Another thought--If IDCC and Nokia were currently discussing a settlement outside of the arbitration process, wouldn't this suit keep Nokia honest in a negotiation that would include a 3G rate since a win against Lucent could trigger an automatic 3G rate that Nokia would have no control over. Better yet--Lucent could settle with IDCC ala ERICY and put Nokia in the same quandry with 3G as ERICY did with the 2G settlement!

Lucent is IDCC's FIRST 3G lawsuit--is it not? Tantivy's patents are all about smart antenna which is CDMA2000. My point is that if and when IDCC wins against Lucent, it could trigger EVERYTHING regarding Nokia and Samsung (2G AND 3G rates). Is this the reason for the timing of this suit, i.e. start the 3G ball rolling aside from the Nokia/Samsung arb which is for just 2G??

Jai, I agree with your viewpoint and I believe that IDCC will get very aggresive once we get the warchest of money from Nokia/Samsung. Interdigital gets an additional 300 million or so on top of the 100 million in the bank and THEN there's a new SHERIFF in town and he comes out "guns a blazin"!!

Institutions are beginning to report their year end positions and IDCC has ticked up from 32.8% to 32.9% as the new numbers trickle in.

Here's my answer to the drop today--and you see it constantly with stocks that have risen in value close to options expiration. If there is a large open intereset in calls (true in the case of IDCC -22.5 and 25's), MM's short the stock to drop the price thus causing a hurt in the option call owners--many of the holders close their call positions which alleviates the open interest so those bets are gone. After this occurs the MM's that are short start buying back the shares which brings the price back. Next week we're back testing 25. They do this for a few days just before expiration each month with stocks that fit the profile above.

Data-you are right but my understanding is that HTC will be making a 3G compliant iPac for HP that will be available by mid 2004 that I believe would intersect our IP. I will try to confirm.

Lastchoice-HTC makes HP's iPAQ PDA (formerly Compaq) and currently makes between 1.5 and 2 million of them--HTC is HP's largest vendor for iPaq's and the relationship is a good one!

Jim, regarding the single base station issue--isn't the arguement from those that don't want to pay us that it wasn't an "error of omission"? In fact, they argue that the patents were about fixed wireless local loop at the time and not mobility so the single base station was appropriate for that technology. I have been long for years, as you know, and continue to accumulate so I don't mean to bring this up to be negative, but doesn't that arguement make sense or am I missing something?

So Frank Marsala starts coverage with a "neutral" at First Albany and I wondered out loud if he had a motive for this after he buried the company last summer at Halpern. Then within two weeks of his new coverage (needed to be an analyst covering IDCC to have any credibility in the Forbes article), he is quoted in the middle one of the most negative articles ever written about IDCC. Is this coincidence??!! I think not--He's got it in for the management at IDCC--there's no doubt in my mind and his motives are not in shareholders best interest--He's dirty in my opinion!

4.9.3 TDD Technology Transfer. Commencing April 1, 2000, InterDigital may
at the first such meeting of such committee after the Effective

circumstances, approval to any proposed changes to the guidelines

On the IDCC website under licensees, Seimens is listed as a 3g licensee under both WCDMA and TD-SCDMA/CDMA2000. Is there anyone that can shed some additional light on this as I don't recall a press release from IDCC on Seimens for 3G. Is this a situation like Nok/Samsung where Seimens is licensed but the 3G rate hasn't been established or are they paid up for 3G entirely?

Ronnie-great job on the estimates, I would point out to everyone that you did say your projection for Sharp at 8.3 million was conservative based on a 10% increase over 2nd quarter. There could be some nice upside there. My point is that you have been somewhat conservative in your approach and I agree with it but that only means we could have some nice upside to the .07 cent estimate. Thanks again!

Olddog-the answer to your question is NO. The partial summary judement rulings that could have ruled some of IDCC patent claims invalid were "vacated" and "sealed" as part of the settlement with Ericson. No one will ever know what those rulings were unless Judge Lynne allows Nokia's request for unsealing of those documents.

Regarding the disclosure of IDCC on the amount owed by Nokia and Samsung in the press release--We should also consider the fact that IDCC had "discussion/negotiation" with Nokia for some time (years) leading up to the ERICY settlement. Could it be that Mr. Merritt and the IDCC management decided to write the release with the amounts owed based on the demeanor of Nokia and their frustration with Nokia's position up to that point? I just can't believe that IDCC would want to piss Nokia off by printing that release unless there was more to this than we know. Any comments?

Ronny-To your point ERICY had visibilty to all the adverse summary judgement rulings and knew what they had to fight with at trial. They settled for what they felt was "fair" based on ALL THE RULINGS. We only got a half a percent and I believe it is precisely because rulings went against us. Nokia wants more, and in my opinion, won't get it!

Bullrider-I think you pose the question that I've been struggling with. In the agreement with Nokia, is it the name of the OEM ALONE (Ericson,etc.) that triggers the royalty rate or is there something in there that speaks to market share as well? If it's simply the name of an OEM as some have suggested then your question is mute. I tend to believe there may be more to this and you may be on to something.

Hey Ziploc -- Doesn't your post sound very similar to the situation with Ericson in '93 when apparently they were at the final draft of an agreement between IDCC and ERICY. All of a sudden--BOOM--Ericson supposedly did an about face and filed suit! As Hyman Roth said- "This is the business we've chosen"!

Not for Nothing but I count about 150,000 shares sold in the last couple of days by our executives--no wonder IDCC took a hit Friday once it got to 28.80 and then yesterday. It had to have been a direct result of the selling pressure from these "new" shares!

At the meeting this week during Q&A, a shareholder asked Harry when the executives of the company would start buying some stock or at least exercising their options but then holding those new shares. He got an arrogant Bull Sht answer and today we see Harry continuing to cash in, right in our faces. He does not care about the perception. He doesn't care about the message he is sending. He cares about Harry and I will not be voting for that pompous SOB when his turn comes around again!!
