The DD a person can do is always limited by their understanding of the relevant concepts, sector, issues, etc. This is why I'm interested in your confidence. It's not to say that I haven't followed the DD thread, and neither is it to ask you do endorse my investment decisions.

Case, you seem awfully optimistic. And also seem to have a fairly good grasp on the relevant issues, which I do not. For which reason, I probably should not be 'in.' But it's too late for that. I'm in. And very curious/anxious about how this is going to pan out.
That it was not TSTRQ that was 'sold,' make sense to me.
And that the sale could settle their liabilities, thus allowing them to emerge from BK makes sense to me.

I don't know the extent of these inquiries made to the DT, but it seems far-fetched to me to call them 'harassment.' Perhaps many individuals called in to ask. But then that is many 'individuals.' That is not one guy calling everyday. It is a number of individual inquiries.
So the claim here has to be against the 'individual,' not against the 'group' of Tivus investors. We cannot all get on a call together and phone the Double Tree.
Said another way, it is fallacious to take the effect of the sum total, here a felt feeling of "harassment" on the part of the DT manager, and then to turn around and accuse the individual investor of "harassment." That simply won't work.
I am not defending the act in question, i.e. phoning the double-tree for information. I nonetheless was one of the ones that called the hotel at one point. I did so under the auspices of a traveler who had heard that there were IPTV's in some suites, and was therefore hoping to secure such a suite. When I was told there was not, I thereby obtained the info I had desired, and went on my merry way.
It's ultimately a failure on Steve's part. But I do not dispute the claim that, now that it has become an issue, it needs to stop.
Rather, I dispute the characterization of the activity in the first place.
I'm not positive, but I'm not sure that anyone here disagrees with the claim that it ought not to happen.
But whether it invariably will happen is another question.
The bottom line - IMHO - is thus that Steve said 'April,' then April came and went, then nothing happened, then Steve said nothing about nothing happening, then Steve was asked why nothing had happened, then Steve said nothing in response, then people sought out the information the only way they could imagine doing so given Steve's proclivity for saying nothing.
So Steve (and we) can complain and shame till our hearts are content.
But the bottom line is Steve failed to apprehend and avert a very foreseeable problem.

Yup. At bottom this is a psych/human-nature issue. Good leaders/managers are aware of that factor and plan/execute accordingly. In other words, even if shareholders contacting customers to gather info is plausibly inadvisable, it is going to happen nonetheless given human nature. Steve not being able to foresee that is just another instance of what worries some about his MO.
Really looking forward to the day when we're buying each other beers rather than quibbling.
