most who continue to P&M about management and timing issues are folks who
played the options and margin game and have lost money. I feel bad for some of those folks.
there are a lot of folks who have been around a lot longer than my 9 years. some (NOT ALL BY ANY MEANS) take it out on management as well.
some have taken to letter writing campaigns
some have resorted to petitions
some have taken Harry to task
some have been ejected from ASMs
some have tried legal actions
some claim that their pressure has worked (kinda like the claims that earth will spin backwards if we drill another hole in it)
I have been amazed that this company has managed to survive the onslaught of MENS for the last 15 years
BUT the most amazing thing to me, is that they have accomplished this feat while ALSO having to deal with their own shareholders actions.
All the different variations of management that I have lived through have each played a part in the survival of IDCC. WM has had the good fortune of presiding over the final stages of the rebuilding effort.
options were used by EVERY company that was in survival mode and the 90s and early 00s were a hard time to retain even mediocre talent even for thriving companies, let alone a brutalized high tech company that had a target the size of Niagara falls on its back.
They kept their heads down in the hopes of keeping IDCC in tact, and after listening to many of the P&M crowd here, most would conclude management did a better job than a lot of folks here could have done.
Options were a part of business. they were not curtailed by the work of Mikey and his crew, as some would have us believe. I think actions at Enron and accounting measures taken as a result, may have had more to do with it than Mikey.
no, I think Mikey was working for a group trying to take the company private via hostile takeover. no other reason to attempt to change bylaws to force the use of "term limits" on the board.
There were many here on the board that became his patsies. I don't blame them for their actions. some folks can be lead easier than others. I do blame him for the scum that he is and the underhanded tactics he employed. He drifted away after he was unsuccessful in his efforts.
this has been a wild 9 year ride. seen a lot of folks come and go. seen a whole bunch of different agendas on both sides of the bid. it has been a very interesting, as well as educational, study in the market, international business, court systems, greed, fear, and human nature.
This investment has changed me over the years, but the biggest change is just around the corner.
management will get us there. not any one, or group, from this board will change that. All the P&M may make it more of a pain in the sitting muscle, but it will not change one thing management is going to do.
and I am glad of that!
just remember that many among the P&M crowd have been around a long time and are tired. I get crabby when I loose sleep and expect they do too. Some haven't slept in years.

there is another possibility that you haven't thought about. The 2m per Q could be along the lines that IDCC gave everyone else on 2G. up front amount based on projections followed by G2 paid up licence. 3G is a seperate animal. maybe Apple projected selling g2 phones for a longer period than they actually sold them for. maybe someone helped then with the design of the 3G iphone to an extent that they were able to release 3G much sooner than they thought. maybe the 2m per Q is payback for assistance rendered in designing. who knows. we are all still guessing, until the AAPL hits 10%..
Dont forget that the reporting from apple is from Q2. there were no 3g iphones in q2.

I agree that Ronnie has been on the money with quite a few predictions of earnings in the past and respect him for that. I do not believe he has done any good by raising the rabbit that he has about AAPL. the company has stated on many occasions that they have not released any financial information on the AAPL agreement and I believe them. The way Ronnie came back and pulled this rabbit out of the hat makes me think he has ulterior motives. I may be wrong but until the company puts out facts on the deal I think it best for an esteemed poster to not put his reputation on the line based on tea leaves. I believe he stopped posting last time due to some incorrect tea leaf readings. That's all I'm saying. wait for the company to put out the facts.
I hope this tells everyone that they did NOT disclose ANY financial information about the apple contract. NOTHING. any money mentioned in the past discussed 8k were not for apple. the company will not mention any financial data about apple UNTIL they account for 10% revenue. can it be any more plain?

Janet, On the CC yesterday it was stated Apple was a 3-G licensee. Will those phones be providing additional revenues over the 2 million per quarter we are now receiving or are they covered under the current agreement?

We have not made any disclosures about the specific revenue contribution from Apple and would only make those disclosures if and when a customer accounts for more than 10% of the revenues. If you have any further questions, feel free to contact me.

it was never disclosed that we are getting 2 mil per quarter from Aapl. For everyone to say so, including carpenter, and make it seem like fact is not right and detrimental to the company/stock

I don't agree. NOK stood to loose more than IDCC. IDCC could have 30000 or 300 declared in UK and NOK would still not pay IDCC. With a ruling in hand it would be much easier for IDCC to get a license from NOK on at least 1 patent. Its a good idea but IDCC had to get more than just what you are thinking. JMO

the only part I disagree with you on is the volume discount. NO volume discount and one rate for all. $1.50 per phone for everyone would be fair and reasonable and make me happy. only the big dogs do enough to get volume, and we all know they do not deserve a discount to make amends for past pokin'
If we lose on this, it is ok with me because as I have stated, my hope has been all are licensed for the same rate up to a certain amount and thereafter discounts for volume etc kick into play.

I have disliked the rule used to report the earnings for some time. it is not realistic when doing comparisons as you point out. It does need to be changed.
i believe it took the fear of 1929 to cause the congress to enact some very smart and enduring regulations on the market. over time, congress has watered down most of those rules and see what we now have? I hope it doesn't take another 1929 style melt down to wake up the bunch in DC. bailing out fredie and jennie could double our deficit overnight and burden our kids with a hell of a bill they may never be able to crawl out from under. when 51% of a society bellies up to the trough it is all down hill from there.

the reward at the end of litigation must actually be several times greater than the present day difference because it will receive only a 1 to 1 multiple for past royalty as cash in establishing the new market cap and resulting share price. In fact, often times past sales are forgiven or discounted significantly in reaching settlements. The royalty received now as recurring and increasing revenue is far more valuable to IDCC than as a one time cash infusion several years down the road. The immediate cash flow will give the company much more freedom and latitude to continue its business plans presently and in the future. The day to day business at hand will be easier to handle without the uncertainty and distractions of litigation.
