Am I correct in assuming that RICO's statute of limitations cannot bar a civil RICO claim so long as the defendant continues to engage in acts of racketeering?
As stated above, the statute of limitations on civil RICO claims begins to run whenever a victim knows or reasonably should know of its injury. The Supreme Court has held that RICO imposes a duty of diligence on all victims who wish to seek redress through the statute. Accordingly, once the victim knows of his injury or reasonably should know of his injury, he cannot sit back on his rights, refrain from bringing a civil RICO claim and thereby allow the defendant to continue to engage in acts of racketeering that will increase the amount of the victim's monetary claim against the defendant. Once a victim is aware of its injury, it has four years to bring a claim.
Many times, however, a defendant will conceal the plaintiff's injury by making false promises, or by engaging in a number of other fraudulent statements. Likewise, a defendant may conceal the pattern of racketeering by similar means. Under these circumstances, the doctrine of fraudulent concealment may toll the running of the statute of limitations for so long as the defendant's affirmative acts of concealment prevent the defendant from discovering his injury or the pattern of racketeering. Once the victim has actual knowledge of his injury or the pattern of racketeering, however, the statute of limitations will not be tolled - regardless of the defendant's efforts to further conceal the victim's claim. There are many equitable tolling doctrines that may come into play in any civil RICO scenario. Other such doctrines include (but are not limited to) duress, infancy, and incompetence. One must consult with an attorney to determine the appropriate application of the statute of limitations or any tolling doctrine with regard to the particular facts of a case.
If you determine that the defendant has committed an act of racketeering numerated in section 1961(1), then you must determine whether the defendant's commission of the racketeering activities constitutes a pattern

Everyone in the technologically-geared blogosphere is clamoring over the possibility of a Google Phone. We've seen unauthorized concept renderings and rumors up the wazoo, but for the most part, it's been conjecture and supposedly leaked information. To get at the truth, we go to the horse's mouth and it turns out that Google has officially "assured everyone that it will definitely launch its own-brand handset."
The rest of the details, however, have not yet been released, so we're forced to take another dip at the rumor mill to see what people are saying. From what we can tell, the Google Phone will be running some unique variant of Linux, it will be manufactured by HTC, and a number of its applications will be web-based, including search and email.
Most recently, there have been indications that the first Google Phone will be 3G enabled for speedy data transfers on the go. If Google sticks with just EDGE, the chip may be made by Texas Instruments, but if it's 3G, Qualcomm may win the contract.

Google has filed a patent application for a mobile payment system, fuelling rumours that the search giant may launch a mobile phone.
The patent application covers a system that would allow consumers to pay for services via text message.
Dubbed 'GPay', the service would involve sending an SMS to Google which would then pay the retailer and charge the cost to the consumer.
"We file patent applications on a variety of ideas that our employees come up with. Some of those ideas later mature into real products or services, and some do not," a Google spokesperson told The Times.
The search firm has already worked with mobile phone providers, including LG, to ensure that its search page is included for mobile internet users.
There have been persistent rumours that Google is planning shortly to launch a cheap internet-enabled mobile phone.
Google's first mobile phone will run a Linux operating system on a Texas Instruments "Edge" chipset, and will likely ship to T-Mobile and Orange customers in the Spring of 2008, according to unconfirmed reports. "GPhone" call minutes and text messages reportedly will be funded by mobile advertising.
News of the so-called "GPhone" or "G-Phone" broke quietly about two weeks ago in the island nation of Singapore, where Jennifer Tan of Reuters subsidiary Anian Research filed a report on July 12.
Tan cited "industry sources," "U.S. sources," and "manufacturing and component supply chain sources" in backing her assertion that after year-long delays finding a manufacturer, Google contracted Taiwan-based smartphone maker High Tech Computer (HTC) to design its phone hardware. HTC is best-known for its Windows Mobile smartphones, however, and Tan offered no conjecture about who might supply the phone's Linux-based operating system.
Additional details reported by Tan include:
The G-Phone will have a large color screen with a predictive Qwerty keypad to simplify Google searching
A follow-up 3G-capable model (Edge is considered "2.75G") will use a Qualcomm chipset
Scheduled for production in Q1 of 2006, the Google phone will hit retail shelves next spring

Google originally hoped to launch a phone this year, but was delayed by "difficulties in nailing down a deal with a handset maker"
T-Mobile will carrier the phone in the U.S., along with (possibly) Orange in other markets
Tan quotes Susquehanna Financial Group analyst Marianne Wolk as having said, "A mobile offering would be consistent with Google's goal to make search accessible. We believe Google would design a solution to facilitate greater use of Google Search and other applications like Google Talk, Gmail, Google Maps, encourage wireless video, and leverage this usage to hasten the market for mobile advertising."
Google itself has declined to comment on rumors it plans to produce a phone, Tan reported.
