SEC sues telemarketers for stock tips
One settles, charges pending against two others
By Robert Schroeder, MarketWatch
Last Update: 12:19 PM ET May 3, 2005
WASHINGTON (MarketWatch) - A Georgia-based telemarketer and his companies settled federal charges in a "pump and dump" stock tip scam, the Securities and Exchange Commission announced Tuesday.
Michael O'Grady agreed to pay back $50,786 in ill-gotten gains and a $25,000 penalty for participating in the scheme, which involved voice mail messages to thousands of U.S. residents touting at least six microcap stocks.
Several of the messages were left by a woman who called herself "Debbie" and acted as if she misdialed when calling a friend to leave a stock tip.
Among the stocks touted were Maui General Store, Inc. (MAUG: news, chart, profile) , Innovative Food Holdings, Inc. Triton American Energy Corp. and Yap International, Inc.
The SEC said the scheme drove up the price of those stocks by a combined $179 million in 26 days.
O'Grady is also facing a likely prison sentence of 10 to 16 months and a $250,000 fine stemming from separately filed criminal charges.
The SEC is also charging David Whittemore of Dallas, Texas and Whittemore Management, Inc. with broadcasting similar fraudulent "wrong number" voicemail messages in an effort to lure consumers into buying stock. Peter Cahill of Houston, Texas and Clearlake Venture Group, which he controls, are also charged in the same complaint.
"It looks like the second scheme is a copycat of the first scheme," Peter Bresnan, the SEC's associate director of enforcement, told reporters Tuesday.

axclr ... do you mind me asking what you're talking about ...
what i do?
found the news you were talking about ... sorry!
but what a coincidence ! !!
(or does this stuff happen all the time ... re SEC going after pumpers)
dwudman!
am i missing something or was that a ruse to get us to see the SEC "sues' news ...
(no rhyme intended!)
thanks clancy ...
it's all over my head but i appreciate your trying to explain ... all i know is my buy order went through this am @ .25!
i thought about making it for twice as much as i did (just hit .35!!!)
hindsight sucks!
if what you say is true it explains why my buy order sat @ .25 all day ... when it's been slow i've never had trouble with a buy going through @ .01 above the low ...
and the creeps being back on rb IS usually GOOD NEWS ... maybe ... soon?
as far a i know/knew blazed is/was one of the good guys but he sorta lost it when the bashers came on strong and disappeared ...
he never posted on this board so IF it's him he would have had to register ... could be him
how do you know what the bid/ask price is?
BLAZED!!!
where the hell you been??!!?!
happiest of belated birthdays ol'dude!
sorry to have missed all the fun yesterday but t'was past my bedtime ...
who'da thunk dwudman could sing ... re his rendition of "oue eee oue ah ah, ting tang, walla walla bing bang, oue eee oue ah ah, ting tang, walla walla bing bang"!! (i'd forgotten that part)
what a day you had ... hope the rest was at least as festive!!
2f2
(i named my purple iMac the 'OneEyedPurplePeopleEater' inspired by (among other things) you guessed it)
not one of your funnier jokes ...
i got you beat dwudman -
FIRST i buy a stock and it goes down THEN i sell it and it goes up ... i know, don't give up my day job
clancy ... re the 7 minutes in question, the 5000 @ .35 @ 1:56:10 was mine ... don't know about the others
placed that buy order a week ago just in case ... honestly, i'm still shocked that i got it ... thought those were sell orders at that price
OT ... for my money, the theory of the lone gunman was the biggest conspiracy of them all!
not to be a downer after our first green day in days BUT ...
if it was a holiday in canada couldn't that account for the low volume/high(er)pps?
(remember reading the MMs in question are supposedly in canada ... yes? no?)
that was positively chilling ...
if i understand correctly, it's like share dilution in the extreme ... right?
what insanity allows that kind of manipulation to lawfully continue ?
it's sums up ALL i dispise in our society ... GREED!
not your basic, run-of-the-mill greed which we ALL have or we wouldn't be here day after day, but greed to the detriment of others ... it's OBSCENE! the creeps should be disembowled ... slowly!
i'm more than a little disgusted and yes, a lot naive
lloyd
just woke up from a nap and reread my post to you ... sorry if i was a bit harsh ... all i know is speaking with them quelled MY fears as to their being legit and stuff like that ... as for the pps ... unfortunately it looks like a trend (except that i don't know squat about trends) until they can land themselves on a bigger board ...
in essence i don't know much therefore i shouldn't be giving advice BUT ...
chill out lloyd ...
it's not dudes job to do DD for YOU ... instead of relying on others to calm your nerves, make a call and get your questions answered at the source ... wouldn't it have more credibility that way?
the dude is doing more than most to keep spirits up around here but it's NOT HIS JOB!
lloyd ...
i'm of the opinion that andrew (aka bluechip) works for bellweather (not medify) as he was the one who brought folks into the HLLF fiasco ...
and yes, clancy "it's deadly dull" in ALL of europe in august ... except, of course for the resorts!

glad i asked ...
THANKS
can someone PLEEZE translate!
"what" website down?
anyone know what the LEVELII is ?
have had a buy @ .52 in for the past week but it's not working there either (i always put my orders 2 cents above what i'd like to get it at that way i might get it!)
thanks!
i could attempt to post everything trevor said but ...
i couldn't possibly do it justice ... the guy is sincere AND approachable!
he answered all the questions he could (without breaking any rules) without hesitation, far exceeding my expectations and squelching(word?) any doubt ... there is simply no way i can do the same for you
one of my questions was very similar to what you ask ... the answer is more basic than you think ... IF you're truly concerned this co. is a sham then either get out (for which you will certainly kick yourself) or email trevor for the lowdown ...
i remember ... you inspired me to do the same
just got off the phone w/trevor ...
my advice to any 'investor' with doubt or questions ... email him immediately (sorry trevor!)
i couldn't be more pleased with our conversation ... some actual dates would have been nice but this is a stand-up guy with a legitimate company that i profoundly believe will live up to my expectations ...
do yourselves a favor, stop with the intrigue ... instead of listening to gossip and inuendo from people with their own agendas ask mr.TBone yourself ... if i can do it, anyone can
(understand why everyone who's spoken with him has come back convinced we are indeed onto something with huge potential)
bax
as you were the only one who took me up on my offer (RE going to the Medify offices here in the UK) and posted a question to ask them, i'm responding to you now ...
just before the long weekend i sent an email to Andrew asking for the name of someone in the office to speak with ... i got an email back from Trevor (the same day) but unfortunately (for me) their office is in Staffordshire (not london) which is quite a distance further north so won't be going this trip ...
i told him i'd amassed a list of questions from the board that i'd hoped could be answered by someone in the office ... Trevor said he'd be more than happy to answer them for us but as i only had your one and two of mine, spent a good part of the weekend going over all the old iHub (and early RB) posts ... it was a long process but incredibly illuminating (amazing how often the GALB connection has been discussed ... and by who!)
but after reading your post have decided to chuck it all and ask only those things that have bothered me and leave it at that which leaves me answerable to no one
happy you made the call ... glad you chose not to share with us as i may have been satisfied with that and never had the comfort of hearing it for myself!
good job ...
best to us all
i'm a bombay gal ... saphire of course!
just a thought ...
is it possible the news they (trevor?) are speaking of is what precipitated the uproar at the conference ...
the bashers are back in full swing on RB which always means news or PR is imminent(sp) ...
possible it's all tied in and good news IS on the way???
i've no desire to be negative but would like to know at what point (if any) you guys would sell and what is that point based on ... how do you determine your limit?
some have very low entry points which makes it much easier to sit here day after day telling others to hold on ... i know cuz that's what i did until now
i always felt the stock would drop this far, based on nothing more than woman's intermission (as someone once called it) and had planned to wait and buy when it did ... obviously i couldn't wait or didn't really believe it, whatever, the point is i'm down quite a bit and am starting to get squeamish so would really like to know how y'all feel about this ... i mean are any of you really prepared to ride it to the bottom?
one other thing ... i'm a yank who lives in southwest england and plan to go to london next week ... am thinking about dropping in on these guys (is their office even in london, can't recall) and would be happy to consolidate a list of questions if anyones interested ... they'd have to be very concise as i don't understand a lot of what y'all say ... i could go back through old posts but that would be SO tedious ...
let me know what you think
sincere thanks
can you please elaborate on "... Blue Chip is just as positive on it" RE HLLF ...
(this DOES concern MFYS as it involves a direct contact to them)
sorry ... guess it wasn't "NEW" news ...
but looks like they're at least trying to feed us something ...
where the ---- is everyone!!!!!!!!!!!!!
medify posting #s on website

npoz ...
thanks for the clarification ... but who's 'tom'?
discovered a good way to handle a day like this ...
inspired the other day by axclr reaching 20k, decided to mortgage the kids and increase my holding ...
am VERY curious about something ... ameritrade shows my purchase at 15:13:47 ... at 15:13:41 the charts show a sale for 5000 (assume it was mine cuz no other movement at that price near that time) problem is i only got 4000 of it ...
is that kosher?
can't complain too much cuz i've got 19,000 shares !!!!!!!!!
(and to think i was thrilled with 300 (pre-split) ... boy!)
axcl what have you done ... i was only kidding!!!
not really ... congrats!!!
(i realize you didn't purchase more on my advice but congrats nonetheless ... you may have even inspired me to do the same!)
you're kidding, right!
if anything buying more is what you do now!
