Yes they can, and it doesn't matter if they are allready infringing or not, the ruling will state that the patents are effective protected, and if used you will have to pay royalties.
offcourse the court adjudications will be overturned if you make misstakes in the procedures, everyone knows that! Murderers rapists and drugdealers have walked on procedural misstakes. When things come together here we see 0.05+ in a couple days, untill then we speculate on possibilities. If you don't get that you should trade on other exchanges, it will save you a lot of money.
I know the history of this company better then you do, in fact I know it more then enough to not get stuck in it like you did. That aside, offcourse I'm looking for a quick ride up, who doesn't. Then why did you wait for it to tank to trips??? I bought a position here in 2009 but sold right after I discovered it could take a while for this to go somewhere. I loved the GERS story, but I knew it was a startup company. I anticipated them getting the patents and enjoyed that brief ride up after taking a position for the seccond time. It is my third time now that I take a position in GERS, in anticipation of a ruling in the littigation new financing and new business oppurtunities that will create revenue. I think we will see a BIG pr real soon.
Nobody is not a basher, he's just been here for too long. pennystocks are all about momentum, even with a company as GERS. Which in my opinion is a real company, and will get there soon. But the fact remains that it's still a startup company in need of cash. I think this is the perfect moment to get in, i could be wrong though, and the second I realise that I will get out and wait again for the right moment. I believe this is the best way to play these stinkie pinkies, and my guess is Nobody stuck around for too long.

This is what they call the grand finale. This is where all the effort thecompany made comes together in the finale, in this case they got the patents and are fighting for the rights that come with those patents. Also they already have steady revenue and still growing. The littigation is a no brainer, so GERS will be a big player in the corn extraction business whether you like it or not.

I just told you that the only thing that's keeping shareholders away is DILUTION, you need to read better. It's obvious that infringement is negativley impacting revenue, because the infringers aren't paying royalties for the patetnts. You're just stating the obvious here.
As soon as the court rules that there has been patent infringement (and they will) royalies will kick in in retrospect and future for all these infringers. then revenue will be impacted very positive (stating the obvious just like you do).
There may be a R/S in the near future because of the liquidity needs as I stated in my earlier post, again this is the only thing that's keeping shareholders away.

The littigation is just formality, patents have already been awarded and patent infringement has already been established. Lawsuits cost money, althoug there's already revenue it's not enough to cover the littigation costs, ergo dilution. This is the only reason shareholders are staying away from this at this point. they are allergic for dillution. But stating that this will be a very hard road to take is bulls**t.
