If that news is actually NEW news, then it is encouraging. This is a product we should have concentrated on and done everything humanly possible to get to market instead of of displaying the most prevalent characteristics of the animal from which we get the word capricious.

Can you provide any documentation that the SEC has no further interest in CYGX? Is there any way to find out if the appropriate persons at the SEC were impressed by the "in-house" evaluation of the LW contentions?
Can you give any proof that Malcolm will actually turn the reigns over to someone else and not try to micro-manage from a BOD position?

I am well aware of all of the facts you cite .... also aware of the true facts concerning the parties who were involved. I have been thru all of this before with bashers of this corporation. I am not going to go thru it again with someone who thinks online DD is superior to going directly to the horses mouth. I don't believe that I stated any time frame for my discussions with the DA's former and current attorneys. Similar discussions were also carried out by others. You are the one who named Judge Key. Contrary to your assertions, this was a major case and had many people involved in the prosecution.

You are correct that Skillern changed the direction of the company from fetuscycles to genetics.
You should have been there to witness all of the New Utopia affair up close and personal. HT was a real class act ... not sure which class, but certainly one of them ... lolol. I always cracked up at some of the photos he wanted to use. Especially one with him wring a speedo. He thought it made him look young. In reality, it only made him look like a foolish old geezer. Fortunately, he was on his way out when I came in. Things improved greatly when he left, although he thought the corporation would not be able to function without him. Although Truthhurts has done some of the most admirable DD I've seen on this board in a long time, much of it does seem a bit out of context, or fails to accurately portray the situation at the time. Of course, the New Utopia business is still a first class laugh factory in and of itself. I must say that I am surprised to see Malcolms involvement in it.

I know you wouldn't post information like this unless you had strong grounds to believe everything you posted. However, I am going to withhold my judgement for a while. I did check what I could, and found it to be supported by what I found, but certainly not enough information to indict someone.
I'm curious if you can document that Roland Violette doesn't own any other shares of other companies. I am even more curious about Bob Hydeman. I think someone I know met with him a long time agao, but I'll have to verify that.
Anyway, this is all most interesting. If it proves true, somebody is going to face serious charges. If not, you will have to do a lot of explaining. In any instance, I can not understandd why the folks on the CYGX side would expose themselves to liability and prosecution.

Nappy, I am surprised that you cannot read between the lines and understand the situation. It has been explained to you already on this very thread. In case you have forgotten or just missed the very definative epistle, I am reprinting it below.
Please refrain from pointing out that it was probably poorly attended and that we shareholders were excluded from attendence because we were not given the chance to know of the momentous moment until moments before the moment arrived.
Also do not question the motivation for the secrecy. Obviously CYGX has acquired numerous government contracts that are so secret that the cannot be mentioned in public. No doubt their classification level is Compartmentalized TS. Were it not so, Malcolm and the front office gang could face some rather difficult disclosure issues. As the large delegations of government related guests arrived (janitors, receptionist and coffee servers for all of those listed dignitaries) Homeland Security no doubt had armed guards patrolling the cordoned off safe zone.
After all, Malcolm was taking no chances with security and didn't want any of the competition to know about it.

Wow ... you nailed it ... CYGX has problems and the only persons who can not accept that seem to be people who post in a manner consistent with some of the pumpers we have had for this stock. And it might actually only be one person posting under different aliases.
CYGX has had its share of pumpers. Probably the most notorious was Big Dog and some of his accomplices and alter-egos ... Mike was a pretty cool dude and so were several of the others. They (and CYGX) got an entire chapter in a book published by Wall Street Journal or NY Times ... don't remember which.
Phanuel Pursuits was actually introduced to CYGX (or vice versa) by a gentleman who had at one time been banned from dealing in penny stocks ... and of course, Malcolm and Lawrence denied that when I confronted them about it .... only to later admit that indeed he had been back on the scene with CYGX. You should have heard the rhetoric and attempts at plausible deniability of culpability in that heated conversation. If David Lane posts again here, ask him who arranged the get together of CYGX and PP.

This is not a scenario that "just happened." I believe it was carefully scripted and played out.
The corporation does not need a long search for ne president. the search will probably go on for a very long time. MS will hav a difficult time finding someone who fits his requirements ... it would have been best for the corporation for MS to just resign all of his posts with CYGX and fade away a long time ago. Of course, that was not and probably will not ever happen.

That's a serious situation there, fellas. When you can't file on time because the SEC contacted you the day before and "commented" on something you can't address in a public filing, you've got really big problems on your hands.

Also, anyone who thinks Malcolm had nothing to do with AVGI obviously knows absolutely nothing about what transpired. To try to deny that Malcolm was very much involved in making the arrangements that led to AVGI is to show complete ignorance of what actually transpired. Unfortunately some posters do not know the difference between AVGI and Bill Waldrop and the roles that were played by Malcolm, Lawrence, Charles Bardwell and Charlie Boyd.
The constant posting of mis(dis)information has not presented a single new fact and has all of the appearances of pure and simply hype. It is kind of like draining the Arab oil fields and starting Armageddon.

Long time no speakee ... I'm in Shanghai most of the time now. I was trying to remember the fellow you introduced me to in China a few years ago. Is he still handling your China dealings?
Your post is pretty much on target, except for one detail. CYGX was intimately involved with setting up AVGI. Malcolm and Lawrence used AVGI as the carrot to lead Dell to tender his resignation from CYGX and to devote his efforts to getting AVGI off the ground. AVGI never had the shrimp or equine license from CYGX. The license was to Bill Waldrop and was given for money that he gave to Mike S in the formative days of CYGX. He was given two licenses .... one for the shrimp and crustacian applications and one for equine applications. Waldrop gave sub-licenses for those to AVGI.
Malcolm rid himself of two directors who dared to ask questions and challenge him and the manner in which Lawrence had structured some of his deals. As he and LW told me, even the mention of their names brought a rage to the CYGX upper management. That left him with only one other person to contend with. He cut a deal with Dell to go into joint venture or at least co-operative arrangement with DG insofar as companion animals were concerned. DG had not finished packing when LW broke into his computer and managed to lose hundreds of hours of our research into the equine applications.
Unfortunately, against the advice of some of his associates, Dell chose to involve the two ex-cygx directors in AVGI. Malcolm had already started craw-fishing on everything he had agreed to in order to get Del out of his hair and give him free reign to completely dominate CYGX. When MS became aware of their involvement, he went ballistic and reneged on everything he had promised Del and me. I think you remember those days well.
Although much misinformation has been posted by some folks who are totally ignorant of what actually occurred, AVGI had several top people in the veterinary medicine field ... including one who used to regularly post on this thread. There was close co-operative effort with Texas A&M and Canadian, British, European and Australian Universities of Veterinary Medicine. There was no need for AVGI to have any physical facilities ... much like CYGX started out and remained for years.
I think you are aware of the connections with BI and the Asian pharmas, so I won't go into that now.

Love him or Hate him, Marvin was someone you just didn't forget. My mother went to Tarleton with him many years ago. His son-in-law is one of my best friends and at one time had a little stock in CYGX.

Arnold, our little corporation is functioning exactly the way that would be expected of an entity so deeply rooted in the community academia. Sales are seldom a consideration there. Folks are used to operating on grants and other allocations. We have only had one person in our executive staff that had that kind of sales experience ... unless you want to consider LW as vastly experienced in big ticket sales.
This is one of the terrifying aspects of Malcolm naming his successor. If he chooses another 'yes man' from the academic ranks who does not have proven successful experience in sales, then we can just kiss it all good-bye.
The fact that Yen, Harrylin, XX, and the back shop gang have made astounding strides in the technological aspects of our business, and could someday win their Nobels, will be but a fading memory if we don't have a product and aggressive marketing.
In the community academia you can change horse in mid-stream and think nothing of it. You can lumber along from project to project all the while just investigating and exploring without any commercial application being developed. It just doesn't work that way in the real business world.

I think your are being a little generous in speculating that we could raise PPO money for $ .25 per share. WE don't exactly have a history of having to surrender that small a premium in our PPOs.
Also, someone needs to sit down and actually calculate the amount of money expended on needless litigation. Don't factor in the PP costs, because they may have actually been necessary. Of course, if MS and LW had not relied on someone that they promised some of us was not involved, it would not have occurred in the first place. None of the AVGI expenses were necessary for anything other than salving some stressed out egos. The LW and FV litigation is certainly not a necessary expense. If MS had just kept his word several years ago, the scenario leading to this would have never occurred.
Those useless expenditures could have provided a jump start for getting us into a larger ballpark of testing or could have been devoted to getting one of the smaller projects actually off the ground.
I wish someone could satisfactorily explain why so many of the projects that were heralded and held high with great fanfare were dropped. If we had actually had even one product brought to market we would be far better than we are with many projects in early stages of development with little chance of progressing in even the intermediate future.
