Just trying to keep all this in perspective and not forgetting the history we have endured from past posts of old and many thought this would settle 2 years ago, then 1 year ago and so on!
Will our adversaries say ,fine we don't get all the releases and sue us?! Now will our lawyers still get paid from the general wamu fund or will they work for the prize? To me this comes down to how much this will cost and will it cost them more later if all gets settled as it is now?

This whole conversation brings me back to 2008,2009 when we tried to figure out why our lawyers of past(now our adversaries IMO) were doing and why they didn't do this or that! Anyone else get this? Nothing seems to be what we say it should be and so many great folks along with the best DD can be bamboozled!? maybe?

I agree and organizing folks to demand transperancy and light a fire under their arses is what I preached awhile back along with advertizing, product dev.,employee count and so on!

I think the state of Utah may only care of tax revenues and jobs maybe? Do they have power over the judicial system? maybe but I am in another bk and its been gruling and many powerful folks can twist truth till it fits but I am hopeful for CPRKQ and other bk's!

Now that would surely help alot of folks if that happens but..I would like very much to just see 10 a share but...all may take time and this judge makes me nervous as I read alot of big statements but we sit at 5+cents a share!
I am here waiting like everyone else and pray for the judicial system to rule with integrity but that examiner really hurt and lets not forget our lawyer of past who drop us!

As I read your post, full of wisdom and journey to a magic kingdom, I picture a wise old man sitting on the porch,rocking and telling of the glory days of old! I also see this person who is very protective of its land and will defend to the end. I say all this with oodles of respect and I feel small in this land of Milford that is full of treasure both metal and its people but the decisions are being made through the courts whom have some bias towards folks with money at times and our great USA is slowly being sold in some form and fashion to others for payment of debt, to simple greed by a few and that hurts to no end.
Maybe a vision by the wise judges and politicians of this land needs to understand the ramifications of their decisions that could lead us out of this mess,maybe?
Milford is one of many great places here in our great country that many have died trying to get to and defended. All of it was a vision of milk and honey and gold "in them there hills" but freedom without oppression along with a people who owned the land and not the government but I do not see that vision so clearly now. That fear is always in my mind till the day of old becomes alive once again, a vision worth repeating.
Always enjoy your posts and I seem to be challenged to see it a different way! I thank you for that!

Happy New Year all and its always tough to say goodbye but I will say,"see ya later" on another board as I watch my friends come and go to other stocks.
I watch CPRK but from a distance as it hurts to see it go to BK court and fight for its existance along with common shareholders.
Many good folks here and I hold hope for the Milford Miracle and will always be here in my mind and thoughts.
This town could use a good employer and maybe this court recognizes the value of jobs vs. mind numbing court banter that seems to serve the very wealthy at times but time will tell.

It does seem bad for this stock as it seems to tumble but who would buy that many? Usually but not always, seems to be a player who sneaks in but also a fool,maybe?

I also think that I never was exposed to a judicial system the way I percieved it(as in honest based on facts) but to see it this way for 2 years has been a learning experience!
I ask this question to our legal eaglrs, does the judicial system on a county(or any level not federal) level work this same way? Would a smaller court tolerate and spend countless millions and allow this falacy to continue?
I am ranting on these boards(not at you Speculator777), to vent in civil way and express my freedom of speech and just maybe one person today will say, enough is enough!

I speak for myself as to say, "I have no sense of humor" when it comes to Wamu and this takedown! I believe you may be sparking this fire but I think its been raging for over 2 years and many have kept it stoked with so much awesome DD and all some of us can do is fan the flames as to reiterate whats been said.
I think a barrage of objections will indeed keep this judicial system questioning motive by our adversaries and what is the truth and can the world handle the truth one might say,maybe?
I can say I am tired but have not given up till this finally ends with a great dinner in Vegas or simply at home where I can keep making the morgage payments, either way the American Spirit lives on and is worth fighting for!

Have not read many posts from you but from what I have, you are a straight shooter and appreciate the posts.
I have said something along the same lines as if the judge can rule according to law, truth and integrity, we should fine but your absence of corruption comment seems to fit this case as we have seen enough back door dealings from our so called lawyer from 2008 as well as our own federal gov. I cannot say that name as it hurts my soul!

Liquidating Trust Structure Is Key to Maximizing Payouts

The use of liquidating trusts in Chapter 11 reorganizations or other restructurings continues to grow. By segregating into a trust specific assets available for liquidation and eventual payment on creditors’ claims, practitioners have created an effective tool for streamlining the confirmation of a plan of reorganization or an out-of-court restructuring.
Maximizing the recovery for unsecured creditors is the primary goal of every liquidating trustee. However, not every liquidating trust is structured in a manner that allows its trustee to achieve that goal easily. Recently, the liquidating trust created at the confirmation of the liquidating plan of Farmland Industries, Inc., paid out more than 100 percent of the allowed claims of unsecured creditors. The company’s unsecured creditors received about 20 cents on the dollar more than anticipated at the time of confirmation.
However, that was not a result of uncovered assets, a “mega-judgment” in favor of the liquidating trustee, or just plain luck. Rather, several structural factors and initial strategies played crucial roles in maximizing the payout for the beneficiaries of the liquidating trust. This article highlights those factors, which turnaround practitioners should consider in structuring and negotiating a liquidating trust to facilitate a trustee’s ability to maximize recoveries for creditors.
Most large corporate Chapter 11 cases or restructurings are very contentious. Consensus among the debtor, the creditors’ committee, and other parties in interest is often difficult to achieve, resulting in more time and money being spent to obtain a resolution. However, with the creation of a liquidating trust and the appointment of a liquidating trustee, that adversarial environment can change immediately, provided that certain structural enhancements are incorporated into the governance provisions for the liquidating trust.
First, the trustee should report to a governing committee that is representative of the beneficiaries of the liquidating trust. Generally in a Chapter 11 scenario, the governing committee is comprised of former members of the creditors’ committee(s), but at a substantially reduced number. In Farmland Industries, for example, representation of the two former creditors’ committees on the governing committee was limited to four members (two from each committee). Reducing the number of members on the governing committee, while maintaining a representative balance, allows the governing committee and the liquidating trustee to operate, deliberate, and make decisions more efficiently.
Second, a liquidating trust’s structure should provide that, absent a conflict, the governing committee and the liquidating trustee may be represented by the same counsel and other professionals. This should assist in the common goal of maximizing value for the beneficiaries of the liquidating trust. The liquidating trustee’s administrative efforts in obtaining necessary approvals from the governing committee will not be hampered or delayed by the logistics of obtaining the consensus of a large number of people. Additionally, regularly scheduled in-person meetings among the governing committee, liquidating trustee, and counsel fosters good working relationships and are instrumental in keeping all parties well informed and on task so that decisions can be made promptly when circumstances require.
Another essential component to preserving and maximizing the value of the liquidating trust’s assets is the trustee’s access to key employees of the debtor. If the corporate debtor is to be dissolved, the liquidating trustee should be given power to retain and manage key employees to perform specific tasks related to the preservation of assets. In the case of Farmland Industries, the liquidating trustee retained about 25 former Farmland employees through the first six months of administration. Specific functions necessary for the effective administration of the liquidating trust’s assets should be identified at the outset, and former employees with extensive historical knowledge and appropriate skills should be matched to those functions.
A liquidating trustee also should have authority, subject to approval of the governing committee, to provide appropriate retained employees with performance incentives tied to the recoveries of the trust’s beneficiaries. The contributions of the former Farmland employees in assisting the liquidating trustee in resolving $120 million in disputed claims, preserving and managing volumes of documents and records material to pending litigation, and otherwise winding down the business of the debtors benefited the beneficiaries and more than offset the cost and expense of their continued temporary employment.
Another critical point for laying the groundwork for a liquidating trustee’s success is the decision of which professionals to retain. The overall strategy to maximize the recovery for beneficiaries in an efficient and cost-effective manner should be predicated on the liquidating trustee’s ability to retain the professionals, usually those already involved in the restructuring or bankruptcy proceedings. This is a core strategy that will allow the liquidating trustee not only to hit the ground running, but also to maintain that momentum in achieving the liquidating trust’s goals. If conflicts arise or existing professionals simply decline to continue their involvement in the matter, other appropriate professionals and experts should be retained.
The parties involved in establishing and negotiating the structure and terms of the governing trust documents must ensure that sufficient funds are provided to administer the liquidating trust properly. With Farmland, an amount equal to the budgeted operating expenses and professional fees for the liquidating trustee was fully funded in a separate reserve account from day one. Although this may segregate a significant portion of money from the funds initially transferred to the liquidating trust that otherwise might be available for immediate distribution to beneficiaries, the long-term administrative requirements and goals of the trustee require that the trust be fully funded at the outset. Having adequate reserves allows the liquidating trustee, the governing committee, and their professionals to avoid having their thoughtful strategies limited or their reasoned decision making unduly influenced by the need for immediate operating liquidity.
Finally, a suggestion about the mechanics of actually liquidating assets in today’s economy is in order. The challenge for every liquidating trustee is locating—or more often, creating—the “market” that results in maximum proceeds for the beneficiaries. Although most governing trust agreements empower a liquidating trustee to liquidate assets through private sales, one also should consider the potential benefits of using Section 363 of the U.S. Bankruptcy Code if it is available.
Presently, a liquidating trustee may easily create a market for an asset by selecting a stalking horse bidder, noticing the asset for sale by auction to qualified bidders under Section 363, and obtaining court approval for the sale with clear title. The expediency of Section 363 sales, coupled with the unprecedented amount of capital seemingly available today, may expand what previously was perceived as potentially limited markets for certain assets and thereby materially increase the anticipated liquidation value. Admittedly this strategy may not result in a “home run” sale price; however, it may result in a consistent series of “doubles” that can add up over the term of the liquidating trustee’s administration.

IMHO=in my humble opinion, sometimes companies need help and shareholders can indeed help by buying shares but without some pressure from us, some may say they rely on just a few avenues for touting their product and so far that may be the case,maybe?
Feet to the fire, I am asking for folks to just ask the tough questions and keep asking as we tread a territory already blazed by another and it also seems to me that their commercials from the competition is ramping up as to say we can out spend you in ad dollars,maybe?

As much as I don't want to quote you but some of the reason why we do get out maneuvered is maybe because we all like to discuss in public about all that is happening, past present and future. We tell them what we feel and know and we let them(adversaries)know what our lawyers should do or what can be done.
Get enough folks from all over the world and eventually the playbook is written and all will have a copy including the adversaries.
To me this whole case is about deception and mis-direction with a huge pot of gold for only a handful of greedy folks who seem to win more times then not!
I am NOT on your side because you have written some posts that really played with folks mind but even you can tell the correct time atleast once a day!

Indeed those docs seem to carry alot of weight but if they were that good for us the EC then why even entertain a POS POR to begin with? Why not start putting folks in jail if indeed those docs carry that much damming info? We are mainly speculating on a day to day stuff but I am more interested with hard facts and information with transperancy as number of employees suchas sales, engineers, product developement ect...that type of information can lead to big fish and then maybe an explosion to the upside in my opinion,maybe?

Great thoughts and may I say what I said earlier, she is in the middle of the road and trying to be fair but if a person who represents us in court that does not have any formal law experience(training) says what she did, this judge has to be pulled our way as we can read whats happening so I hope she can see this too! (No offense or dis-respect Ilenes)! I really thought Ilenes was a lawyer when I heard her speech but she did clarify her credentials earlier today.
Also enforce previous ruling would also help in my opinion.
