What is the relevance of Aug 1,2005 in the Tantivy/Lu documents? Is it the day the new license is effective or more could it be a retroactive effective date for a 3G license with for the entire IDCC patent portfolio?

The 5 years takes us to 2010--I would expect a full 3G deal should cover the same timeframe.

Based on the language on page 8 and in light of the recent IDCC press release that stated Nokia had missed its payment directed by the arb panel, is Nokia in default? Is that why this has been included in the 10Q?

In retrospect, Howard was apparently on the outs for some time. He wasn't on a conference call (I forget which one)because of "travel", then he was not quoted in either of the attached press releases on the share repurchase and the updated guidance.

the question is--does the wording of the agreement specifically call out a 2G vs 3G trigger??!! We all assumed it did--now I'm not so sure.

Ilkka signed that declaration on Thursday--he says there are no negotiations current or scheduled. As a result, did we say to the arb panel, give us the ruling (I'm thinking they have been waiting to give both sides a chance to work a settlement) and so we get the ruling TOMORROW.

Ams--In Mr. Ilkka's reply--section 25--he states that the 3G license is part of the same agreement that the arbitration for 2G is currently ongoing. Is it possible that the arb panel could trigger 2G AND 3g rates based on the ERICY license and the way that agreement is written? Nokia's 3G suit at the time it was initiated (in January) could be a direct result of Nokia fearing that posssible eventuality?

If memory serves me---the Friday BEFORE the ERICY settlement announcement on a Monday morning, IDCC issued a press release after the close with updated increased earnings. Does anyone recall that Friday, March 14th 2003 announcemnet? Now we know according to Nokia's brief that they are not talking but maybe IDCC will have the arb ruling Monday morning??!!

dmiller- to 12b's point they did complete a million share buyback just prior to the Oct 2004 announcement of an additional 1 million share buyback. The completed buyback was done at an average price of 17 dollars a share. I don't have all the answers like you and I'm not a dreamer--I am trying to consider all reasons for why things don't always go the way you want them to when you want them to. This whole picture will become much clearer in about 60 days and we'll see who the real dreamers were.

If Management were in material settlement negotiations--would they be free to buy back shares or would they be restricted? My thought would be they might not be able to purchase shares at this time and that's why we haven't seen support.

imalurker--that's twice now that I've heard the arb is about to settle a rate calculation--Judge Brown and Janet Point. Just listen to JP at the Emerald conference (IDCC website) and she clearly states it's about the rate and NEVER mentions the possibility of NO trigger. I don't believe this is a coincidence, I believe they both KNOW the panel is now deliberating on how much and not if!

It seems there is a typo on the hearing date of the attached document--it says FEB 4th , 2004 when it should read 2005. Would this mean that the hearing could be delayed?

Thanks Jim--One thing that I noticed--IDCC lost a ruling and had to pay 200K in legal fees for Nokia in the UK on Dec 8th. I just took a look at the IDCC charts during that week and noticed that IDCC stock took a hit just after the ruling on it's run to over 23.50. Just pointing out that it sure appears that this stock trades on timely knowledge that appears to be greater than even what this great board uncovers.
