Toolong...Before the wolves get me, let me make it perfectly clear. I am not saying that we, today, need to rerun the trial. What I am saying is that if the FDA does not accept our combined group we will have to rerun the trial. I think most here would agree with that.
Our focus needs to be on the FDA approval or breakthrough status. Not the settlement. That small bump in PPS would last premarket, IMO.

Six months is nothing. I feel that is also what the wolves would think. In their eyes we would be a wounded antelope and move in immediately.

The wolves would drool at a 10mil or even a 20mil settlement. And, in my opinion, would attack immediately.
A settlement in that area would not even dent the cost of re-running the trial. It would be like giving a glass of water to a lost man who is in the middle of the desert.

RM...400M drop in market cap is just the tip of the damages iceberg. There is the cost of possibly having to rerun the entire trial and if we would have had a since FDA approval; at $20PS our market cap would be in the neighborhood of $2BIL.
How's that for damages!

Lawsuit with CSM
I feel alot here are focusing too much on the financial reimbursement that we could receive in our lawsuit.
IMO there isn't a dollar amount that can be placed on the damage that error will cause if we do not get FDA PIII approval.
There isn't an insurance policy that could ever cover these damages. And CSM, I'm guessing, does not have that capital on their books.
If no FDA approval, because of this labelling error, CSM will be most certainly be put out of business. IMO. We would be suing for more than they are worth and more then their insurance policy can cover. We cannot get a dime if they go under.
In this sense PPHM and CSM are in the same boat. Both our lives are depending on the FDA decision.
Not sure if I am considered one of these "johnny come lately bashers." Seems to me that if you bring any concerns to this board you are labelled that. I am long 34K under $1.00. I have traded in and out the last month as many here have, and I am proud to say I am psuedo-positive long.
I enjoy this board and can appreciate both sides of the argument. I also have the mental capacity to ignore the lunatic fringe, on both sides.

I read the DNDN report a few days ago. The simularities are uncanny. I have to admit, there was always a doubt (10%) that maybe this was a scam. But after seeing the attention we get for a 1.30 stock, I'm convinced we are the target of HF's
CP layed the whole day out to a tee. I do find it odd that all the damage is usually done in the morning, followed by a drift the rest of the day. (Just as CP stated).
Bungler's amazement at the media attention PPHM gets. I have to agree. We get alot of attention for a 1.30 stock.
And finally CP's comment on how low they can take it before those who sold see a new lower price that they can't resist. See Charlie's post today. I feel we are near the "door slamming shut" phase.
With this weekend and March news/events approaching, I feel the short stealing is close to ending. I got my full share yesterday, and today down 10% but yet I'm very calm.

We have filled the gap at 1.35 on light to avg volume. Can expect a move up off of that.

I am not thinking that at all.
In Sept we were told we were close to a deal. I'm sure that partner is still there. Why then not renegotiate using similar parameters, with some tweeks to adjust for the doubt that the labelling error has caused.
This could also work for a new suitor. The deal does not have to be drawn up from scratch. I guess what I am saying is, there probably was a number on the table in Sept. Now we are either getting much lower bids because of the screw up, or we are asking more then that original offer(I don't think that to be the case)
There is alot at risk to the BP regarding the size of this deal. A blessing from the FDA would get the deal done.
Thank you for having this debate. As a newbie, sometimes our comments get ignored or poo poo'd.
Sometimes it helps adults (longtime longs) to view the world in the eyes of children (newbies and johnny come lately's). We have a different perspective based on only what we have learned and have seen in the small time we have been here.
I don't see how that gets us a better deal. If anything, I feel it makes us look weaker. If BP believes in our technology, we would be partnered up bynow now, or real close to it.
We need the FDA to give us Phase3 approval or breakthrough status(our validation) . Until then BP can sit on their hands or lowball. I feel that is what is going on right now.

What PPHM says holds no value in the investment world. Thus the decline in PPS after two PRs.
We need someone else to validate our technology. Either the FDA or a partner. Until then we will drift down. If the drifting continues for too long we will need our own financing.

Anybody who ever wants to buy an individual stock should read that report. It is astonishing the degree to which some will go.
I read it while I pulled up a 10yr chart. That way I could follow all the nonsense. I remember alot of those "hollow" companies (GENR), but had no idea that where scams.
One positive...at least we seem to be of the company that they want to manipulate as opposed to one of the scam companies. I know, small concession.
Question: How do some companies break free of the strangle hold of hedge funds/shorts' manipulation (PCYC / JAZZ)? My initial thought is to partner up. The BP can offer a shield. Would like to here other opinions....TIA
