SmartBiz and I were talking earlier this morning on the phone about the suits which NEOM has brought against the 4 defendants; Virgin, L-Scan, Scan-Buy and AirClick.
We have all recently been informed by very astute fellow longs that the L-Scan/Symbian booth at CeBIT has been withdrawn and that some of the court appearances have been moved to the court systems in the home towns of these defendants (as permissible by law).
Questions:
1.) When do Cease and Decist Order's actually take effect?
2.) Is it immediately upon receipt of the treble damage patent infringement suits (treble damages because all defendants were previously contacted and warned by Baniack & Pine regarding patent infringement on NEOM's intellectual property)?
3.) Are Cease and Decist Order's automatically enforce after the standard 30-day grace period required for each defendant's response?
4.) Does implementation of the Cease and Decist Order depend on the type of reply from the respective defendant?
5.) Ordinarily, can Cease & Dicest Orders be postponed?
6.) Finally, could a Cease and Decist order be one of the reasons why L-Scan/Symbian pulled their booth from CeBIT at the last minute?
We know that the practice of law is not a predictable science and that you may not have the answers to all our questions. Furthermore, we felt it best not to contact Baniack & Pine with our questions directly, as we wish to keep it in an open forum. We also wish to respect the Rank & File of the contracted parties without interferring in the legal process.

Executive Summary
NASD is delaying the effective date of amendments to Rule 3370 (Prompt Receipt and Delivery of Securities -- the "Affirmative Determination" Rule) approved by the SEC in November 2003, until April 1, 2004. The amendments expand the scope of the affirmative determination requirements to include orders received from broker/dealers that are not members of NASD ("non-member broker/dealers"). The effective date of the amendments originally was February 20, 2004. NASD understands that some members need to make significant technological changes to their systems to comply with the new requirements; therefore, NASD is extending the effective date to provide members with additional time to make such changes.

Discussion
As further detailed in Notice to Members 04-03, the SEC recently approved amendments to Rule 3370 to require that, prior to accepting a short sale order from a non-member broker/dealer, a member make an affirmative determination that the member will receive delivery of the security from the non-member broker/dealer or that the member can borrow the security on behalf of the non-member broker/dealer for delivery by the settlement date. In addition, the amendments provide exemptions for certain proprietary orders of a non-member broker/dealer if those proprietary orders meet the same conditions for exemptions applicable to proprietary orders of member firms, and the following two conditions are satisfied: (1) the non-member broker/dealer must be registered with the SEC; and (2) if using the market maker exemption, the non-member broker/dealer is registered or qualified as a market maker in the securities and is selling such securities in connection with bona fide market making.
As approved, the effective date of the amendments was February 20, 2004; however, NASD is delaying the effective date of these provisions until April 1, 2004. NASD understands that some members will need to make significant technological changes to their systems to comply with the new requirements. NASD believes that delaying the effective date of these amendments until April 1, 2004, will provide members the additional time necessary to make changes to their systems. I assuredly do not have the answer to your question. There are many of us Longs who have well over 1Mil. shares and I would estimate that most average holdings are above $0.10/share, which infers we are down, and some quite sigificantly. However, a bottom does appear to be established at these levels.
Some people have bought a stock. Subsequently they seek to enter and exit; all along watching the pennies in either direction on an hour to hour basis.
On the other hand, as Retired has said, there are those of us who have bought a company. This creates a definitive and tangible shift in perception, driven by all together different motives. Simply put, those of us that are buyers of companies as opposed to stock traders view and react to things differently.
I learned long ago there are 3 kinds of people in this "Cause & Effect" world of ours as follows:
1.) those that watch thing happen
2.) those that make things happen and
3.) those that wonder what the f*#k happened
I choose to be on the side of making things happen. Thats why we take the initiative to write reporters about enemic reports on PaperClick or start message board forums to create a pooling of information and DD or send packets of information on NEOM to people like Chris Gessel, Editor in Chief of Investors Business Daily. There are countless other things you and I can do together to champion our cause, that we can not do alone. I hope this helps. All the Best, JP

Well said. Most new inventions are met with frought and skepticism. It's only human nature. Don't forget, Critical Mass is needs only 10% of the populus to bring about a 90% chane in the way people adapt to a new technology. This is a powerful Universal Principal. I think once this technology is previewed and in a proper forum, it will ignite.
I also liked the article because it presents compelling public awareness or the lack thereof; a guide for which NEOM can now change course and tack by a degree or two.
Its similar to a fine-tuned engine. Like PaperClick, the engine is built and able to perform powerfully well. All that is needed to push out the additional horsepower is a minor adjustment. As road conditions change, so will the adjustments. But it is built, up and running! All the Best, JP

Government Wants to Track Patients' Use of Prescription Medicines

WASHINGTON (March 1) - President Bush's national anti-drug strategy will for the first time target the use of pain relievers, sedatives and stimulants for nonmedical purposes, a problem that has exploded in the last decade.
A key part of the strategy being released Monday involves government efforts to help states develop monitoring systems to track a patient's use of prescription medicine. The monitoring programs flag cases that indicate a pattern of abuse, such as "doctor shopping," where a patient gets prescriptions for drugs from multiple physicians.
Prescription medicine now ranks second, behind marijuana, among drugs most abused by adults and young people, said the report by the White House's Office of National Drug Control Policy. It cited a recent study by the Health and Human Services Department.
Twenty states have prescription monitoring programs, the report said. John Walters, director of the drug policy office, said he expects to expand the program to 11 more states by next year. About $10 million in federal funds will bankroll the expansion.
With painkillers such as OxyContin and Vicodin widely available on the Internet, "pill mills" or rogue online pharmacies will come under increased scrutiny.
The Drug Enforcement Administration plans to aggressively pursue pharmacies selling controlled substances illegally over the Internet, an effort that will include deploying modern Web crawler technology to search out those peddling prescription drugs online.
Physician training and education programs will also be a part of the new campaign.
The Drug Policy Alliance, a New York-based group that promotes alternatives including the legalization of marijuana for medical purposes, was skeptical of Bush's strategy. It saw unintended consequences that will end up causing more pain and suffering.
"The principal impact of this campaign when you step up the law enforcement response is that doctors will err on the side of under-treating pain," said alliance Executive Director Ethan Nadelmann. "So any time a doctor is dealing with a patient in pain, their first instinct is not to prescribe enough."
Since 1995, emergency room visits from prescription drug abuse have risen 163 percent, the report said.
To highlight the problem among youth, it noted a University of Michigan study that found abuse by high school seniors of Vicodin more than double the use of cocaine, Ecstasy or methamphetamine. One in 10 seniors, it said, reported nonmedical use of the painkiller.
Mark Surks of Kendall Park, N.J., who lost his son, Jason, a few months ago to a drug overdose, said he had no idea the 19-year-old was buying OxyContin and the anti-anxiety drug Xanax on the Internet.
"I was blindsided," Surks said. "There was no evidence that my son had ever been using any kind of drugs. He was a good kid. He was involved in the religious community, in sports and in music. He had tons of friends. It never crossed my mind that prescription drugs were a problem."
Surks praised the new focus by the White House on prescription drugs.
Bush outlined other facets of his anti-drug strategy during his State of the Union address in January. They include additional financing for drug-prevention efforts and a sharp increase in funds for schools that want to use drug testing to expand early intervention programs.
His proposal to boost funding from $2 million to $23 million for student drug testing has come under fire from some parents, school administrators and civil liberties groups concerned about privacy violations and the effectiveness of the testing.

As I've said before, the US Host Provider slot is unfilled at present. I have seen indications that Apple and/or HP might very well be interested in this position here in the US, with VodaFone vying for the lead in Europe.
This is going to be quit an exciting next couple of months. And tomorrow, Monday, 03/01/04, Virgin will is required by law to formalize a respone to NEOM's patent infringement suit...treble damages style. A share buy back is always possible to reduce the share count. So is a reverse split. Not many of us Longs are partial to a reverse split, at least that I know of. I'm not sure of other means by which a company can retire shares in the public float. Retired could probably take a good shot at this one for us.
Also don't forget, XM and Sirius Satelite Radio had enormous amounts of shares in the float when they exploded. When a company becomes hot such as these two did, the shares are bought up quickly by the Big Kahuna's, i.e. Mutual Fund Companies, Hedge Funds, Pension Funds, etc. So, having +160Mil. shares (albeit this quantity maybe out of date) in the float may not be as negative as one might suspect, provided they don't continue to dilute more shares into the float.
Also keep in mind that the float amount is quite different from the outstanding share amount. All the Best, JP

SmartBiz, brilliant drill-down on Aura! Here's what I believe may impose an infringement on NEOM's patents as follows:
"You simply point MicroSoft's Aura device at a barcode and the code displays a list of Web links with information about the bar-coded entity. You then select which URLs you want to view and subsequently can call up the information on your PDA about the entity in question..."
Sounds exactly like click to server for bar code data and link to URL server for brand product information. That's 2 servers! And that folks is NEOM's patents!
It would be wise for MicroSoft to cut a deal with NEOM as the North American Host Provider before someone else (Apple, HP, ATT) beats them to the punch. This position is open for enrollement gang, but for a limited time only. More will be revealed. All the Best, JP

Regarding NEOM's patents, in accordance with the International Patent Protection Agreement, there are 120 countries world wide who actively participate. I suspect that NEOM has been involved in getting their patents covered in this treaty due to the fact NEOM was the first to obtain patents for this technology starting from the late 80's to the present; specifically 1995 was a big one for NEOM. NEOM doesn't necessairly need to blow Bango away. What NEOM's approach has been is for firms Bango, Virgin, L-Scan, ScanBuy, etc. whose impose upon NEOM's patents to pay a licensing fee. The fee will allow them to use NEOM's proprietary rights in owning the bridge and ultimately cross it. This aspect of NEOM's business plan is simple, its a freakin Cash Cow. Can you say Moo Moo?
