I would hope that there is not a trial over this BS attempt. And Capted, this judge would not be the one to do this. This accusation puts a new spin on the whole deal. The Fischer's could not win the "barrel" idea, so now we have a game of he said, she said. The "he said she said" makes this whole ordeal now criminal; not civil. A whole new court ...CRIMINAL COURT. But for this to happen, there must be a police report filed stating that the gems were stolen. Can anyone produce this? Next, the county or district attorney must decide whether or not a crime has been committed. Little fricken odd that all this comes forth AFTER.
I believe it is pretty standard in all court cases for the judge to allow for an appeal period. The Fischer' got their 15 days. They truely went fishing with this one.."pun intended". Now its Jays turn to answer this appeal. And then the judge can rule if he even accepts this ridiculous claim.
Capted, I appreciate having your opinion on this board and am sure others do too. I just wonder what your personal vendetta is toward's Scott H. and ORRV and Jay M. You have also refered to him as the "fat man". You must have some reasoning for your disrespect. Does he resemble your mother?

It would be so nice to be able to have $500 million dollars go missing and not file a police report or even bring it up until a couple years later. Shows just how much money the Fischers have. Seems very frivolous as someone stated before. This 15 days that the Emerald Group has to reply is more than enough. This outrageous claim should only take a couple of minutes to respond to. They probably spent more time rolling on the floor laughing than they will figuring their objection.

As stated before. WIth this "appeal" there would have to be a police report filed stating that the emeralds were stolen. There are also 2 conflicting statements. One stating that Kent stole the emeralds from the Fischer's and gave them to Jay. The other states that there is an email stating that Jay told some guy that He stole the emeralds from the Fischer's. Which one was it or were they in it together?

This would be a criminal court proceeding, not a civil. It would seem like there would not even be a reason to appeal. It would be a matter of walking into the local Key West police dpt. and filing a theft report.
Their whole arguement was based upon the emeralds floating away in a barrell and that didn't fly. I'm willing to bet that this doesn't fly eather.
To base an entire case off hearsay...it's a gasp for air by the Fischer's in a drowning loosing battle.

I believe that a PR is coming soon. In the meantime we can find some comfort in knowing that RR is not out there making up BS reports and releases to give shareholders news. That is what it seems like many of these pinksheet CEO's do. WHat this company is doing is really no secret to any of us. We have a profitable first quarter and the business is really pushing forward and cutting costs where needed. One can see that RR truely wishes to make a long lasting company. He takes more time building a lucrative business than putting out fluff PR's. Better than the other way around. The man probably just has his hands so full that there has been no time to give out his PR. I personally hope that it doesn't slow down for him. Only that profits can allow for hiring an assistant that can take some of his work load.

Though I have not read the entire affidavit; the basis of what this case is being founded upon seems ludacris. If the Fischers' truely believe that the emeralds were stolen from them, wouldn't that have been their first attempt at claiming them??? This sounds more criminal than civil. There would have to be a police report filed one would assume, and I doubt that this current judge would be the ruler in that case. This seems alomost to ridiculous to be true. Oh, so our idea of the emeralds floating away in a barrell failed so now we will say that someone stole them from right beneath our noses, gave them to Jay, and we want them back??? And to top it off, we have an email that someone sent (this someone who has beef with Jay ) stating that Jay said that he stole the emeralds from the Fischers. C'mon. This is all hear-say, and I believe hear-say is objectible in court. At least in criminal court...which is where it would seem like this will be heading.

I am going to have to file a claim on the emeralds...the other night, I had a dream that they were mine. LOL. This has got to be the most ridiculous attempt the Fischers' could have possibly made. The judge should not even accept this appeal in my opinion. Hear-say is not even admissable in court, is it? Is'nt that an objection? Hopefully this preposterous shot in the dark gets shot down by the end of the week.
Judges have ruled for some ridiculous things in the past week though..Hopefully we do not have another John Roberts on our hands.

Thanks for that Spinner. Once again, it does not seem like the Fischers would want to do anymore damage to their name with this case. It also seems that they probably used their best gamble in the previous hearing to attempt claim at the emeralds. It would make no sense for them to waste more money on this. that is money that they could be putting towards bringing up actual treasure that belonged to the Atocha.

I recently bought into EXPU and hold just a few sshares over a million. I viewed the financials of this company and it seems as if they are making a profit...$8000.00 and some change last report I believe. I do not know of to many triple 0 companies that are turning a profit and still set in trips. Does anyone have an honest opinion of where this stock should be sitting at or another stock to compare it to? I am new to stocks (within the last year). Are there any trip 0 comanies to ever have made it to say, .50 or 1.00 mark that anyone knows of.

Does anyone know if the Fischers have yet filed an appeal? It seems to me that they really have nothing else to base a case on. I am sure that they thought the "Barrell" idea was there best bet. Unless they have something solid, one would not think they will pour money into legal fees to dipute this case further.
As far as the appeal option, I am not an attorney, but this seems to be pretty much standard practice for the judge to give the 15 days. It would seem that at that point it would be case-closed. Does anyone know for sure that July 3 is the date? That would include weekends in the time period. I am only wondering if the legal system used calandar or working days for the length of time to appeal.
All only my opinion and just curious if I might have missed something here.

When Key West treasure salvor Jay Miscovich found emeralds worth as much as $500 million scattered on the sandy sea floor with no ballast pile or other sign of a shipwreck nearby, other salvors took notice.
But thus far, only one salvor is legally challenging Miscovich's claim to the treasure. Kim Fisher, the son of the late treasure-hunting legend Mel Fisher and head of Delaware-based salvage company Motivation Inc. claims the gems Miscovich recovered in the Gulf of Mexico in January 2010 came from the Spanish galleon Nuestra Señora de Atocha, which sank in a hurricane off Key West in 1622.
The Fisher family's companies have a legal claim to the Atocha and her sister ship, the Santa Margarita.
Though none of the precious stones were listed on manifests of the Atocha or the Santa Margarita -- the Spanish crown required only gold and silver to be listed -- Fisher claims Atocha inventories suggest it was carrying a large number of gems like those Miscovich recovered.
Though Miscovich has not found remnants of a ship on his site, he did find a cannonball, said his attorney, David Paul Horan. The exact location of the treasure site has not been disclosed, but it is west of Key West and at least 40 miles north of the main Atocha site, according to court documents.
If the stones were not from the Atocha or the Santa Margarita, then their source remains a mystery. For now. Fisher claims the Atocha site's boundaries have been amended periodically because the ship broke apart and was pushed northward by the hurricane that sank it, and from prevailing winds and ocean currents since that time, according to court documents.
"The Atocha artifact scatter trail now extends northward approximately 9.5 nautical miles from the Hawk's Channel Outer Reef point of impact that caused her sinking," according to court documents.
That scatter trail reportedly has continued a northern course through the Quicksands area, about 18 miles west of the Marquesas Keys, over the past two years.
Horan said the Atocha site and scatter trail have always been amended west by northwest, not some 40 miles due north, where Miscovich claims he found the gems. Fisher's claim disputes that location, saying Miscovich found the gems from 26 miles to 30 miles north.
Miscovich's company, JTR Enterprises, is asking U.S. District Judge James Lawrence King to dismiss Fisher's claim, and if dismissal is denied to ask Fisher to establish "objectively, verifiable criteria" when identifying Atocha emeralds, Horan said. "Otherwise, we're putting the cart before the horse," Horan said.
The emeralds, stored in a safe deposit box in New York City and a jewelry store in Pennsylvania, are headed to a safe deposit box in Key West, where they must be stored for the judge to have jurisdiction in the case, Horan said.
Miscovich submitted samples of the emeralds for analysis to the Smithsonian Institution's Museum of Natural History in Washington, D.C., the Gemological Institute of America and laboratories in France and Switzerland, according to court records. Miscovich plans to publish those findings when they are complete.
There appears little argument on either side that many of the stones were mined in the Muzo region of Colombia, in the foothills of the Andes. That determination was made by the Smithsonian, according to court documents.
There is some evidence, however, that some of the emeralds came not just from the Muzo mines, but the Chivor mines in Colombia, another heavily mined area that was abandoned in 1593, about 30 years before the Atocha sank.

Have been watchining this board only for a week or so. Many have posted about the possiblity of a press release in the near future. What gives this assumption? I believe if there was some backing...(evidence)...to this that we may see a positive gain this upcoming week rather than loose as others state. I have read the information on what is going on with the company and this all seems to be great..though old news. What IS all the hype about?

It may only be speculation, but I would like to hear what all might think would be the safe way to go about this providing it does run. Fairly new to stocks and would like some more thoughts on what to expect. Trueblue, you speculated on .05 to .10 cents and blew me away with the $1.00 to $1.50 mark. Is this really possible or conceivable to anyone else? In a situation such as this, will this hype drive the stock up within days, weeks, months??? Asking for opinions and speculation providing ORRV does have a major roll in this thing.
