sunshine, (IMO) it appears that you are ignoring the fact that in the past we did not have a merger agreement/acquisition and other important developments. Why would these very positive developments not change the fortunes of WMIH and pps for the better?

nranger, the powers that be(IMO)do no want the shares valued higher at this time for their reasons-that they only know. Since we are on the same team in a sense wanting WMIH shares in the future to be valued much higher, as the "whales" that they are- they always strive for the BIG bucks. Thus, I'm optimistic.

Thus, my point is why would either WMIH and NSM ,if needed, not be in agreement. Both parties want the merger to take place.
I'm not a lawyer. Does such a statement legally have to be in a merger agreement document? The same question can be asked as to:why is it stated that NSM can waive the $4 min. requirement? As a lay person I find this very confusing.If it's required, it's required-period.
nranger, in my opinion due to the fact that NSM has agreed to the merger (partnership) and very publicly, they would not have entered this agreement unless they knew all there is to know regarding WMIH. Thus (IMO), NSM will waive the $4 min. if necessary. There is nothing for them to gain from the merger failing.
According to Mordicai's post NSM can waive the $4 min. pps value of WMIH to allow the merger to go forward. If they know what's behind the curtain, why wouldn't they do so if necessary for the merger to take place?
lodas, your thoughts totally makes sense.We know (IMO) what motivates KKR at this point in the process. I wonder now who would be shorting WMIH? It appears to be economically self-destructive.

How can the stock price of WMIH currently be the major factor determining a tender offer when the WMIH company stock (and price/value) does not represent/reflect the trillions of dollars of WMU value that remains hidden (redacted)- which the judge is aware of?

Questions for the longs. Any hypothesis as to why the MMs keep the pps within a few cents of $1.00? Why not lower or safely over a dollar? Is there method to their madness?
The point is if "they" can get away with what has been described, the Por 7 came with a major loophole which has not been from my memory during the last 9 years reading this board, a serious focus of the major contributing longs. That's why today there is a significant concern expressed! We all understood that "ruthless" and "greedy" were correct descriptions of those who benefited from the heist of Washington mutual. The continuous positions of HFs gave some degree of confidence that the scenarios presented yesterday and today would not come to past. Otherwise, I too would have invested much less time and money on this investment.
