Turning the ITC into a rate setting body is not what the mission of the agency is--correct? Can't the ITC send them all to arbitration for rate settlements tomorrow? most civil cases are sent to arbitration of mediation these days first---the Apple vs Samsung case is a good example, Samsung would not settle----
In any lawsuit , anyone can allege anything, claim, its a matter of fact that they are today selling infringed goods-i don't care when they made them--I'm sure the license states SELL--no harm is done until it sells---
sure like they are doing with Google , everyone is just falling over to pay them royalties---nothing in this game is quicker or easy---there's billions at stake-----
One last gasp of hope for Nokia, if we don't put teeth into the enforcement of patents then the whole system is failing--exclusion orders, destroy goods that infringe--like roller crusting Nokia phones---Try importing a container of fake Rolex watches and see how that goes--or LV handbags---crushed----
The point of importation is the only way to protect this---or force the hands to pay--
"continues to Sell and import" is the key---you can't claim we made these under an old license---delay and defer tactics--if the USA is going to protect IPR, this BS will have to stop---if Coach handbags can destroy millions of handbags on violation of infringed products, someone is going to have to explain why these products get a "free get out of Infringe" card?
you can declare or assert your rates all day, but when someone doesn't desire to pay, what then? Court? then Court , more court, and finally they claim someone else received a lower rate---and not Frand----
they seem to be saying that the products where manufactured under the license---I'm sure the license has to cover products that are "SOLD" without a license---Samsung is getting bad legal advise if this all they have to hang their rice on----if a product is SOLD in the USA it infringes---why the H-ll would it matter when a product was mfg--, you could jockey mfg dates all day long----I hope they see through this--

I don't think he's dealing with SEP, and I don't believe showing all your cards is a good strategy for any business, ever---and if we are ready for courts to set rates in this country---I have a BIG problem with that------the question is who takes off his cloths first? if we are going to open this up to some tribunal in Hamburg, or Helskinki, I have a problem with that as well----
Published rates are a bad idea, and either sets the price too high , remember at the end of the day, negotiations are private and based on other factors: Size or volume, promise, ability to collect--
as far as I know Nokia has not released its rates to a multitude of companies--
So our band of infringers are asking a FRAND rate to be set by the DE court? or to wait till the DE case is completed in 4-5 yrs? who has jurisdiction in this matter on rates?
They as asking a Chinese court to set a rate, "has also initiated contract and antitrust lawsuits in China and asked a Chinese court to set a royalty rate for InterDigital's Chinese essential patents".
Potential trumps results , just ask any coach, and any Apple Stock holder--I'd say IDCC potential is brighter than ever--today--we have more visibility---
Results only matter in education, its hard to determine potential earnings or talents----a lot over look the it at their own peril---
called cradle to grave---wonderful system on the receiving end, the paying side is hard--Nokia is in the middle of the world where no one can ever stop getting unemployment--so they create Zombie Companies---
I beg to differ---governments keep a lot of zombie companies going----
the Finland government will never let Nokia go out of business, its a national treasure---and one of the only things the country has---I could see them being an NPE like IDCC , I could see them stop or just developing phones for others, not sure how that would work--MSFT like deal---the are too big to fail for Finland
my guess it will be rolled into a future licensing agreement, payout over 5-7yrs--this could give us certainty--and forward guidance would be solid--
the tie they have with MSFT will be our ace in the hole--MSFT needs them to remain in business---I find myself defending Apple which needs very little based on results--but you know we should burn all books on investing if Apple is not going to be rewarded at least a 14PE----we also need to throw all valuation models out the window, sure one can make the case they missed, some miss a couple hundred thousand iphones--all due to Supply constraints--
market was looking for an excuse to hammer Apple---
don't they have like 800million reserved for patent royalties on the balance sheet?
or Amazon.com, they will have a phone I'm sure---

Nokia vs IDCC
this morning on Bloomberg, Nokia's reports earnings , cutting dividends after 143 yrs, massive layoffs, and this shocked me: "The company’s devices unit had an operating margin of 1.3 percent in the fourth quarter excluding some items, the first profit in a year and a sign the company is making progress with its cost reductions. "
1.3%, this says it all...you may have heard Apple reported yesterday and the talk was they need to be making a low cost, cheap phone--if you need any preview of coming attractions just read Nokia's report---there's no way that Apple will or should start passing out cheap $50 phones, this is crazy---Apple's will and should take the highroad and build to its massive brand strength---Cook gets it, Analyst do not---
And "we" Idcc investors need prices to be higher on licensing agreements.
1.3% is our royalty or close to it? Fundamental business model flaw to me--they have more problems than they realize--
on Apple, what a report---every analyst and stock broker should burn all his text book fundamental investing books today if your going to sell me on this is a 8-9PE stock and nothing more---the promises Apple make were kept, the promises analyst made where guesses---Again Apple needs margins for IDCC to have royalties and they do----

we are due, LG settlement, some arbitration monies, not sure they have to announce them, be nice if they did, some movement on our cases--I think our trail dates are Feb, the last big trail we had was SamSung? and it settled right up to trail date, correct me anyone-I am pulling this from memory---

Nokia has been playing the field on 2 fronts, licensing its technology to Apple and others at "some" rate, and then wanting Idcc to license its technology to them at "near nothing" rate--to me the issue is how and when will the parties reach a compromise on Rates--we are only talking rates now-, a settlement that satisfies both--MSFT since its in bed with Nokia, should be added to the lawsuit, AT ONCE--
he needs about 50 pens in his pocket protector, hope he's not making our sales calls--but I'm sure he has the math down---
I think one falls and the all domino pretty quick--the group will be facing 3-4 yrs of constant legal battles, with IDCC and others---

The connected, wild world, a report comes out of Japan yesterday , Demand of for iphone, down and apple cutting parts orders---WSJ picks up---all over the internet last night---on 12/14 reported Apple would cut orders by soothsayers, not apple---really does Apple run around talking or letting its vendors talk about its orders? NO WAY-----shares are down, best qtr in company history just past---the BEST---regardless of the exact numbers---it was good---
