Over the past two decades, email has evolved from a novel method of communication to the primary form of correspondence used by businesses around the world. Discovery of emails and other electronic documents has followed this trend to become a fixture of commercial litigation, with its own set of ever-improving methods and tools familiar to inside and outside counsel. Recently, short and multimedia message service (SMS and MMS, better known as text messaging) has exploded in popularity across all categories of users, including businesses, leading to a glut of less formal (and less cautious) "instant" communications as a supplement to, or replacement of, traditional email. While SMS e-discovery is in its relative infancy, numerous recent court decisions should put all organizations on notice: Texts are discoverable, and failure to plan accordingly may result in damaging admissions, adverse inferences or worse.
Several related factors have kept SMS e-discovery from becoming a commonplace practice to date: unfamiliarity with SMS data management, fear of reciprocal demands for SMS data and the general objection that it presents an undue burden under discovery principles of proportionality and reasonableness. With the expanding use of SMS, however, such excuses are going by the wayside. The growing number of decisions on this issue illustrate that plenty of litigants are willing to open this door, and that courts are unlikely to accept a blanket objection based on undue burden. In light of these trends, organizations are best advised to develop strategies and procedures to manage texting practices, to preserve information on SMS devices, and to develop procedures for SMS data management in the civil discovery context.
An organization's well-defined mobile device policy will provide the foundation for managing the use, and preservation, of this ubiquitous form of communication. There are essentially three categories: company-owned-personally-enabled (COPE), bring-your-own-device (BYOD), or a hybrid approach that gives some or all employees the option between COPE and BYOD. While a COPE policy gives organizations the most control over the mode and storage of instant messages, such uniformity presents significant costs and overhead. For large and complex organizations, a hybrid approach is often preferred because it allows increased flexibility at a reduced cost; however, the great diversity of devices and operating systems adds further complexity in preserving and managing the underlying data. For example, while a typical Android or iOS mobile device preserves text messages for some period of time after a user deletes them, both operating systems have data volume limits and hidden automatic functions allowing permanent deletion unless backed up elsewhere or re-configured and actively managed by IT professionals. There are additional usage-based variables that can be impacted by the database rules and architecture of each system, which are compounded by carrier-specific device configuration, as well as cloud-based and other personal storage options. While a growing number of manufacturer-specific and third-party software platforms are being developed to manage data retention on individual devices, there is no industry-standard enterprise solution. These factors tend to make management, data holds, backup and retrieval a case-by-case challenge.
Company-owned and managed-texting applications, or "apps," provide a particularly interesting option to lessen the obstacles presented by the multitude of mobile hardware and software systems, along the lines of an enterprise email server for instant messages. These apps provide a texting platform separate from the "factory installed" applications on iOS, Android, or other operating systems, allowing enterprise-level data retention and deletion policies to be implemented, without the cost of a traditional COPE policy. One potential shortcoming of this category of apps is that they may only support texting between devices that have the app installed, limiting their use to internal SMS communication. Nonetheless, the cost and security benefits of enterprise-level management of enterprise-managed texting apps are apparent.
While this remains a developing area of law, inside counsel and their IT counterparts can take a number of immediate steps to minimize risks associated with SMS:
• Adopt a formal, written texting policy defining the proper use of mobile devices and instant messages, including what topics may and may not be discussed by text;
• Educate personnel to apply the same caution to email and SMS correspondence; whether it is a company-owned or BYO device, all communications, including business and personal texts, may be subject to discovery in the event of litigation;
• Perform an audit of all employee mobile devices and messaging platforms to produce an active and dynamic picture of a company's user base, determining what employees use mobile devices for work, whether they are COPE or BYOD devices, manufacturer, model, and operating system of devices, and what security measures are in place on those devices;
• Develop realistic monitoring procedures, coupled with practical enforcement tools to maximize compliance;
• Consider a third-party internal texting app to provide enterprise-level management of SMS data; and
• Implement proportional and reasonable procedures governing the preservation and discovery of text messages, focusing efforts on key personnel or a control group subset from the entire universe of relevant mobile users. By taking proactive steps to identify the key actors and preserve their texts, a party lays the foundation to argue the steps it took were reasonable and proportional in the event of a discovery dispute.
Like email discovery before it, SMS discovery will evolve as the courts shape its parameters and as vendors and counsel develop the tools and procedures to meet this growing need. The organizations best prepared to deal with these challenges will be those that evolve their practices in tandem with these trends. An affirmative, integrated approach will minimize the risks when—not if—employees' text messages become key evidence.

Here is something to cheer you up..have you been to a McDonalds recently where they have installed those flat screen kiosks so that they hope people will use to order and pay using their card in order to speed the lines/service..well, the other fast food places are not interested in making that investment at the moment because they are waiting on the technology to become available to have customers use their own phones by company specific "SMS" to order and pay. You could pull into the parking lot and before you reached the front door already have your food being prepared and already paid for. $750K is nothing.

Does anybody here know who is providing the messaging capabilities for MOBILE text and video in this past weeks' YouTube blockbuster news? Reason I ask is that it technically sounds only possible with a 3Gen SMS cloud platform. The fact that now any video taken horizontally or vertically from a mobile phone will be automatically 'fixed' for best format while transmitted within the 'Cloud' is further evidence of 3G. I don't believe prior to 3Gen that use of a 'Cloud' was possible for seamless, instantaneous SMS texting..not to mention the ability to text video.
Just think, we now have a white-label partner working exclusively in stitching the sms texting networks between these marijuana communities. Each text is revenue. Now, what is next is partnering with a "payment transaction specialist" company that can handle the buys and sells of the product which will further be a revenue source. This operation has Gold written all over it.

Close on the heels of successfully organizing the GTENSpring conference in Silicon Valley recently, American Tamil Entrepreneurs Association (ATEA), is all set to support yet another conference-- Tamil Entrepreneurs Forum (TEFCON), according to press note received by this correspondent.
TEFCON will be held in Minneapolis on July 1, as part of Federation of Tamil Association of North America’s (FETNA) annual gathering. TEF is a parallel event, scheduled as part of FETNA annual convention to be held from July 1 to 4. This year the Minnesota Tamil Sangam is hosting the conference. TEFCON is supported by the Federation of Tamil Association of North America in association with ATEA.
This event is designed to provide value for entrepreneurs or those aspiring entrepreneurs, executives, early-stage startup founders, graduates entering the workforce, or professionals of Tamil origin, said Vinod Pillai, chair of TEFCON.
Key speakers will be from India-- Ishari Ganesh of Vels University, Isaac Padmasingh of Aachi Masala and Dr Arcot V Kalanidhi, founder of VeeCare Health Center. 420, 4:20, or 4/20 (pronounced four-twenty) is a code-term in cannabis culture that refers to the consumption of cannabis, especially smoking cannabis around the time 4:20 p.m. (or 16:20 in 24-hour notation) and smoking and celebrating cannabis on the date April 20 (which is 4/20 in U.S. form).[3]
In 1971, Steve Capper, Dave Reddix, Jeffrey Noel, Larry Schwartz, and Mark Gravich, five high school students[4] in San Rafael, California,[5][6] calling themselves the Waldos[7][8] because "their chosen hang-out spot was a wall outside the school",[9] used the term in connection with a fall 1971 plan to search for an abandoned cannabis crop that they had learned about,[7][10] based on a treasure map made by the grower.[11] The Waldos designated the Louis Pasteur statue on the grounds of San Rafael High School as their meeting place, and 4:20 p.m. as their meeting time.[9] The Waldos referred to this plan with the phrase "4:20 Louis". Several failed attempts to find the crop eventually shortened their phrase to simply "4:20", which ultimately evolved into a codeword that the teens used to mean marijuana-smoking in general.[10]
Mike Edison says that Steven Hager of High Times was responsible for taking the story about the Waldos to "mind-boggling, cult-like extremes" and "suppressing" all other stories about the origin of the term.[12] Hager wrote "Stoner Smart or Stoner Stupid?" in which he called for 4:20 p.m. to be the socially accepted hour of the day to consume cannabis.[13] He attributes the early spread of the phrase to Grateful Dead followers, who were also linked to the city of San Rafael.[13]

April 20 has become an international counterculture holiday, where people gather to celebrate and consume cannabis.[3][14][15] Many such events have a political nature to them, advocating the liberalization / legalization of cannabis. Vivian McPeak, a founder of Seattle's Hempfest states that 4/20 is "half celebration and half call to action".[16] Paul Birch calls it a global movement and notes that one can't stop events like these.[17]
On that day many marijuana users protest in civil disobedience by gathering in public to light up at 4:20 p.m.[18]
As marijuana continues to be decriminalized and legalized around the world Steve DeAngelo, cannabis activist and founder of California's Harborside Health Center, notes that "even if our activist work were complete, 420 morphs from a statement of conscience to a celebration of acceptance, a celebration of victory, a celebration of our amazing connection with this plant" and that he thinks that "it will always be worthy of celebration".[19][20]
As of 2017 many events take place only days after April 20 or not in relation to 4/20 and global synchronization entirely. While many of these locations are expected to host such an event annually local authorities may attempt to prohibit protests on that day or create unreasonable conditions. However relocation might be required in some cases due to issues such as environmental protection.

In Colorado, the Colorado Department of Transportation replaced the Mile Marker 420 sign on I-70 east of Denver with one reading 419.99 in an attempt to stop the thievery.[42] The Idaho Department of Transportation (ITD) replaced the Mile Marker 420 sign on U.S. Highway 95, just south of Coeur d'Alene, with Mile Marker 419.9.[43] That marker was eventually stolen as well, leading ITD to just post the marker with spray paint on the pavement.[citation needed] In Goodhue County, Minnesota, officials have changed "420 St" street signs to "42x St".[44]

Based out of New Zealand this family, mostly the females, specialized in mens suits. They became famous by making Ronald Reagan most of his early Presidential suits which Reagan affectionately called the 'Alagua of the Zealanders'. Yesterday's TXHD tweet about the "putting the finishing touches to the media kits", which by the way was only up for hours before it disappeared for unknown reasons, still shows how close the company is to 'Game Time'. Media kits are designed to tell a condensed story of the company's development, the present state of affairs and the future route it sees in furthering the growth of the company. You don't have to be a 'pumper' or a 'basher' to see this as for what it REALLY IS...and that is that any company that is "putting the finishing touches to the media kits" is about ready to get the story out there and make a name for itself through the help of media awareness and distribution to the public.
