Stranger things have happened. Even if the DVIS were to be approved at this point, I think the dilution at the levels IMGG has come to would prevent the PPS from going far. If I recall, Dean stated they were planning on 250K profit per machine. How many does the public need? How many can they sell? Where is the dilution of shares at now? Are more on the way that we won’t know about until after the fact? My rough estimate is 658 million OS shares at this time from the Gov. filings published “SO FAR” Although the paper work is slow to catch up with reality!
Oh, then there’s the law suits from the past against IMGG that we have no idea what the judgments are? This is the blank spot in the 10Ks that the SEC allows, but from research by some here, we do know some of the judgements.
All in all I think this post sums up the eventual outcome IMO:

What Next from Imaging 3
Not implying anything. I found the article interesting and thought I would share.
Old but interesting article. I found this at Biotech Value board posted by Dew D.

Investors should have some confidence
I think this "confidence" was lost when Sano used the FOIA to get a copy of the FDA denial. Then we went back and listened to the Conferance Call again and compaired Deans answers to the FDA document.
No Confidence left, only beleive what is stated in legal documents filed with the Government.
I asked for Mike Nessen, he's not there either. I got the run around last week when I asked to speak to him.
Kimble
You asked who is purchasing IMGG stock. I have given this some thought. I think this is false volume. Someone with millions of shares could hire a broker to buy and sell shares between accounts to make it appear IMGG has real volume. With the upcoming 501K submittal many that know little about IMGG would be wary of a stock that traded only few thousand shares a day, as it did in the past,or they could use the volume to support the share price as they slowly sell.We all know massive shares on the sell side would drive the price into the ground. Most brokerage accounts track the 10 day average. I think the question to ask is, who holds enough shares to pull this off? What do you think?
OS has been updated to 414.4 More to come....
I think it’s time for investors to realize that Twits and Face book post are hear say as the SEC considers it, they do consider PR’s made public, but we have not seen any of those lately.
It’s obvious to me that something is awry with no public PR or SEC filings. “Speech from the CEO can be held accountable” Is the CEO avoiding this. A Conference Call can end many questions.
This worries me. There are so many avenues to speak to shareholders on a legitimate basis and the CEO opts for obscure off the record emails and twits through third parties?" I think we have heard enough of these on this board" Investor relations? This is not a money issue because they are a startup company. That’s pure BS.
I will take what’s in the 10K as fact; it’s filed with the SEC. The rest is rumor or BS smoke and mirrors in my book. NO SHORTAGE OF BS HERE.
Now is the time to ask questions.
Mitch Brown, are you willing to step up to the plate and answer investor’s questions? If not, maybe you should consider taking the company private.

You seem to be a long term IMGG investor with knowledge. What do you think happened to Deans missing shares in the last 10K?
These numbers are in black and white and filed with the SEC.No speculation in any way. What’s your take on it? What caused the large share drop in Deans ownership in shares? The latest 10K states Soen owns more shares in IMGG than Dean now?
Is Mike Nissan still working for IMGG?

I also feel this 15 million share deal Dean cut is where the missing shares have gone. I think anyone loaning Dean funds for shares of IMGG would have a stipulation in the agreement that he turn over more shares if the PPS drops. What date did Dean reveal that deal was made? I think the PPS is less than half that today, if memory serves correct.
We have no idea what was in the contract between Dean and his Lender. This could be where some of this volume is coming from? We can only guess, because Dean wanted this deal kept private. I wonder how much cash he received for those shares?
I just looked at that chart, Quite impressive! Over $100 PPS increase.
If this is the case, would not Michelle Janes be the person required to file? My first thought was Deans lender on the 15 million shares had a stipulation written into the contract much like the lenders in the 10K.
But now it seems to make more sense to me, that Michelle wanted no part of that loan and had her shares separated from Deans? I just don’t know what happened here. I dont see her listed on page 57?
I suspect the 1Q 2012 filing will be just as intresting.

You must be thinking of this, I believe it already expired with no shares purchased by IMGG management. Actually I think one officer sold some shares during the time frame? Not sure...
Just checked the OS with the brokers. Its still 408.5 million. I guesss they will update prior to opening bell tomorrow to comply with the 10K numbers from Dec. 2011.
Sano
Are you saving that second for some special ocassion in the future?
Got stopped out on the shares I got last week.
It's amazing how money affects the human mind. Nothing pointed at the post I’m responding to.My largest cost in short term trading or long term shares is taxes. In the end everyone in the US will pay them at a known rate. I can’t speak for foreign investors.
I have held shares in Ariad for a long time. I purchased the first in the 3's. Now those are in the 20% range and I can sell at a known tax rate.
I will be frank here. My orinal investment is off the table with a profit. I have large gains on the table.
I try to take some profits along the way with trading shares.
I will end with this. It's never a bad time to take profits, I think some anxiety would be released if investors took some profit instead of concentrating on maximum gain.
Just my .02 This works for me.
Well lets change the subject. I purchased an nice chunk of shares today. In the past if it goes below where I purhcased it has always come back and higher. I had been looking for a nice pullback. Stocks never always go up. They have to pull back at some point. Like others here said ASCO in near.
laltrader I agree the word squander in my post was a bit harsh. In the end, I have lost faith in management. I do hope a buyout offer comes soon.
From page 36 of the lates 10K. Large pay raise this year? Pernocks pay appears to be lumped in with the total. For whatever reason he does not want it revealed. This is where some of the cash went.

And in the end it will be who. Some still post here IMO
KIPPER
First let me state that I believe the FCSC product works, and works well. This is why I purchased shares in FCSC long ago. I sold my entire position over the last few weeks. The reason I sold is, I feel the management of FCSE has no plan. I feel they have squandered the funds from the previous dilution not long ago. I listened to the Call. Pernock seemed caught off guard with the investors change of heart buy the PPS movement. I feel he is a very weak CEO with no real experience and plans another Dilution very soon to retain funds for the short term. I was willing to give them 18 months until recently.
Bottom line, FCSE has a decent product and Piss Poor Management that does not know which direction to go next.
This is how I honestly feel.
I wish the best for all invested here and hopefully some other Company with a seasoned management purchases this company. That’s the only out I see from here.
It takes exacution by managment in addation to FDA approval. We received FDA approval.................
Here's one. It was carried out very well. The company trades for almost the same as this one does?
http://www.imaging3.com/news/pressreleases/press_sept24_09.html
I suggest he take 1 Hour and do a conferance Call and answer investors questions. Im sure the emails and phone calls from investors would slow down. Surely he not so busy to spend 1 Hour with investors?
Any others like to chime in?
Why? Precisely based on all those factors in that yahoo post, and many more factors which that post didn't mention, e.g. diminishing risk factors. The risks that remain are focused mostly on Pona now. While the risk of FDA rejection is near zero, what is the risk that Pona isn't as good as (most of us) think. That it won't be 2nd line almost immediately. That it doesn't have other possibilities. And what about '113? That should be adding 3-5 pps next year. And the rest of the Ariad assets including their discovery process and team.
I think the Yahoo post was pure speculation. Nice to read but....
I now understand BTH post here a few days ago.
Don’t fall in love with this stock. The Harve is doing a good job, but keep your eye on the the results. I repeat, The Harve is doing what he is hired to do and doing it well!
In the end it’s the FDA's call. They don’t give a crap about outside rants from CEO's or anyone else. Actually they are very harsh and that’s an understatement!
I’m reeled in. Where do you stand?
If you think Pona is a sure approval, re-think your investment.
Never bet the Bank
You have good friends

The sentance of 21 years was Stiff. I can think of a few to send this link to!
LMAO thats a good one vid
I've been waiting for a point to re-enter my trading shares. I sold them all during the meeting but held core shares. I honestly thought the PPS would go down after the denial. What did I know...
We could go lower again tomorrow depending on how these earnings reports come in after hours. I have some cash set aside just in case.
Is this the one?
2. 0610235 - Bristol-Myerss Squibb 3 /31/2009 http://www.ftc.gov/opa/2009/03/bmsplavix.shtm
Drug maker Bristol-Myers Squibb Company (BMS) agreed to pay $2.1 million – the largest fine allowed by law – for failing to inform the
FTC of agreements reached with Apotex, Inc., regarding potential generic competition to its blockbuster drug Plavix. BMS’s conduct
violated a 2003 FTC Order and the Medicare Modernization Act, which requires that certain drug company agreements be accurately
reported to both the Commission and the U.S. Department of Justice. The complaint alleges that BMS failed to disclose that, as part of a
patent settlement in which Apotex agreed not to launch its generic version of Plavix for several years, BMS also orally stated, among other
things, that it would not compete with Apotex during the first 180 days after Apotex did market its new generic drug.
I fully understand your post and the DD to support it. I have one question. Why have the brokers not reflected this new OS count? This is why I was looking for a filing. This is why I suspected the paper work had not been completed yet.
I won’t argue the point other than to say the FDA has the final word. Keep in mind this is a paper or digital package. The FDA doesn’t require a demo?
I’m neither supporting nor denying IMGG product/ application.
I’m just discussing the facts and possibilities as they are at this time.
Good Day
I thought this post was interesting.

Thank you for keeping the information as fact. Your input is greatly appreciated. Its obvious you are very experienced with transactions such as this. I’m just following this story to the end.
I must agree with your statement.
The warrants in question were the kicker, the bonus. IMGG and Cranshire had the nerve to call it a "success fee"
I call it the gift that keeps giving
I think the Crenshire people are professionals and know exactly what they are doing. I think they named it a Success FEE for a reason? This is of course this is hind sight at this time.
From your previous post I guess Cranshire gets shares on a monthly basis? from the court judgment? I suspect this is to stay withen the percentage of share ownership you stated previousely?
I think there is still a possibality of FDA approval. The question is, what will the Share price be worth after the dilutions if it is? I dont see much left for the shareholder at this point.
IMHO
Too bad we have no true knowledge or control of their actions....
I agree with the knoledge part because this is my best guess in what they are doing, its sound business pratices.
On the second part, the shares belong to them, to do with as they please.
There’s no doubt in my mind they are selling shares to get their
1 mil cash back. Hence, the recent 1 mil plus volume days on a stock that has had little volume over the last 6 months. How long they can continue without driving the SP in the ground is what I wonder about. So far, they are doing a impeccable job IMO
So what do you consider Crenshire's 256 million share prize, Publishers Clearing house Grand Prize or Power Ball?
I think all 3 answers qualify!
