APPROVAL BRINGS $20 MILLION MILESTONE PAYMENT
(ACUR) recently received US Food and Drug Administration (FDA) approval for their pain treatment, Oxecta (oxycodone). Oxecta (formerly known as Acurox) gained approval for the management of acute and chronic moderate to severe pain where the use of an opioid analgesic is appropriate.
Oxecta became a part of Pfizer’s portfolio following its acquisition of King Pharma earlier this year. Oxecta has been developed under an agreement for the licensing, development, and commercialization of immediate release (IR) pain medicines utilizing Acura's Aversion (abuse-deterrent) technology.
The abuse-deterrent technology has been designed to discourage opioid abuse and misuse through common ways of tampering. Oxecta’s approval triggers a $20 million milestone payment to Acura from Pfizer.
SCANBUY/EBAY/SONY ERICSSON / SAMSUNG ...2011 MANY MORE TO COME ..
Scanbuy: On October 16, 2009, we entered into a ten year settlement and license agreement with Scanbuy, Inc. ("Scanbuy"), in which we and Scanbuy settled all of our pending litigation against each other and we granted non-exclusive licenses and a sublicense to each other. Under the terms of that agreement, we will receive annual minimum royalties and then a percentage of revenue generated by Scanbuy through the use of our barcode ecosystem patent portfolio within a defined field of use in the United States.
· eBay: On December 21, 2010, we entered into a license, covenant not to sue and release agreement to grant a five year, non-exclusive, non-sublicensing license to eBay Inc. ("eBay"). The license grants freedom to operate to eBay, its affiliates and certain third parties, by providing a worldwide right to use our barcode technology patents. We received a license fee from eBay for the initial term. The Agreement also provided mutual covenants not to sue and mutual releases to the parties. The Agreement also granted to eBay a 60 day option to a similar license for our search technology patents, which they exercised on February 15, 2011, and for which we received an additional license fee for the initial term. The initial term of the licenses expires on December 31, 2015 and the licenses may be extended for successive 3 year terms, for additional license fees, from eBay.
During 2009 and 2010, we have also entered into strategic agreements with mobile marketing agencies and platform resellers for our services. These resellers typically represent brands and mobile technology solutions in Europe and the United States. Currently there are six (6) such agreements and have begun to conduct trial initiatives and some active campaigns in markets in the US and Europe.
Given the need to drive consumer adoption of barcode scanning, we are also seeking to have the barcode reader scanning software pre-installed on mobile phones in order to make it easy for the consumer to access the barcode reader application. Thus far, we have entered a strategic relationship with Sony Ericsson and Samsung Electronics Italy as described below:
· Sony Ericsson: On November 27, 2009, we entered into an agreement with Sony Ericsson Mobile Communications, AB, through which they have selected NeoMedia as their strategic 2D barcode partner and NeoReader will be pre-installed across all Sony Ericsson platforms.
· Samsung Electronics Italy: On September 13, 2010, we entered into an agreement with Samsung Electronics Italy, Italian subsidiary of Samsung Electronics, to pre-load NeoReader onto Samsung's Omnia II devices.
Discussions with other leading handset manufacturers are also underway. In parallel, we also have our NeoReader scanning product available for download in the key "app stores" including Android, Apple, Blackberry, Nokia and Ovi.
We will continue to take this diversified sales approach to ensure that we maximize all revenue opportunities for our business in this time of tremendous market growth and opportunity.

US: DOE provides loan guarantees for 650 MW of solar projects
16. June 2011 | Applications & Installations, Global PV markets, Markets & Trends | By: Jonathan Gifford
In the past two days, three large scale photovoltaic and concentrating solar power (CSP) projects have been given conditional loan guarantee approval by the Department of Energy (DOE) under its loan guarantee program, known as Section 1705. The program closes in September.
Secretary Chu said the investments will build expertise and bring photovoltaic and CSP prices down. Image: Flickr/Department of Energy.
The three projects total loan guarantees of over $2 billion and will generate 150 megawatts (MW) of electricity using photovoltaic solar modules and 500 MW using concentrating solar power.
Sempre Generation is the company behind the photovoltaic project that is known as Mesquite Solar 1. It has received a conditional $359.1 million loan guarantee. The solar plant will be located in Arizona, approximately 45 miles west of Phoenix. The project will be one of the first large installations to use, "transformerless and liquid cooled inverter technology, which allows for significant improvements in the energy output," the department said in a statement.
Abengoa Solar Inc. is the recipient of a $1.2 billion loan guarantee for its Mojave Solar Project, worth 250 MW. The installation uses CSP technology and will signify the first utility-scale deployment of Abengoa’s latest Solar Collector Assembly, which the company claims to be a significant improvement over the prior generation of parabolic trough technology. The plant will be located in San Bernadino Country, California.
NextEra Energy Resources is the second CSP installation project sponsor and it will receive $681.6 million in loan guarantees. Its project, also worth 250 MW, will be located in California on land managed by the Bureau of Land Management, in Riverside County. The project is known as the Genesis Solar Project.
"By investing in the commercial-scale deployment of solar technologies, we can create greater efficiencies that will lower the cost of solar power while creating jobs and increasingly our global competitiveness in this key industry," said Secretary Chu in a statement announcing the two CSP installations.
There is a strong focus on job creation in the announcements of all three installations and the three companies estimate that construction will create over 2,000 jobs. To date, the loan guarantee program has committed over $10 billion to solar generation projects, including four of the world’s largest solar projects.
Solar Energy Initiatives will locate new facilities in Williamsburg County, creating a solar technology campus. The goal is to leverage the Port of Charleston and develop a showcase for solar technology, training, distribution and logistics, making Williamsburg County the solar capital of the East Coast.
“We are very excited about our announcement with the State of South Carolina and the next stage of growth for Solar Energy Initiatives. We plan on creating a solar showcase for South Carolina, aiding the State’s effort to develop the jobs and businesses linked to the fast-growing solar economy. This also focuses our Renew the Nation campaign at the regional level, continuing our mission of economic development for small businesses in the construction trades,” said Chief Executive Officer David Fann. “We expect Renew South Carolina to generate over 200 jobs over the next few years, laying the groundwork for hundreds more as the State establishes itself in the solar marketplace.”
“I am thrilled that Solar Energy Initiatives Inc. has made the decision to locate in the NESA Region of South Carolina. The decision to locate in Williamsburg County is a testament to the strong work ethic and innovative nature of the people of this region and the belief that South Carolina is the place to be for this rapidly expanding industry,” said Senator Yancey McGill, chairman of the NESA executive committee.
NESA is a regional economic development organization that serves nine-counties in Northeast South Carolina including: Chesterfield, Darlington, Dillon, Florence, Georgetown, Horry, Marion, Marlboro and Williamsburg.
With over 200,000 square feet of building space, the company plans on starting a solar academy to train new solar technicians and a distribution center for solar products. The location will also serve as a demonstration center for all types of solar installations including solar thermal (hot water) and solar photovoltaic rooftop and ground-mount systems. Finally, the plan includes co-locating major manufacturers of solar products used in residential and commercial applications. Solar Energy Initiatives is actively working with its supply chain to make this possible.
“South Carolina’s business-friendly climate, skilled workforce and strong market access continues to attract new opportunity to our state, and today’s announcement is another indication that our state has laid the groundwork necessary to attract investment from innovative and emerging industries,” said Joe Taylor, Secretary of Commerce.
The first phase of the project involves the configuration of the 6,000 square-foot solar academy training center. Construction is expected to begin this spring with a ground-breaking ceremony to be announced at a future date.
