marijuana is also in play this session. Rep. Nancy Mace (R-SC) is sponsoring that legislation, and she said in a recent interview that she’s received assurances from Democratic leaders that her States Reform Act will receive a hearing.

Could the governor face arrest for money laundering?
Under current federal laws, state governments collecting cannabis tax revenues are technically no different than drug cartels. That has to change.
Under the longstanding definition of money laundering and current federal law that categorizes cannabis as an illegal substance, there is virtually no reason that Illinois Gov. J.B. Pritzker—as well as his fellow governors across the country—should not be arrested on federal charges. Consider that on an annual basis, the governors of any state that allow regulated and taxed cannabis markets to break more federal money laundering laws than Al Capone could ever imagine. The FBI should be knocking down the doors of the governors’ mansions in every state with a regulated market.
