Well, I would make a couple of points.
1) We know for a fact that Andy and his family have owned a significant portion of BIEL's shares in the past. We have no way to confirm that remains true today since they are no longer SEC reporting and the financial statements do not state insider holdings.
2) How badly a reverse split would hurt the family would depend on how they modify the convertible debt currently held by the family.
That being said, I don't foresee a RS on the immediate horizon, but an increased AS is inevitable in my opinion.
How is he wrong when you just repeated exactly what he said?
One of the big problems with BIEL, and has been for years, is that the AS is meanningless. Andy has the authority written into the bylaws to raise the AS at any time, for any reason, without shareholder approval. So, the AS is an illusion. In reality the AS should read as UNLIMITED.
Yeah, because you can't conduct business in Europe without being traded on a European exchange. The reason they're doing this, assuming they actually do it, is so they can dump shares in multiple companies and in multiple countries, IMO.
MM, have you checked any of those stores since then? I know they had the display case up in the window, but I'd be interested to know if they actually got it stocked in the cooler with the rest of the regular inventory.
Anyone notice the 8K from November 4? CSKH is being evicted due to noncompliance with their lease? What's up with that?
They're still out there. I think they've all been change to "Buy It Now" transactions though, as they obviously weren't getting strong demand on the auctions.
You speak the truth. We'll have to wait until the annual report is released next year to find out if they're selling directly to the market to raise cash, but recent history indicates this not to be the case as they haven't sold direct since 2009.
I hear what you're saying, and obviously they need cash badly, but converting existing debt brings in extra cash of Zero (0). Especially conversion at such a steep discount to current market prices. If it was purely a need for cash then they would be better off selling shares directly to the market then converting at $.0012 per share.
Actually, Sheena Kong was the doctor they brought in to do the Tylenol study and Allay as well I believe (although her being Joe's girlfriend at the time is still true). Carrie Snyder was the analyst that signed her name to the report. She was a former coworker of Joe's at Pacific Growth Equities and more recently his own IR/Stock Analyst Firm.
I'll counter that by stating that Andy has no clue (despite his crazy PR) as to when FDA's decision will come..so 'holding off' until clearance may not be an option, particularly if they need cash to to pay off the debt, or, worse yet, pay their employees.
Makes you wish it wasn't so difficult to short penny stocks, doesn't it?
Well, manipulation or not the 18,000,000 share per week dilution over the last month+ is reality.
You can read this one of two ways, or both possibly.
1) They obviously haven't been denied or they wouldn't be selling due to insider trading laws.
2) If they are as confident as they claim in regards to FDA clearance coming soon why would they convert and dilute at the current prices?
I can see both arguments.
OS as of 9/30/2011 was 483,814,778. Does anybody honestly think that the current OS doesn't exceed the authorized number of 500 million?
The FDA does not post denials or NSE notices, just approvals and clearances. Also that link is an incomplete list. If you want the complete list you need to search the 510k database:
http://www.fda.gov/MedicalDevices/ProductsandMedicalProcedures/DeviceApprovalsandClearances/510kClearances/default.htm
Also, here is the link to approved De Novo applications:
http://www.fda.gov/AboutFDA/CentersOffices/CDRH/CDRHTransparency/ucm232269.htm
If this continues they'll max out the current AS in 8 weeks. In my mind there is only one explanation, but that won't be known for sure until the annual report is release unfortunately.
GB - have you contacted the TA this week? The sell volume has been through the roof the last few weeks.
Most of the largest and profitable companies, started this way.
Well, admittedly I haven't read all of the clinical studies on PEMF, but I have read quite a few and they were all relatively short-term studies which focused on higher intensity treatments in short bursts under controlled circumstances. The mechanism of action is still up for debate, but as you say studies show that it has an effect, most likely at the cellular level which brings up fear of the big C.
I am no scientist or doctor by any means, I'm just enjoying the recent return to rational discussion on the board.
One thing that might be of concern, IMO, is that all of the PEMF studies I have seen have been under controlled conditions for limited periods of time. What are the long term effects of having a PEMF device attached directly to your body 24-hours a day for months at a time? Possibly nothing, but I don't know that such a study has been conducted.
It may be enough that BIEL include a warning in the instructions that recommends not using it for longer than X period of time, similar to what many drugs contain, but I don't know if there is such a warning included.
I have no idea if this is actually a concern expressed by the FDA, but it seems reasonable to me.
The big seller is back today. There are very few people who hold enough shares to continuously hit the bid like has been happening the lasat couple of weeks.
Why don't you post a pic of the can so we can see the first confirmation of a purchased and consumed beverage?
When are they planning on announcing the next fake buyout? That's the only way the PPS will rise on this share selling scam.
Bebida Beverage Company back to deliquent on their tax obligations.

Looks like BBDA is back to writing their own press releases. Probably refused to pay their former PR guy.
As has been discussed previously, they are most definitely not the leaders of this niche category.
I can't answer that. I held a small position for a short time over the summer, but sold before the big drop. I just happened to glance at the 10Q and read their cash flow situation.
Ah yes, the old try to bully people into not posting their opinions by spamming their personal business all over the internet. You're a class act.
Maybe you need to re-read his scenario again as nobody lost any money. The fact that he never wavers from one side of the fence makes him MORE trustworthy IMO as there are some on this board that will completely change their stance on the company depending on their position that day.
P.S. I think you should change your tagline from "millions" to "hundreds" or at the most "thousands" as there volume and price will keep anybody from getting rich on this share production factory, IMO.
Yes, due to Phizer extending their patent through 2019. Even if they get it tested and ready they can't market it in the U.S.
Kind of like the facts he is stating regarding this company and its management?
Still waiting on those audited FY2011 financial statements. They're over a month late now.
In theory BIEL should't have to do any of that stuff aside from manufacturing the product and getting it to their distributor(s). If they have aligned themselves with the right distributor(s) then they will have the necessary agreements in place with the retailers. It's then a matter of the distributor drumming up interest and, hopefully, purchase orders for the product. It will take time for this process to occur because big retailers aren't just going to start ordering truckloads of the product until they conduct some sales testing.
Well, hopefully they got it right this time. I really posted that to make the point that those calls always sound great, but the reality is in the financial statements. I hope Greenwood group is as great as they say and the product is a smash hit in Canada, but they need to start showing real results at some point.
January? When you spoke to him in February of this year he told you the retail agreements in place and product was ready to ship.

Andy told me in my last discussion, that are have new agreements with major retailers in Canada and are ready to ship. This is fantastic news.
Kind of funny how they can never seem to manage to get a quote from the person supposedly promoting their product, nor anybody representing that person.
10Q out. Bankruptcy possible by year end.

Our independent registered public accounting firm has included an explanatory paragraph in their report on our 2010 financial statements related to the uncertainty and substantial doubt of our ability to continue as a going concern.
As of September 30, 2011, we had cash and cash equivalents of $429,000, negative working capital of $2.0 million, and an accumulated deficit of $91.9 million. Based on our operating plan, we expect that our existing cash and cash equivalents will fund our operations only through December 31, 2011.
These conditions raise substantial doubt about our ability to continue as a going concern. The accompanying financial statements have been prepared assuming that we will continue as a going concern. Our financial statements do not include any adjustments that may result from the outcome of this uncertainty. This basis of accounting contemplates the recovery of our assets and the satisfaction of liabilities in the normal course of business.
Our management plans to address the expected shortfall of working capital by securing additional funding through equity financings, strategic alternatives or similar transactions. There can be no assurance that we will be able to obtain any sources of funding. If we are unsuccessful in securing funding from any of these sources, we will likely file for bankruptcy.
I love the declarative, yet unsubstantiated statements. I agree that it is highly doubtful that this patent filing will have any impact on the current pending FDA filings, but it's impossible to say that with 100% certainty. In regards to the warning label, if they're adding additional heating gel to the pad then of course it will require additional warnings in regards to allergies, potential burns, etc. that come standard on those types of products. Again, it shouldn't impact their current lineup unless they're planning on adding it to those products as well.
Show me one shred of evidence that Koma Unwind is available on a Southwest Airline flight or in a 7-11. (Hint: There isn't any.)
