I would hope Chanbond didn't hire a lawfirm that needed to look to ihub boards for information.
I hope Mishcon attorneys dont neglect to bring that up in the current proceedings - that Chanbond tech is touted as the industry standard by Cable Labs.
The Cable Labs docs in the links are not patents, just specs, dated 2016 and 2017. I think he's trying to figure out if they're infringing. Which they are if the specs are "close" to the specs in Chanbond's patents.
Ash. Thank you.
We still haven't seen what the judge so ordered. I wonder what happened to dilly?
I think there is a response due to Judge Andrews tomorrow. Hearing is November 25.
Chanbond filed renewal applications.
UOIP will win.
I agree. They agreed years ago to a joint trial. It's a matter of public record. And they have gone through discovery as one consolidated case as Chanbond pointed out. They're likely to file separate appeals anyhow.
Seems he should have been a bit more prepared for that hearing anyhow.
I dont think I've ever disagreed with you before, but I think they would have won that one in court with the other two propping it up. But I will concede the 13 would have appealed it anyhow, so probably best to let it go.
They can settle out of court and remove themselves anytime. The jurors can be instructed to consider awards separately as well. Judge even mentioned as much in regard to Comcast in his order.
They appealed those portions of the claim not held up by PTAB. The patent in it's entirety was not instituted. Companies have won at trial after losing at PTAB. I was hoping Chanbond would fight for that patent at trial. I know what my verdict would be if I were a juror, even if I didn't hold shares. I'm disappointed with Chanbond.
Judge doesn't mention the '822 patent, just the other two. Sounds like hes leaning in favor of separate trials.
Looks like your other favorite holding is about to break out?
Me thinks they don' wanna, so they want Comcast outa there.
Probably why the other 12 want separate trials. Maybe they think it will sway the jury in Chanbond's favor if Comcast settles.
No. It sounds like Comcast is the only USP looking at treble damages. It was one of the reasons highlighted as a reason to have 13 separate trials in the letter from the defense. Chanbond countered - the jury can be instructed to consider damages separately, but there is no reason for separate trials. I think Chanbond's arguments were pretty solid.
Well, I guess that answers the question regarding how many defendants will pay treble damages.
Chanbond filed for extensions.
Looks good to me.
That was Chanbond's contention at the beginning. The 13 agreed to have their cases consolidated and the judge stipulated it way back. Filings were posted again on here a few weeks ago.
Interesting. I wonder how much Commscope paid? And did they actually go to trial or did they ask for a stay. I'll have to dig around in Pacer later.
We would have internet. It would just be insufferably slow.
Chanbond needs to play hardball when they win at trial and ask for an injunction.
Makes me nervous. Really nervous when we start talking about Chanbond going after the FAANG companies. Especially after the fat middle finger from Comm and Arris. They have to have this on their radar. Makes me think about that public hearing where Zuckerberg sat on a book in front of the Senate while they asked him if he would be willing to help them write new legislation surrounding data privacy after the Cambridge Analytica sale, ahem, I mean breach, right after Franken (who wrote the net neutrality legislation was ousted and the net neutrality legislation was repealed -- on behalf of tech lobbies?). Now I'm going to be chewing my fingers off until this thing settles worrying about corruption. Because, honestly, that's the only foreseeable way Chanbond can lose this thing in the end -- outright corruption. But if they own Congress... How much do you suppose it costs to buy a couple of appeals court judges?
Seems defendants are planning to drag the discovery phase on and on and on for eternity.
I've done a lot of scheduling over the years for both, filling booths at conferences for companies and scheduling roadshows. Hell, I've done scheduling for "advocates" (lobbies) of private industry and members of Congress. Generally, booths at "conferences" are staffed with salespeople. "Roadshows" are coordinated between executives and investment firms.
There were just over 526,000 licensed real estate agents in my state last time I renewed my license. That was just the number for "agents." Doesn't include "brokers," many of whom hang their licenses under other brokers. No one wants to work with an independent broker - everyone wants that Coldwell Banker, Sotheby's or Berkshire Hathaway sign in their yard. Everyone from the 48 contiguous U.S. states to Australia is gonna get rich on real estate in California. Truth is, you can spend 3 months in your car driving a cute young couple around - 2 hours in traffic to get 30 miles and view 2 or 3 properties in a day and make multiple offers -- before you finally sell a $260,000 condo. After your commission split with your broker, you end up with about $4,000 before taxes. Of course, as an independent contractor in the eyes of the IRS, you not only pay taxes, but you also have to pay the employer matching taxes. You might end up with $3,000 at the end of the deal -- 4 months later, because of course you have an escrow period. Inventory waxes and wanes. When inventory is tight, I have to improvise. Sometimes it makes more sense to take some contract work for a few months, or even a "permanent" position (nothing in life is "permanent") for a year or two while I sell real estate "part time" on the side.
Trust me, I've been around the block a few times. But don't worry, thousands of people along the way have treated me like I don't know jack squat, so I won't hold it against you. :)
The CES show in Vegas is a "conference" to showcase the tech. "Roadshows" are equity raises. Executives meet with investment firms.
MJ, seriously, why do companies showcase their products -- roadshows, advertising? They want to sell their products, and they want to attract investors. When I worked for a publicly traded startup, I scheduled the "roadshows" -- here in the U.S., Canada, Europe. I worked with a consulting firm from Toronto. The executives (CEO, CFO, COO) traveled, showcased their products, and met with investment firms.
How many "roadshows" has Microsoft had in the last couple of years? Google? Apple? Their products sell themselves. They don't need to go on the road to raise equity.
They did the shows to showcase their tech so they could raise what? Awareness? Awareness for what purpose? Equity? It's an equity raise. I worked with and shared an office with the CFO of a company for a year. It's an equity raise. ;)
A roadshow is generally an equity raise. It seems they're looking for investors.
November 25. There's a conference end of January.
Targun, the NOBO list only applies to publicly traded companies. UOIP is no longer publicly traded. Shareholder information should be delivered to the company upon request regardless.
I learned the hard way swinging the first one based on PRs and hype. I flipped the rest, but held on here due to the PTAB filings and Pacers.
I did do a bit of research and did discover one that relisted after revocation. Never really seemed to recover, though. But it does give one hope.
So it would be the triple lindy.
We have Pacers, Nicasurf. And UOIP wasn't issuing PRs. There's a big difference. I've been in stocks with stop signs releasing PRs. I lost money on one. The rest were day trades. Every one of them ended up suspended and revoked. At least I'm not attacking you.
They would have to reverse merge, or file for an IPO. I have never seen a revoked company reinstate. I'm not saying it can't happen, but I've never seen it happen.
So I wonder if they will have a pre-trial hearing before trial, in addition to the trial scheduling conference?
Nope. We have Pacer updates to rely on, rather than PRs. I don't think it's Carter's intention to bring UOIP current again. I honestly think there will be a buyout one way or another, either the 13 9r a 3rd party.
