The issues mentioned were likely the reason for the original extension. During the extension, there has likely been talks going on with the SEC about delaying it past the original extension deadline due to other issues. My friend from law school said that this is sometimes done in order not do disclose anything in the extension filing. He did say that it was a POSSIBLE reason but had no clue if that is actually the case.
The MM's will work with Hedges and other big investors, so when they see absolutely no volume on the bid side, they start filling up those bids all the way down to any resistance, hoping to catch a few loss limit shares on the way and hoping the down turn will also make a few nervous investors sell some shares.

They have plenty of time to establish a sales and marketing department for commercialization. They are at least 6-12 months away from approval, and it would be premature to start hiring and training staff at this time.

You have to only look at date of DL. Anything else is not important in regard to timing of TLD.
Then you have not been invested in many Biotechs with a phase III study. 3 months between DL and TLD is not unheard of.

In regard to Flaskworks, I think both situations are an option. Either NWBO could keep the production in house and let Merck handle the sales and marketing or they could sell it to Merck. It seems from the hiring during the last few months, that they are preparing for production.
As for approval, don't estimate good old US vanity. The FDA was just stood up by MHRA on Covid authorization. That will likely happen with DCVax=L too. The question is how long it will take them to follow along with an EUA. I think we will definitely be up and running in UK first. EU might follow suit, though they are just as difficult a dance partner as FDA. The fact they will start production for UK market will give them an advantage with FDA when it comes to proving the production is stable and can be done safely.

I have really no knowledge about biotech deals like the one I suggested. I have been involved in licensing and production deals in other industries and I would not know if the frameworks used in those would be available in Biotech. I just see it as an alternative to a buyout, where LP could still control the product, yet would avoid the headache of scaling and having to set up a sales and marketing department to handle commercialization. I agree, that they should be ok in regard to actual production, so at least that part should be workable for them.
They could ask for an upfront payment for the immediate future. Let BP (Merck) handle production and commercialization, which would make sense considering the network of physicians that are currently prescribing Keytruda. They could then turn their focus to Direct.
I would make a small wager with you that no BP will have a substantial equity interest in NWBO for the next 12 months.
Don't forget that a partnership agreement doesn't have to include any ownership. It could simply be a deal for Merck to be producing and commercial agent for DCVax-L, with a pre-determined percentage profit sharing. That way NWBO would get an large income stream and Merck could guarantee themselves an extension of the protections they will have for Keytruda, as a combo drug with DCVax-L. It would also let NWBO continue to develop the other products related to DCVax-Direct.
I am in the same boat in regard to being optimistic. I think we are seeing some amazing anticipatory action in the SP. It should be a wild ride when they start their information release process.
The important issue is not whether this common law rule applies in this case to NWBO. The important issue is that DI believes it applies to NWBO and that company looks to be acting like it applies, through DI's statement earlier this month.
It's a 1 person firm handling 11 clients totaling $3.4M. She seems to semi retired. She has a stellar career, but she is no longer a big fish. That doesn't mean I am not happy for her articles, but they hardly move the needle.
I am not a scientist and will never claim to be an expert on the science behind any of the products that NWBO are in the process of developing.
I also am convinced, based on previous statements of LP in regard to the valuation she puts on NWBO, that we are far from being in a position to accept ANY buyout offer.
What are the odds that LP is in the process of either a sale of DCVAX-L or a partnership where a BP would become the agent for commercialization of L, possibly later on Direct and other vaccines currently in the works? I have seen several small biotechs selling off one of their products. Maybe the best way to get immediate value to NWBO is to isolate L and either sell or let a BP become the commercial agent for L. If we take LL's enthusiasm of the combo trials, a company like Merck would extend the value of Keytruda for a period beyond it's current patent by either buying L or doing a deal, where they become the commercial agent for L. That would create a nice stream of income for NWBO over the next many years and it would avoid the pitfalls of NWBO getting involved in scaling the company for production and commercialization. It would essentially let NWBO continue to do what they seem to do best, develop drugs related to the science behind DCVax. It would also keep LP assured that the drugs would reach patients in a fast and efficient manner and make LL very happy that NWBO will have the funds to continue to develop drugs to help cancer patients.
This is just my thoughts on the subject of commercialization in a faster and more efficient manner. I doubt LP will relinquish control of the drugs in the pipeline, which this will prevent and let her continue on her crusade against ALL solid tumor cancers, while giving patients with Glioblastoma the drug they need.
In addition to the above mentioned advantages, it would also get most of the FUDsters and shorts off her back as a deal would eliminate all the doubts about the future of NWBO and their capabilities to take drugs to market. I really think that would create a safe and smooth ride to a market cap we all know this company should have.

I find it absolutely reassuring that something great is about to happen, when you look at all the fools showing up again today. The length these people go through to help us all is amazing. We just made 20% today and now they are trying to save us from doom. Every time that happens, I know it is time to add to the holdings.
Doubt a little article can make it move like this. Someone might know something. It was bound to happen when more people know the results.

I agree 100% that rules are out the window during the pandemic. They would never signal this as that could lead to many companies not even trying to adhere to the rules. I am also pretty certain that NWBO are in communication with SEC during this period to keep them updated about the progress. As you said, with the legal and regulatory expertise we have, both in-house and outside counsel, it would be a failure of immense proportions if this was not approved by the SEC. I highly doubt this delay will have any effect in the future.

Just a little side note regarding the flu. The lives saved due to the Covid restrictions when it comes to the flu is quite significant. Here in Clark County (Las Vegas) we have yet to have any deaths cause by the flu this year. Last year at this time 10 people had died from the flu. I assume that is the same all over the country. I know 10 people doesn't sound like much, considering the lives lost due to Covid, but I think the overall numbers in the world is significant.
I agree it is not definitive in any way, but as it has been part of almost every single correspondence, I feel I am able to deduct that it is the stance of the company. I never said that my initial post was anything but my own opinion. I said I think it was my own view that MY OWN expectations were not based in reality. I came to that conclusion when looking at DI's continuing reference to the DL PR. Everyone on this board should make their own judgements based on information they value. Mine was that at a certain point, I based my expectations on what I feel was an unrealistic timeline.
