@Nascow Absolutely correct, and why are businesses to big to fail? More government means more problems! Wamu is a direct result of the me me me give me more for nothing age we live in. Look at Ford they restructured and came out of this not only with there chest puffed out but with the satisfaction of knowing they did it without the governments help. Look here’s the deal, the real uncensored truth. People have lost there entire life savings because of these people. No you wanted it to be political you just wanted to hide it in with a heart felt plea to try to make people think you really are on there side. @ thelimeyone Amen, we need less government not more. Regan said it best more government means more problems. You know thelime its funny because there are so many people that don't understand that this case is not over and from that letter to the shareholders that I read from Susman concerning the urging to vote NO tells me he wants to litigate this. I am holding until the last man is standing!
I just read a report sent to the P's that stated Susman did not want them to vote for a settlement because it is not in the best interest of all share holders. This leads me to believe that he wants to litigate this case.
I think your right on Q! Let me add that litigation is very very slow sometimes. To a point you could strangle the litigators but we have to trust not the attorneys but the fact that no attorney wants to lose a case like this. Let the rough end drag!!!

@RealTime I have a philosophy... I never trust anyone when it comes to money. In the back of my mine I figured something like this could happen. I have seen money distroy and pit siblings agaist each other. Hey if the examiner could make some quick cash... what the %ell he doesn't know us. These guys are Grade A game players and as I am not as well versed on the case as you guys I have been here for a long time. Rosen has argued what the law should be that best fits his clients gain. Ok guys lets ride the tiger!!! In most cases when you start digging (IE Examiner)... that is when you find a lot of shocking facts to substantiate what was suspected (IE: The Judge Appointment Of Examiner)and now we are down to knowing (IE Investigation/Examiners Report). Good luck all!

It is apparent to me NJ you are lacking in the knowledge of due process. It was an illegal seizure period! Just because an agency, police depart or any other branch of goverment takes property does not mean we automatically assume they are right in doing so. That would simply violate the rule of law and that has been implied by the judge appointing the examiner. Is there equity? If so this will lead to additional litigation on why it was taken. No one... and I mean no one's... hands are clean in this case. Will there be criminal charges,? probibly not but I believe they will pay civially!

My company sued a bank for fraud "Regions" and it is still in litigation they back dated docs to avoid a court order. Caught them red handed.
My point is I don't put anything past a bank these days!

I think Fsson is right on the money! A judge is not going to direct anyone to take action against JPM. That would be supplying a legal strategy and is unethical.
Your friend needs the advise of counsel, any lien holder on a property can foreclose. For example: if a person has a judgement and it is inrolled that lien holder can do a Judical Forecloser. There is a lot of legal back and forth on these things and if you don't want to get your Ars handed to you get a good real estate attorney.
Its like they always say any person that acts Pro Se has a fool for a client. Good Luck
@ Large Green ad SF: I think you both are on point, and it is possible for these thugs to go to jail but I believe it would be highly unlikely if they make full resitution for there damages. Which I might add is really good for us. Keep in mind that the threat of possable jail time is a good barganing tool behind the seens for Susman. You see this all the time in small fraud cases if they make full restitution they see no jail because the victims just want there money back. Make no mistake it is a highstakes game and they are master players. We will come out with hour pockets thicker so keep the faith. Oh and SF you are right about the judge... she is making sure they will be stuck like chuck in her court with no room for appeal.
I agree with you, but you will never be able to proof that Rosen was participating and not just defending his clients and takeing information provided by his clients in goodfaith. With that said I really believe this will be over soon they can not ride the tiger forever... God I hope soo anyway!
Hear me out before u send the linching squad lol. Let me say this NO-One is going to jail. I have seen a number of cases of fraud and if they can make restitution they will not see one day behind bars and the bar is not going to disbar Rosen for doing his job.
Guys keep in mind if your a good attorney you shouldn't care if your client is guily and you can't be disbared for knowing it. If the prosecution, the police and the judge all do what they should no defense attorney can win. I hate predicting but in my opinion if they find fraud and they most likely will and if restitution is made then its over. The only time I believe these people will ever be made pay with jail time is if they can't pay. Plus I would rather them walk lighter and me heaver .

Well give it a little time guys this currently a civil case but if the judge was so incline she could issue an writ of execution if requested and have the us marshals seize the documents needed. I think she is giving them enough rope to hang themselfs. She is looking out for our best you don't want these snakes to have room for an appeal.
I agree she did well my first time setting in and plus don't forget we can't see the body language she imposed.
In part I believe you are right... the Judge can't object in most cases she rules on what is presented to her. But the court can upon there on motion object unless it’s affirmative. In this case she has ordered the examiner and will rule and make decisions based on those findings.
