Beside the appeal letter, this post is also a nice read. It's posted here, very recently by the CEO of Greenshift. Ans it might help you figure out some other issues you might find on Greenshift. It has been quiet around Greenshift for a while, before that post came, so that post was very welcome for those who have been wondering about some issues like why there have been no filings for a while.
Nope, no date set. The appeal court may take as long as they need. But we're all following closely what happens, so if there is a time path set that's known for the public, somebody will share it over here.
There are a couple of posters here, that have been here for years, and that have done a very great job keeping everybody updated, so no doubt that if there is important information released, we will hear it soon after it is available.
It's a patent infringement case. They're at the stage of the final appeal at the U.S. Court for Appeal of the Federal Circuit, and to me it seems like they have a huge change of winning the case. A lot of (millions? billions?)$$$ are at stake, and also the future income of GERS. It seems a all or nothing case

Of course, if we could choose which one to bankrupt, and which not. But H. his opinion was based on getting the clients of the infringers, because he didn’t seem to realize a lot of them are at the using end of the technology, not the developing end. But anyway, even if they develop new technologies, they first would need to pay in case they lose. And gers doesn’t get a penny more if the users of the technology go bankrupt,and there will always be competition that tries to find a workaround.

Why would I reply if somebody asks a question, never says ‘thank you’ if he gets an answer, tells people “You made a mistake. Please be a gentleman and admit it.” when in fact they made the mistake, and When you proof they where wrong about the defendants and the kind of clients they have, they don’t say they made a mistake, they just don’t reply.
I don’t think that’s worth as much energy as I gave it.

Well if they did paint the tape to perform larger buys and sells after that, they could have made a lot more profit.
But there is no way to tell. And I don’t think they will advertise it, since it is illegal, and someone might file a sec complaint when he/she reads it.

We're talking about two very different classes of companies, those that process the corn plant and those that use the processed corn for their own purposes. Greenshift is in the first category, along with the infringing companies. Greenshift and the infringing companies have customers.
The companies that are infringing on Greenshift's patents (according to the lawsuit that Greenshift filed) are doing so because they wish to use the same patented process to produce the same products (or similar products). Their customers are in the same industry as Greenshift.

You’ll see that I talk about ‘future clients’ and that if the court rules in GERS favor, that could become great NEW customers for GERS. So if you hope they go out of business, I say to you, it would be a pity. And if you say that you want GERS to have customers that can pay their bills, I say, then they better don’t go out of business, because again, every infringing company might be a great paying customer after the court ruling. That can’t continue to use the technology without becoming a customer of the technology if GERS wins the case.
For a person doing a lot of research for other media (whatever that means) you sure have a hard time keeping track in a few posts.
I don’t agree. Winning the lawsuit could mean many new customers. Much more then they have at this time. That would increase the future income with much money.
It could even without the lawsuit money make the pps go north.
And it would set the price on a way more stable high level then the penalty could do on its own.

Why’s that? These companies would make great future clients of the Greenshift technology they already would be using in the case the court orders them to pay. Going out of business could also mean they are not able to pay whatever they could earn GERS.
I’ve mailed Kevin on his GERS email account and asked him if BTZO is still connected to GERS.
His reply:”BTZO has separate challenges that need to be resolved. I have a response to your questions drafted and under review by counsel”
So, they are working on more clarity about BTZO too.

If I had the money available I would be buying. But it’s stuck at this time in other stock. But I would love to have doubled my position.
Yep, but it isn't always what shareholders get in pennyland, so that's why I'm really pleased with the recent developments.
Yes, but I wanted to have it confirmed for myself. Even though I did believe your post about it, I still wasn't a 100% sure. But now I am.
As for the tunnel... I know, it isn't the end of it. And there are still a lot of things that can happen. The outcome of the lawsuit is still a lotto play. And beside that we can't predict the future for GERS just based on what we think is the value of the patents. For one, because the value will be determined by the outcome of the lawsuit, and also looking at Attis, we also don't know if their way of handling their company gives a great future perspective. I just know too little.
However, when I look at the most recent things we got to know, the biggest bears for me have disappeared.
- I don't think anymore that there is a chance that KK will let GERS go the road BTZO went.
- The lawsuit appeal has been filed and it looks like they got a very good case
- We are hearing from GERS, so we're not sailing blind anymore
- KK seems to care, despite from what we've heard sometimes.
- We know why there hasn't been any dilution lately, and we know that if everything goes as planned, dilution like it happened in the past will not happen again.
- We know that filings will be updated soon and that they are working on repaying the debt.
And there are probably more positive things happening that I've missed.

He also told me that they will make sure Greenshift will not be delisted due to the absence of filings. They will update the complete filings and financial statements.
I’m sure he’s doing everything he can for the shareholders to get all issues resolved. So I’m happy and confident that Greenshift will do great in the nearby future.
Kevin did also ask you a question:
“Do you want to ask any questions to confirm the veracity of your accusations? If so, now is the time. We need the issue to be resolved. “
I believe that he might be aiming at some accusations about a drinking issue too.
So now you can ask him yourself to resolve that issue.
I’m not talking about transparency, but about the way some posts are more about the man on a personal level, then about the company. Some posts have been unfounded and Ad Hominem about KK. Now these posts can be seen as a personal attack on a fellow boardmember, which is off topic.
One thing that changes now, is that posting about KK can be posting about an other boardmember now.
So it might bring the posts more to posting about GERS.

The going gray of BTZO (in which I also invested, beside GERS) had me worried a bit about the risk for GERS.
1. How can you avoid GERS going gray also?
2. Is BTZO still involved with GERS?

Sounds good IMHO. If a company seeks publicity and contact with shareholders about future plans in a CC it’s often to announce a new path with a great outlook.
Might be good for GERS to, if they fit in to these plans
If BTZO is still involved in GERS, then they are part of the Attis deal. Then you can find out very fast by calling in at the conference call.
But sometimes it might be more convenient, not to know.
