It's means the TRO (temporary restraining order) that ZTE obtained -- which blocked VRNG from enforcing the injunction in Romania -- has been dissolved.

VRNG can now keep the pressure on ZTE in Europe and this was a very positive ruling.

Additionally, by transferring ZTE's action to SDNY -- where VRNG already has a breach of contract case being litigated against ZTE -- it basically shoots down ZTE's effort in Delaware.

It's positive news.

I would say it depends entirely on what the ruling is

so far we haven't seen VRNG issue a press release on this recent Delaware action, and the company appears to be strategic in which legal events it issues PRs about... not to mention the timing of any news releases

To add to your response, the Teva vs. Sandoz decision deals with claim construction and the standard of review applied by the courts - and has the potential to curb CAFC's ability to reverse patent decisions from the district courts (in particular limiting/decreasing the instances of de novo review of the alleged patents).

So what does this Teva decision have to do with MARA, a company who has published that less than one percent of it's patent enforcement activities has even made it to trial?

It's amazing how far people are willing to go in trying to connect dots that don't exist in an effort to "explain" the trading pattern. Not everything is black & white. Making random guesses doesn't help MARA investors who come to this board for factual information and logical analysis.

All MARA can do is execute it's business and strategy. MARA can't control buyers and sellers in the market. MARA can't control macro-economic variables. MARA can't make the ticker price close higher each afternoon so people can sleep better with a psychologically fragile sense of increased worth relating to their paper portfolio.

Investing is for educated adults to are able to understand that there are significant risks in owning individual stocks, especially smaller stocks in emerging sectors of technology. And these adults should know in the short-run anything can happen. Over the long run, if the company executes the risks should be mitigated and the potential reward is more than worthy of enduring short-term risk.

Stocks don't go straight up. Those who whine that their stock isn't going straight up should move away from the computer or sell. These message boards shouldn't be used for the emotional venting of frustrated novices because it drowns out the quality content that so many highly intelligent and experienced longs are willing to donate to all of us for free.

1) MARA doesn't provide that information. Generally speaking, licensing agreements are generally broken into two different structural categories:

A) Variable
B) Fixed

A Variable license is always an ongoing license by nature. The royalty payments paid by the licensee will vary based on the specific terms of the license agreement. There are usually several factors to consider in these agreements - such as volume discounts, caps, modifiers, thresholds, exhaustions, etc. Any given ongoing licensing agreement can have many provisions that renders it extremely difficult to classify into simple black & white terms for forecasting models.

A Fixed license can be either be a one-time royalty payment or an ongoing royalty that is paid in fixed increments over time. The payment amounts are said to be "fixed" because they are set ahead of time based upon an agreed set of conditions and forecasts.

Licensing agreements can be hybrids (contain both fixed and variable elements) and they can also be very complex. Unfortunately for investors and analysts, most language in present day licenses is kept confidential and often the only parts made public are the type of license and duration of the license.

2) Ongoing licenses are never in perpetuity. Patents expire and almost all licenses will expire at the very least at the time the patents are no longer active. In the sector, we see most deals being penned between 5-10 years (assuming the patents are still active). 10 years is a very long time and most modern day deals involving ongoing royalties are much shorter in duration (between 3-5 years) -- which gives both parties an opportunity to renegotiate/arbitrate/mediate at some point in the future.

3) I believe the CEO was giving a general example. No two patent portfolios will generate the same monetization opportunity in terms of duration and royalty recovery. In simplest terms, the CEO was saying those defendants who roll the dice with litigation going the distance will generally be on the hook for a much larger infringement payment should they not take the deep discount settlement offers given to them pre-trial.

Most investors prefer ongoing royalties and when it involves manufactured products they want their patent investment company to achieve the highest possible royalty income that a variable, per-unit offers.

However, theoretically a fixed (flat fee) license should be nearly equivalent to variable (per-unit) license for patent owners. If the parties agree to a set of variables and assumptions at the time of the license - such as price, volume, etc. - and agree to provisions for future adjustments up or down (if the realized sales are out of whack with projected levels).

In fact, Fixed licenses are often preferred by both parties so that inflows/outflows are more manageable and less swings in cash inflows/outflows will be experienced.

I haven't followed all the dismissals and other events very closely. This is just what pulled up when going back to Nov 2013.

the only thing the Iron Gate vs. D-Link dismissal could mean other than a settlement is that VRNG dropped the case against the Taiwanese unit of D-Link and kept the lawsuit going against the California entity (remember, D-Link was named twice on the original complaint: one as D-Link Corp of Taiwan and one as D-Link Systems from Cali, USA)...

I've seen it both ways many times over the past few decades

it might not be a settlement... but 99% of the time when cases are dismissed in this manner with similar circumstances they are due to a settlement
