DM did say a agreement he had was breeched. That probably does warrant investigating, terms of merge can be worded to assume liabilities and potential liabilities. This is likely the scenerio. Maybe there is something there and certainly should be put to rest so all parties are comfortable. If it was me I would, that was nasty.

IMO this could run wild with T4T in place, it seems logical to me that a higher PPS perspective may be born with the right news.
Has anyone seen this play out before now?

On a serious note the T4T seems to be working, what if news is really really good, and buyers hit this hard, and sellers dont sell, do you think that will be stratiferic (?) for the PPS until it reaches a point the shareholdes will sell some, or do you think this will stall out, or do you have any idea at all or ever seen this before?
