If you desire to move product to national chain stores you need a distributer like D&H. The pieces are slowly falling into place: (1) establish a manufacturing base - Chang in China (2) develop the product line - Genesis, Netdisk, UTEK, etc. (3) build a distribution network. IMO the pps is undervalued here at a market cap of $5M.

I am somewhat frustrated with the investor community here. This company has come a long way in the past six months and the pps does not reflect it. I am begining to think that if they PR'ed they discovered the chemisty to turn lead into gold (and it was true) no one would take notice! This company owns patents and has products in leading retail chains. IMO this market cap. is way below fair market value.

The plan was to move up to OTC BB late spring / early summer.
IMO litigation will only delay the launch of product due to the added company expense. Any settlement might pay for a Wall Street Journal subscription for a year or so.

It may be time to take a second look at Klegg (KLGG). IMO these guys are doing the right things and growing their company. I posted some DD on the KLGG board - please read it.
Last fall Klegg bought rights from UTEK for a modem which incorporates Blue Tooth and standard PC IP protocals. With their newest aquisition (Ximeta's NetDisk) they could exploit this technology which could turn into something big (wireless media streaming)!
They are also on target to start delivery of their new products:
"Klegg said some products will begin to appear online and become available for purchase beginning in late May. Additional products will become available as they are shipped to distributors over the next four to eight weeks."

Ximeta's NetDisk Home / Office NDAS devices serve up media

While a certain group of customers have apparently fallen madly in love with Ximeta's NDAS offerings, we're not entirely sure what these two forthcoming devices will actually be called when they land this summer.
Klegg Electronics has reportedly snapped up Ximeta's NetDisk brand, but regardless of what label the NetDisk Home and NetDisk Office don, these two media servers could potentially offer up a much desired solution.
According to CEPro, Ximeta is claiming that its newfangled NDAS units can "stream DVDs over the network," which could prove difficult to fulfill due to the ever-lurking DRM that will surely appear somewhere in that equation.
Regardless, the NetDisk Home is slated to come in a two-bay rack and dual two-bay rack form, while the Office variety includes a single and dual four-bay rack with four hot-swappable SATA drive bays.
Each will include the MediaPortal software to serve up music, photos, and videos around the network, and the fanless design should keep the noise level down within your AV system.

Piggybacking on existing intellectual property is becoming a popular means for companies to develop new products and services, and UTEK — as in "university technologies" — is looking for the best and the brightest.
A specialty finance company focused on technology transfer, UTEK performs its own scientific due diligence and puts its own capital on the line to purchase innovations, says chief executive officer Cliff Gross. UTEK then resells the technologies to companies, for either cash or equity — a valuable option for businesses trying to preserve cash flow.
Consumer-products company Klegg Electronics has in-house staff for research and development, but UTEK "takes off some of the strain," according to chief executive officer Dennis Gentles. Klegg buys technologies and not marketable products, he adds — commercializing the technologies remains a job for the R&D department — but UTEK "lets us bring products to market much faster." Benjamin Croxton, CEO and CFO of surge suppressor manufacturer World Energy Solutions, also praises UTEK's "sophisticated bird dogging" of innovations across its wide range of university contacts.
UTEK's public-company connections prove valuable to the universities, too, contends M. Douglas Speight, director for outreach and technology transfer at of North Carolina A&T. Speight recalls one technology — a means of analyzing structural damage in military aircraft — that proved difficult for the school to license. UTEK, he says, recognized that the technology might be valuable to a company in a quite different line of business: monitoring the structural health of some 200,000 bridges and overpasses across the country. "It gave us the opportunity to serve a whole new market that we had never anticipated," says Speight.
Another means of matching technology buyers and sellers will take the stage next month in Chicago at an intellectual-property auction conducted by Ocean Tomo. The company, which describes itself as an "intellectual capital merchant bank," held its first auction last April. Of the 78 multi-patent lots up for bid, 26 sold that day — two of them for seven figures, but most of the rest for between $2,000 and $17,000. Five additional lots were later sold, privately, at an average of just over $1 million each.
Shortages of time and resources are an issue for many companies, maintains Andrew Ramer, Ocean Tomo's director of corporate finance. Ramer explains that to develop its own intellectual property, or IP, a company needs to "engage IP counsel, go through the patent prosecution process, and wait three, four, five years until those patents issue." An approach that many companies are taking now, he adds, is "taking funds they'd be allocating to develop new IP and using it to acquire new IP."
An experienced intermediary can smooth the way, says James McNamara, executive director of the technology management office at University of Massachusetts Medical School. At a smaller company, he explains, it's entirely possible that no one has ever consummated a deal with a university, "so there may be some early surprises on both sides as to what the expectations are." UTEK's experience in academic tech transfer, adds McNamara, "helps to make the deals more reasonable."

Newegg.com is known as an e-tailer used by manufacturers of computer hardware and software, consumer electronics and communications products to reach the do-it-yourselfers, hardcore gamers, students, small to medium-sized businesses, IT professionals, resellers and consumers.
Since its inception in 2001, Newegg.com has registered more than 5.5 million customers.
eCost.com has positioned itself as an “online discount superstore,” specializing in computer hardware, software, peripherals and other consumer products.
Buy.com is known as an “Internet superstore” that offers more than 2 million products in categories ranging from computer hardware and software to electronics, cellular, books, movies, music, sporting goods and more.
All three online vendors will soon promote Klegg’s Genesis line of convergence and portable electronics along with other online vendors such as Amazon.com and PCMall.com.

This company is doing all the right things. Sooner or later someone will take notice.
In a conversation with IR some time ago it was implied Klegg would again make the attempt to move off the pinks. They now have the funding to do this.
IMO, with the products introduced at the CES, Chang and the Chinese production capability, Ingram Marketing Partners, and now with the capital to produce and build the brand all the pieces are in place to move the company to a new level.
All that is left to do is to execute the business plan and convice a few venture capital investment firms to cobble up some shares and we are all in the green.
This is good new indeed.
And what if ... Paula (pure speculation) - take us to the promised land.
