Either the next PR references Home Depot by name, like the previous 99 PR's, or Depot has indeed put the kabosh on being referenced by name in Eco's PR's. Easily answered, isn't it? For once there is actually something Steve can cleared up in his favor.
So, based on the link you posted, is Eco now being told to refer to Home Depot as a "big box", as opposed to "Home Depot"? That appears to be a huge change in the spin machine vocabulary.
Read the agreement again:
"....to sell Supplier's products in all retail channels of distribution...."
'ALL RETAIL CHANNELS' is not a limitation to just Big Box.
Just quoting the H-D agreement Eco posted (signed by Depot and Eco). If it's the wrong agreement, get them to post the right one. Eco is married to Depot, whether Eco makes money or not. Note key word "sell". Doesn't mean Eco can't give away product, which must be Eco's major channel at this point, since we are told the plants and licensees are railed out, while SALES continue to decline in the SEC filings. More production, less sales? That can ONLY mean it's being given away. Or, is something else going on?
Unfortunately, the agreement says otherwise. Here's the clause, followed by a link to the agreement:
2. Exclusivity . In consideration of Home Depot's marketing efforts during the term of the Pilot, Home Depot will have the exclusive right, in the United States and its territories and possessions, to sell Supplier's products in all retail channels of distribution ("Channels of Distribution"). This means that for so long as Home Depot issues purchase orders for Supplier's products, Supplier will not sell, distribute, market or rebrand such products, or allow any third party to sell, distribute, market or rebrand such products in or to entities within the Channels of Distribution without prior consent of Home Depot. Both parties agree that exclusivity described herein extends to sales via the internet.

Maybe you can help me with this then. I know Eco picking up H-D blew sales through the roof, so we hear. Keeping the two pilot dates in mind, I am having trouble reconciling these Sales numbers from Eco's SEC postings (Q, Month ending) against were Sales were before this pilot programs:

Why am I taking a break from some nice wine and re-stringing another Stratocaster to comment on this? Lack of good sense on a Saturday night.
Anyway, in the black and white of the Q's, the much hyped Depot pilots have resulted in less sales, instead of the promised blow-out (ignoring whether the results are red ink or black ink). So, if this isn't helping sales, and it isn't helping the bleeding, what is supposed to be the positive net result? This was going to be the equivalent of fracking, but it appears to be more of something else that sounds a lot like fracking.
It's supposed to be an exclusive deal, too, ACCORDING TO ECO PR'S, but subsequent ECO PR's state sales to modular builders and others. I wouldn't call that an exclusive with Depot in USA. So what's the deal? Exclusive or not? Apparently Depot isn't in the loop on this exclusive.
The hype and the PR's have their intent, that is certain. But what is actually happening, and what is numerically stated in audited (and unaudited) Q's says something else. Do we believe the PR's, or do we believe the Q's, because it's a tale of two cities, so to speak. Somebody pick one instead of flip-flopping for the moment.
For certain, again, as the Q's themselves speak from the grave, ECOB need some help with their financial accounting. Where's that financial whiz they keep threatening to hire?

Don't forget, unless you subtracted it out, those sales numbers include chemical sales to all those licensees that we're told can't even keep up with that overwhelming demand in the PR's. Don't factor that into Depot sales since they generally aren't in the Depot pilot areas. There's more ambiguity in the 10-Q than meets the eyes.

Some scouts in the area have not been able to catch Eco Prime in any condition except locked up tight. They must have sprayed one house package, took the photo for the PR, and locked it back up....unless it was an old photo. There's no Depot deal in the southeast, there's no Mexican Hot Tubs there, no Sandy area there, no Haiti. Just reality. Bear does have the anti-aging cream.....
Northern Crossarm, Rocky Mountain, Interstate, and Guthrie all have inventories of FRTW on the ground (and other pressure treated products). Eco Prime in Augusta appears to be no busier than a Roach Motel. Someone may elect to post otherwise, but all I have are eyes on the ground. If Red Shield was such a great cheap option, why are these guys selling expensive pressure treated products?
Knowing that a worldwide exclusive is almost impossible to manage, I gave AF21 and Eco the benefit of limiting it to the US. If you can't manage an exclusive in the US, you can't manage it anywhere. It just reiterates that AF21 has no prospects or they wouldn't have to make a deal with Conboy. There have to be hundreds of better business options for that product, if it actually works. And they go pick the worst one in the World? May also be as simple as I think you have already said, they are in on the scam, too, in some way.
As I said back in July or August, Eco was in no shape to get involved with Home Depot. It was a PR Eco could not afford. And now Eco is in worse shape with exactly nothing to show for it except a stack of PR's infused with false and reloaded statements in them. Yep, Depot was merely part of the pump and dump program.
Yes, if Conboy had dissolved ECOB and started over, they would be in the black today if they just went around spraying framed houses, as I told a couple folks on PM's months ago. There wouldn't be the showboat for Conboy to pilot and none of the discounted stock program, but if he really wanted to make a go of it as a legit company, that would have been an option. Of course, as he's no doubt seen now, the housing market still sucks for the most part, which is why they post a photo of a fellow buying a dozen pieces at Home Depot and claim a victory. They even show a shot of a truck load of Fire Chief FRTW leaving Guthrie and claim it's Eco Red Shield. The Licensees are not the success story the PR's claim. All BS, and the Q's consistently show that well.
The 10-Q makes one thing certain for sure, Sales continue to decline since the deal was set-up with Home Depot. Unfortunately the 10-Q doesn't breakdown "chemical" vs. "chemical + wood" Sales, but the amount of Chemical inventory ($360K) and the stated low rate of application (in MSDS and ESR) and low sales indicates chemical purchases should be at a minimum for the Q, if not ZERO. The low to no volume the licensees are producing says Eco isn't shipping any chemical to them since they are probably sitting on inventory as well. There is a lot more bad news behind the 10-Q numbers for those inclined to decipher it.
Here's a question though. With such low volume and theoretically a low head count, how did the outstanding payroll taxes get so high so fast???
Somebody could clone this operation with their petty cash drawer and carry no debt or outstanding tax obligations. But as we see, selling wood is not what Eco is about. It's about the stock.
AF21's future is not good. Consider they are hitching their cart exclusively (US) to a meteorite (Eco). Clearly says AF21 has no other prospects or they would be cutting a deal with them. You don't pin your hopes on being a vendor to Conboy unless you want to be underwhelmed on volume and short on receipts. No doubt, they deserve each other.
Just goes to show that the steady stream of claims about same are also untrue.
That said, Conboy has helped himself, so his salary should be deductible. A lot if hanging jokes hanging here, for those that wish to express them.
