Apple, others test on-chip liquid cooling technology
October 7 - 14:08 EDT Apple could possibly take advantage of a new processor-cooling technique announced yesterday by Cooligy, a Stanford University spin-off company. In fact, the company said it has already prototyped the system with Apple, Intel and AMD. "Cooligy's approach -- called Active Micro-Channel Cooling (AMC) -- involves scoring hundreds of tiny channels into a silicon layer placed on the upper surface of the chip package, reports The Register. "Water -- or any other fluid, for that matter -- circulates through the channels drawing heat away from the core... The Apple connection is interesting since Cooligy's could play a major role in allowing the company to ship G5-based PowerBooks. Motorola's Chip Business May Not Be Better Off
By Donna Fuscaldo Of DOW JONES NEWSWIRES NEW YORK (Dow Jones)--What's good for Motorola Inc.'s (MOT) bottom line may not be so good for its semiconductor division once it's spun out.
While shares of Motorola climbed 10% Monday on news that the Schaumburg, Ill., handset maker will spin off its chip business, analysts and investors questioned whether a standalone semiconductor company will be successful given it has underperformed its peers.
Motorola's chip unit has not been executing, and so "what's the difference if it's a standalone or under this umbrella," said Daniel Morgan, a portfolio manager for Noble Financial Group, in Boca Raton, Fla., who plans to stay away from the eventual initial public offering. "Its chip peers are showing improvements, why aren't they showing a better improvement?"
Indeed, Motorola's semiconductor unit has not been faring as well as its competitors like Texas Instruments Inc. (TXN). In the second quarter, Texas Instruments reported a 9% increase in sales of chips from a year earlier, but Motorola saw a 11% decline from the year ago and said orders fell 23% in that time period.
The company believes by spinning off that unit, it will allow the chip business to take better advantage of an improving semiconductor sector. For all of 2002, Motorola's chip business posted sales of $4.8 billion.
During a conference call earlier Monday, Motorola said that once the spin-off is complete, it will still buy its chips from the standalone company. But analysts and investors aren't so sure that will be case, and cited increased competition as a reason the new company may not perform well.
"Our view is it will be modestly negative over time," said Albert Lin, an analyst at American Technology Research. "Motorola Semiconductor group will lose a majority of Motorola as a customer."
According to the analyst, who does not own shares of Motorola, the handset maker will be free to buy chips from other sources, namely Texas Instruments, which Motorola has stayed away from in the past.
"My belief is if the phone group is part of Motorola proper and the semiconductor business goes off on its own, the chances are better than 50/50 that over time its biggest buyer will buy less," said Lin.
A spokeswoman for Motorola noted that the semiconductor unit has more than 50 years working with Motorola's equipment businesses and that Motorola expects that relationship to continue in the future.
On the flip side, some analysts said that by spinning off the chip business, the unit could see increased market share by handset makers that didn't want to buy from a competitor.
"It now frees up Motorola semi to go out and be aggressive and swim on its own and push envelope against Texas Instruments and Analog Devices," said Noble's Morgan, who does not own shares of the handset maker.
Still while many industry watchers are speculating on the success of a separate semiconductor business, they all said more details will be needed from Motorola before making a final judgment.
"The big question is when and how," said Sandy Harrison, an analyst at Pacific Growth Equities. "The devil is in the details."
Pacific Growth and American Technology do not have an investment banking relationship with Motorola.

Internet Initiative Japan Inc. (NASDAQ: IIJI) ("IIJ") today announced that it received a delisting notice from Nasdaq on October 3, 2003 as a result of its filing of an incomplete annual report on Form 20-F, dated September 30, 2003, for the fiscal year ended March 31, 2003.
The annual report was incomplete because of the absence of audited financial statements and certifications under Sections 302 and 906 of the Sarbanes-Oxley Act of 2002. The delisting notice indicated that IIJ's American Depositary Shares will be delisted from The Nasdaq Stock Market at the opening of business on October 13, 2003, unless IIJ requests a hearing to review Nasdaq's delisting decision. Nasdaq also has indicated that delisting can be avoided if IIJ files an amended annual report on Form 20-F that complies with Nasdaq listing maintenance requirements. At the opening of trading on October 6, 2003, the fifth character "E" will be appended to the trading symbol for IIJ's American Depositary Shares; the trading symbol will be changed from IIJI to IIJIE.
As indicated in IIJ's filings with the Securities and Exchange Commission, IIJ was not able to file a complete annual report on Form 20-F for the year ended March 31, 2003 on time because IIJ was unable to obtain audited financial statements of its former significant equity method investee Crosswave Communications Inc. ("Crosswave") for the year ended March 31, 2003. Crosswave commenced corporate reorganization proceedings in Japan in late August and has not released audited financial statements for that year.

Suit Holds Microsoft Responsible for Worm Holes

Microsoft Corp. is engaging in unfair business practices for its failure to better secure its software against computer viruses, worms and other cyberattacks, according to a lawsuit filed in Los Angeles.
The suit, filed late Tuesday in a California court, is on behalf of a single consumer who claims to be the victim of identity theft as a result of a hacking incident.
But it is designed to be a class-action case if other consumers with similar claims step forward, and will be closely watched as a steep rise in cybercrime raises questions about whether software makers should be held responsible when their programs are compromised.
In general, software manufacturers have not been liable for security and other product failures because users are required to sign license agreements that insulate the companies from legal responsibility.
But a recent spate of worms and viruses that crippled hundreds of thousands of computers worldwide has led to a growing clamor for holding software makers more accountable.
Microsoft's Windows operating system, which powers more than 90 percent of personal computers, has been a particular target of hackers. With seeming ease, hackers have stayed one step ahead of the company in exploiting vulnerabilities in Windows, e-mail software and other Microsoft programs.
"The vast majority of successful Internet attacks are attributable to major vulnerabilities in Microsoft's . . . software," the suit alleges, adding that the company does an inadequate job of warning customers about the problems and helping to fix them.
The suit takes a different tack from previous efforts to claim damages due to software flaws. It argues that because consumers have little choice other than Microsoft software, its failure to provide secure programs constitutes an unfair business practice under California law.
"If you live in the modern world, you must use Microsoft," said Dana B. Taschner, a Newport Beach lawyer who filed the case on behalf of a Los Angeles woman who is a film editor. "You can't on the other hand say, 'We're not responsible.' "
Microsoft spokesman Sean Sundwall said the company is still reviewing the suit but would fight against allowing it to become a class action. Adding numerous additional plaintiffs -- with the potential of multiple damages -- is typically the way law firms fund litigation against large corporations.
"This complaint misses the point," Sundwall said. "The problems caused by viruses and other security attacks are the result of criminal acts by the people who write viruses." Still, he said, "Microsoft has made security a top priority and is committed to developing the most secure software possible."
The suit echoes a position paper issued last week by a group of computer security executives who argued that Microsoft's ubiquity poses a national security risk because one attack can do such widespread damage.
The authors said that policymakers should consider the current "monoculture" of software when evaluating ways to improve computer security.
In addition to compensation for losses, the suit seeks to require Microsoft to improve security notification.

Microsoft Faces Class-Action on Security Breaches

LOS ANGELES (Reuters) - Microsoft Corp. (Nasdaq:MSFT - news) faces a proposed class-action lawsuit in California based on the claim that its market-dominant software is vulnerable to viruses capable of triggering "massive, cascading failures" in global computer networks.
The lawsuit, which was filed on Tuesday in Los Angeles Superior Court, also claims that Microsoft's security warnings are too complex to be understood by the general public and serve instead to tip off "fast-moving" hackers on how to exploit flaws in its operating system.
The suit claims unfair competition and the violation of two California consumer rights laws, one of which is intended to protect the privacy of personal information in computer data bases. It asks for unspecified damages and legal costs, as well as an injunction against Microsoft barring it from unfair business practices.
Many of the arguments in the lawsuit and some of its language echoed a report issued by computer security experts in late September, which warned that the ubiquitous reach of Microsoft's software on desktops worldwide had made computer networks a national security risk.
That report presented to the Computer and Communications Industry Association, a trade group representing Microsoft's rivals, said the complexity of Microsoft's software made it particularly vulnerable.
Microsoft said it had received a copy of the lawsuit and that its lawyers were reviewing it, but could not comment immediately.
Dana Taschner, a Newport Beach, California, lawyer who filed the lawsuit on behalf of a single plaintiff and a potential class of millions of Microsoft customers, could not be immediately reached for comment.
"Microsoft's eclipsing dominance in desktop software has created a global security risk," the lawsuit filed in Los Angeles said. "As a result of Microsoft's concerted effort to strengthen and expand its monopolies by tightly integrating applications with its operating system ... the world's computer networks are now susceptible to massive, cascading failure."
With some $49 billion in cash and more than 90 percent of the market in PC operating systems, Microsoft has long been seen as a potential target for massive liability lawsuits.
But the company, which has been moving to settle anti-trust claims that it abused its monopoly on PC software, has been also seen as shielded from liability claims by disclaimers contained in the licenses that users must agree to when installing software, according to experts.
The lawsuit comes in the wake of two major viruses that have recently taken advantage of flaws in Microsoft software.
Slammer, which targeted computers running Microsoft's server-based software for databases, slowed down Internet traffic across the globe and shut down flight reservation systems and cash machines in the United States.
The Blaster worm, meanwhile, burrowed through hundreds of thousands of computers, destroying data and launching attacks on other computers.
Since early 2002 Microsoft has made computer security a top priority under a "Trustworthy Computing" initiative spearheaded by the company's founder and Chairman, Bill Gates (news - web sites).

Symantec says viruses becoming faster, more complex.
SEATTLE, Oct 1 (Reuters) - Symantec Corp. (NASDAQ:SYMC) on Wednesday said more intricate computer viruses are appearing at a faster rate, making it harder for computer users to guard against malicious software.
Cupertino, California-based Symantec, one of the top providers of Internet security and services, said in its latest Internet Security Threat Report that hackers are using "blended threats" that combine the capabilities of different types of viruses to carry out their attacks.
Blended threats, which include worms that can burrow into computer systems by sending themselves over a network or attaching onto e-mail, accounted for 60 percent of malicious code submissions in the first half of 2003, Symantec said.
In most cases, such attacks focus on Microsoft Corp.'s (NASDAQ:MSFT) software, which provides the largest opportunity to infect the largest number of computers, said Tony Vincent, Symantec's lead global security architect.
"There's a continued focus by the bad guys on vulnerabilities based on Microsoft's Web server product and Internet Explorer," Vincent said.
The Blaster worm, which targeted Microsoft software and devastated hundreds of thousands of computer worldwide, emerged only 26 days after the world's largest software maker warned users of a software flaw and urged users to download a patch.
"The speed of propagation of blended threats is also increasing," Symantec's report said. "Symantec expects to see greater worm propagation resulting in overloads to network hardware, crippling network traffic, and seriously preventing both individuals and businesses from using the Internet."

EU Court/Intellectual -2: Abusive In Some Cases
BRUSSELS -(Dow Jones)- A top European legal adviser Thursday said dominant companies can be forced to share their protected software and databases.
There are circumstances where "refusal to grant a license to use protected intellectual property constitutes an abuse," wrote Advocate General Antonio Tizzano of the Luxembourg-based European Court of Justice. But Tizzano added that a potential licensee must "have the intention of producing goods and services with different characteristics." The opinion focuses on a long-running battle between Connecticut-based health information giant IMS Health (RX) and its arch-rival, Georgia-based NDCHealth Corp. (NDC). IMS complained in 2000 that NDC infringed its copyright on a valuable database, when it created its own database. NDC disagreed, saying the database is an industry standard for tracking pharmaceutical sales it needed in order to compete.
A Frankfurt court now must decide whether Tizzano's decision favors protecting IMS's property, or whether it benefits NDC. Judges in Frankfurt halted those legal proceedings in 2001 because of confusion over European law. Judges then referred the case to the European court for further guidance.
Tizzano's ruling is preliminary, but such opinions are followed by the full court about 80% of the time.
Although the case doesn't involve any other companies directly, lawyers say powerhouses such as Microsoft Corp. (MSFT) and others in the software and pharmaceutical industries are keeping a close eye.
