Thanks for posting the facts. It seems to me a no win for V/MC and SMME. SMME can approach the court later and this decision/no decision may be reversed. I would still be surprised if V/MC produces ALL the documents requested by SMME by the March due date. Hope reigns eternal...
Better to sign contracts than to TALK about signing contracts.

SmartMetric Reader Opens Biometric Market

You only have to look at news headlines to know that noise around unsafe passwords is reaching a critical mass.
Brute force password tools are readily available for download. And organizations such as Anonymous and other hacker collectives are not about to surrender their notoriety they achieve by hacking into corporate databases and posting scads of user passwords on public online white boards.
Going forward, all that FUD will likely open a gap for risky passwords solutions to eventually be supplanted with enhanced identity and authentication solutions.
It’s a trend that spurred the development of a new technology, developed by identity firm SmartMetric Inc., in the form of a biometric fingerprint reader that fits inside devices as small as credit cards.
The technology emerges as a bit of a disruptor by leveraging users’ fingerprints, used in lieu of passwords or PIN numbers to protect transactions on the 1.5 billion EMV banking cards issued globally. The solution is one of the manifestations of a ten-year research and development endeavor designed to create more secure alternatives to increasingly vulnerable password technology.
The fingerprint technology will manifest in products geared for the financial and online transaction sectors. And that could, in turn, potentially pave the way for the channel to further introduce biometric solutions in those and other vertical markets heavily reliant on security or tapped to adhere to mounting compliance regulations.
Now in general, biometrics haven’t gained the widespread adoption experienced by identity and authentication solutions – for a lot of reasons. Historically, as Channelnomics has previously pointed out, multi-factor authentication solutions, which often incorporate biometrics, has been perceived as cumbersome and complicated, while requiring too many moving parts.
However, the market is forecast to grow. A Reportlinker research report estimated that the biometric solutions market is slated to grow at a CAGR of 21 percent between 2012 and 2014.
Perhaps not surprisingly, the most salient target markets are Point of Sale, ATMs, border security divisions, military contractors and other government sectors that require official clearance and top security systems to guard classified and highly sensitive information.
And other reports have projected steady growth of biometrics in public sector arenas as more organizations forego passwords and other static mechanisms for more robust security defenses.
But with a rash of password hacks gracing news headlines, it’s possible that biometric solutions – such as the fingerprint credit card reader — could trickle to enterprise market segments, as well as retail, healthcare and other verticals
That ultimately could open up a few new avenues for solution providers, who could deepen industry ties while expanding compliance and other security portfolios with a new crop of biometric value-adds.

I've been in SMME for about 3 years. I've rode it up and paid $.75/share and down and paid as low as $.15/share. Wonder what the price was 7 years ago???
The product is a winner. But with the product, as I mentioned, will be competition. And for now, Samsung and others have deeper pockets than SMME.
The lawsuit will certainly allow SMME the necessary funds to put this aray of products out into the market. I believe that is one reason it has taken so long to get it out there. Why borrow funds when you can use the money from the lawsuit. Ms. Hendrick has always believed, and now proved correct, that the patent was valid and valuable. 2013, will show just how valuable it is. For me the lawsuit has always been the catalist for buying. I believe we are talking $6-$10/share of funds going to SMME. Remember, the patent was issued in 2004. That's 9 years of infringment at BILLIONS of transactions per year. In addition I would not be surprised if there are talks, even now, of a pre-trial settlement or a buyout after the lawsuit is settled.
I believe, as I have said, that once the suit is finished the funds will allow SMME to take to market the products of the company OR possibly be bought out by someone. With both the lawsuit and products we will all be kicking ourselves for not mortgaging our homes to buy more stock.
For me it is first and foremost the lawsuit which they have already WON. The Federal Appeals Court has ruled the SMME patent was and continues to be infringed upon. What is left to decide is the monetary damages to be awarded to SMME.
Also, the product has unbelievable potential. I remember reading about a year ago that Samsung was going to invest about a Billion dollars to create what SMME has already developed.
I wonder if SMME has ever been approached regarding a buyout/merger?? Perhaps after the lawsuit we will hear about such action. By then SMME and possible buyers will have a better idea about the value/price of the company.

That's how I read it.
It seems to me it is nothing more than a trademark of the phrases mentioned. With the abandonment of the trademard on those phrases, others are now able to use the phrases without fear of legal recourse.
Those who have the least to say talk the most...
I remember reading somewhere that the agreement you mention, though expired, will be supperceaded by any and all aggrements and contracts to license the product. In short, it is a moot event. I, for one, don't think the CEO would spend all this time and money to build up SMME only to take away the company"s sole product.
Also, it was mentioned some 3-4 months ago that SMME receive a Million dollare funding to complete the plant for production.
As for the suit, I think the legal firm is working on a contingency basis...we win, they win; we lose the battle, they lose any monetary compensation. Can't believe it would be any other way. When the suit started, SMME had no funds....
Some, like me, don't have the time or skill in looking up information that may be easy and available to others, like you, who are able and skilled in doing so. So my thanks for the information shared which comes from the public forum is a reflection of my upbringing to show my appreciation to others who do good and kind deeds for those beyond themselves.
As for SmartMetric, my experience over the last 2 plus years in following them is reflected in my comment in a previous blog. They are not always forth coming to the public forum with information and on many occasions information comes via others like you who glean it from multiple sources.
As for your "show" of vocabulary...it does not impress me at all. A few, like myself, do understand what you are saying. However, it is my experience that those who over compensate in some area of life, be it the use of vocabulary, the vehicle they drive, or outragious behavior, shows that they are trying to make up for some other deficientcy in life. ?? I have been taught and do believe that if you want to say something that is vaulable, say it at a 5th or 6th grade level. Then people will understand you and you won't come off as some arrogant show-off.
Finally, I do appreciate the valuable information shared via blogs. I for one, though, don't value the negitive and/or sarcastic, demeaning comments by others toward others. It's just my upbringing. Long ago I learned that when I look in the mirror, my negitivity towards others is reflected in myself as well. Do enjoy the day and the money you will make on SMME
Thanks for the information. It appears you are more fothcoming with information than SmartMetric. The information is always welcomed and appreciated. I, too, see this as a WIN for us and with the comment about all materials becoming open to the public eye if we go to trial may encourage an early out of court settlement.
At my online broker you cannot sell penny stocks at "market". You have to put in a price and sell as a "Limit" order. Perhaps he wanted to sell for a time and kept reducing the limit price or just to sell all shares quickly put in a ridiculiously low price to sell all of them because he needed the money fast. Putting in a "limit" price of $.001 meant that the seller could have gotten more for his sale than the $.001...but appearantly didn't.
On the other side, buying with a limit price, for example, $.005 still allows the buyer to buy at a lower price. All depends on the "market-makers" eagerness to get rid of the shares.
Remember, some people HAVE to sell for personal financial reasons. The fact that they had to sell at $.001 tells me the sale was a desparate move. Why else would someone sell this stock at that price?
I believe the announcement was that instead of starting production in the 4th quarter of 2013, as originally stated in the PR, production would begin in the 1st quarter of 2013.

It's because of the Bid and Ask prices...the Sell and the Buy prices. The difference is what the marketmaker makes by being a part of the investment transaction. The wider the spread between the Bid and Ask prices the less frequent the trading. As the stock trades more often and with more volume the spread narrows.

thanks for posting the whole hearing minutes. SMME didn't win on all definitiions...but did on many. Now, it seems, for the court, jury or parties to decide on a monetary amount of compensation... I hope for a very huge amount!!!

You can contact the Transfer Agent of Quture/Techs Loanstar and ask them why it is taking so long. The Broker should have that information.

No, not yet.
Nothing more to explain other than TCLN will be winner. Similar companies with like software do not compare to what TCLN will offer. That is second hand from someone in the industry.
Making money in any stock is predicated on buying low and selling higher. I defend Constellation and the companies they promote. I, for example, was first given notice about SMME when it was at 5 cents. It rose to around 80 cents in under 3 months. (With the lawsuit now settled in would be worth your time looking into this one as well as viewing the product they are about to launch.)
I am also aware that Redwood (Constellation) lost money on the SSTP/ZEONS deal because they wanted to pull out once they realized John was less than honest. They nolonger wanted to promote a company with low character management.
With the PR coming forth from this company and the names attached to it this one, because of the product promoted, will be a winner. I see now as a time to accummulate the stock.
There are some honest people out there in the market place, really, and these people are one. IMO :)
Still time and opportunity for those of us in the "know" to accummulate stock in this growing company. I like it!!

When does the quarterly news come out...any idea?
What affect do you think the finalization of the Visa, Mastercard, et al, lawsuit just settled ($6.5 billion) will have upon the SMME lawsuit? Might they feel a bit nervous? Could they now be focussing their time and thought more to a SMME settlement? Might they wait until next year when their insurance will cover costs of another lawsuit settlement...if such insurance they have? What are your thoughts?

I'm in San Diego, CA. The pps, based on the Earnings per share, is based on the Total Outstanding, not the float. That is why this stock, I believe will do a reverse split. When the stock price reaches $5/ share or more many more entities--mutual funds, stockbrokers, etc-- will then be able to buy the stock. That is when the price will really move.
