Based on my understanding of what has transpired, there was a suit and countersuit with the original plaintiff requesting a dismissal. The original plaintiff appears to have filed the a dismissal of the entire case on April 15, 2009, but was rejected and the matter went to trial on April 20, 2009 The court notes indicated on April 20, 2009, that "HEARING RE: STATUS OF STIPULATED JUDGMENT SET FOR 06/05/09 AT 09:30 IN DEPARTMENT R12" Since June 5, 2009 the matter of the stipulated judgement has been delayed and now it would appear that the original plaintiff filed a motion for a dismissal of the stipulated judgement. That court call is on Friday, September 11, 2009. If the motion for a dismissal is denied, it is my understanding that the stipulated judgement motion that has been delayed will be executed immediately and the case will be considered for lack of a better word, final. Note, actual outcome of the September 11, 2009 proceedings are not officially made available until typically 12:00 Pacific Time or 3:00 pm Eastern Standard Time, the day following the court proceedings. Therefore, Saturday, September 12, 2009. Also note, that the San Bernardino Court System may in essence "drop the file" which may indicate that the case is considered final.
I agree with johnnyfiber in that the resolution and completion of the court case may in fact be the final step barring any other unforseen setbacks.
Finally, before I get questions by posters, I am not a legal expert and therefore have tried to translate the proceedings in layman terms and NO I don't know what the court matter was all about as I have access to the public information available just like you do, and have tried to piece it together based on what was publicly made available through the court system online. If your interpretation is different and/or you have a legal background and can provide insight into the matter, I will gladly accept your insightful comments.

Average is the quotient obtained by dividing the sum total of a set of figures by the number of figures <scored an average of 85 on tests>. mean may be the simple average or it may represent value midway between two extremes <a high of 70° and a low of 50° give a mean of 60°>. median applies to the value that represents the point at which there are as many instances above as there are below <average of a group of persons earning 3, 4, 5, 8, and 10 dollars an hour is 6 dollars, whereas the median is 5 dollars>. norm means the average of performance of a significantly large group, class, or grade <scores about the norm for fifth grade arithmetic>.
Therefore, based on the word "average" one can safely derive that based upon the amount of time already transpired, it may mean we are approaching the relative range that an announcement could be expected.

I don't always agree with what every poster has written, and for the most part don't respond to the post(s) as individual(s) may be confused. I do however compliment a poster when they have been able to explain a topic of discussion clearly and in this case, you have explained the present situation over the last few posts that I share as well. My estimation based upon research conducted is that the scenario you described may begin anytime after September 12, 2009 (date of importance in reference to a prior post made). Would that be your estimation as well based on your research?

In prior posts, I've focused on United States water issues, with respect to EPA and the ETV program and how it relates to RCC Holdings Corp's sole subsidiary, IWS. In addition, I've discussed and shown passed and pending water legislation and the focus of a decentralized wastewater treatment system contained within that legislation. However, what hasn't been discussed at any length is the Worldwide water needs, and why RCC Holdings Corp has known partners such as Evolutech and CPIC with an international reach as presented in the previous RCC Holdings Corp PR's. The following is from "US AID" or U.S. Agency for International Development, regarding international efforts undertaken by the United States Government to address the water needs around the world, along with an explanation as to why water is so important, found in the "Overview" section of the document. Claude Smith-
Mr. Smith's experience traverses many businesses, progressing to his current major effort in wastewater treatment. After earning his B.S. Degree in Math from LeMoyne College, Syracuse, New York, and receiving his MBA from the University of Kentucky, Lexington, Claude began his career in IBM, New York City as a computer programmer and systems analyst in the 1970s. Following this, he moved to computer sales in IBM's New York City financial district, and subsequently accepted employment at Citibank in New York. At Citibank, he held various jobs including Director of International Communications, and ended with a 3-year tour of duty in London as Vice President of Operations for one of Citibank's largest international retail banking facilities.
On his return to the U.S., he found entrepreneurial activities to be attractive and formed his own telecommunications company partnering with staff from the New York Stock Exchange. From there, the company expanded to servicing banks and financial institutions across the country and business grew in both New York and California. Customers included Master Card, First Interstate Bank, Citibank, Chase, and other smaller banks.
When interstate banking replaced many consulting firms in California in 1991, he moved to Las Vegas and began his career in helping high-potential, technology-driven businesses turn around, moving them from losing or break-even positions to significant and profitable operations. In these efforts to date, he became a partner in and helped create the largest graphics firm in the Casino Gaming Industry, was a partner in and helped create the Casino industry's largest website services company, and is now a partner in a wastewater treatment company, headed for national expansion.
Claude is married and has 3 children. He serves on various Boards in business advisory positions.

stimulus money legislation that already passed, as well as the additional pending legislation.

So what is so important about the legislation you ask? The language contained within the legislation,
both passed and pending which Congress and the President of the United States of America, authorizing
the EPA to act as the Administrator, which has the power to oversee the disbursement and types of
projects implemented. Note, that the United States needs to replace an aging water/sewer system, and
upgrade/replace existing water treatment plants.
There is another underlying problem and that is, if I can borrow what Alvin Toffler described as the
Industrial Wave or 2nd wave, an over reliance on bigger is better mentality. At one time, the economies of scale
dictated how an Industrialized Society conducted itself. However, retrofitting an Industrialized Society
isn't feasible first and foremost due to the enormous cost to tear up existing infrastructure to replace
aging water and sewer pipes, while not addressing the source of the waste in the first place. Thus the
legislation makes direct reference to the use and implementation of a decentralized wastewater treatment
plant for the purpose of treating the waste directly at the source.

In an era of post 9-11, the Department of Homeland Security has taken an interest in trying to protect

SACRAMENTO, CA - Today, at a press conference with Governor Arnold Schwarzenegger and California congressional leaders, Secretary of the Interior Ken Salazar announced the Department of the Interior will invest $1 billion under the American Recovery and Reinvestment Act of 2009 (ARRA) in America’s water infrastructure to create jobs and get the economy moving again. Overall, the Department of the Interior will manage $3 billion in investments as part of the recovery plan signed by the President to jumpstart our economy, create or save jobs, and put a down payment on addressing long-neglected challenges so our country can thrive in the 21st Century.
Of the $1 billion that Interior’s Bureau of Reclamation is investing in water projects across the country, $260 million will go to projects in California that will expand water supplies, repair aging water infrastructure, and mitigate the effects of a devastating drought the state is currently experiencing. History: A former police officer at Virginia Commonwealth University, Charles Bryson currently provides project management services as well as technical support for 700 and 800 MHz land mobile public safety communications systems. He also supports clients requiring assistance with projects related to homeland security and communications strategic planning. Mr. Bryson joined RCC in 1998 and has over 40 years of experience in public safety, telecommunications, and higher education.
As a police officer Mr. Bryson served in every sworn capacity as a member of the department from Patrolman to Captain while earning degrees from the University. As a Police Captain, he was responsible for Police Administration, Communications, and Security Operations. Mr. Bryson founded the Commonwealth’s first campus police training academy and was a state-certified criminal justice training instructor.
Telecommunications Background: Mr. Bryson has been deeply involved in RCC efforts regarding the proceedings before the Federal Communications Commission on the public safety spectrum allocation in the 700 MHz band and, in particular, the proposals pending before the Commission concerning the development of a nationwide public safety interoperable broadband network. Mr. Bryson has worked closely with a number of Regional Planning Committees as well as state, county, and municipal public safety agencies to learn their concerns and assist them in the development of filings with the Commission.
Education: Mr. Bryson holds a Master of Science in Public Safety Administration and a Bachelor of Science degree in Public Safety Planning and Management. He has served as an Adjunct Professor in the Department of Administration of Justice and Public Safety providing graduate and undergraduate instruction.

Canadian Interoperability Technology Interest Group
The Canadian Interoperability Technology Interest Group (CITIG) brings together representatives from public safety, industry, academia and government to help shape the direction of research and development activities related to interoperability amongst Canadian public safety providers. If you are indicating that the DEWAT technology didn't significantly change after the indictment of Shackleford, then you need to provide supporting documentation for this claim including links to this information, otherwise the argument is invalid. Notice that in order for the acquisition to go through, that assets needed to be divested, and the list is extensive.
I've tried tracking down the assets, but became bored with the search some time ago. Perhaps you would like to pick up where I left off and figure out where all of the assets went?

All I know is that Rural Cellular Corporation, (RCC) was taken over by Verizon. RCC had a known subsidiary known as RCC Holdings Inc., which apparently is operational at the moment, and based on the digging, I cannot at the moment figure out where all the assets or slices of the RCC pie went after the DOJ ruling. K? My post was with regard to that particular discussion thread of RCC Holdings Inc.
I was going to post my partial search file on RCC Holdings Inc, but apparently there is a limit to the file size and would probably be construed as "off topic anyway."

When you read the ruling note that, Rural Cellular Corporation ("RCC") is the parent of RCC Holdings Inc. Link for that one later...
So, some obvious questions arise including but not limited to:
1. The complete list of assets that was divested.
2. Where did the assets go?
Simply put, of the entire pie, how much of a slice was carved up and who ate it?

Allow me to step in on this one Rob and add a few background comments. (I'm doing this by memory and a bit tired right now) Rob and I have discussed it at length previously. Research has shown that the State of Vermont was irritated that a combined Rural Cellular and verizon would be a combined 63% marketshare. (again doing this by memory I'll dig up the links tommorow) The Department of Justice stepped in and filed a suit to prevent a monopoly and a final ruling was made (again by memory) April 27, 2009. In order for the combined companies of Rural Cellular and Verizon to move forward, a divestiture of assets needed to occur and covered an extremely large range of assets, from (extending into both sides of the Canada/US border) properties, cell sites, long distance, patents, desks, desk chairs, etc etc you get the picture. RCC Holdings Inc was a subsidiary of Rural Cellular. At the present moment, I'm inclined to believe that RCC Holdings Inc was divested by Rural Cellular as a result of the DOJ ruling. RCC Holdings Inc, is rather large all by itself and owns and/or has a number of partnerships, affliliations and associations extending into Canada. RCC Holdings Inc, based upon some research conducted has interests into radio (emergency response type of radio), 4G, microwave etc etc....
I think if you go back far enough into the post records here, that you will find a previous discussion regarding a certain acquisition that was shot down by a few. It was dismissed at the time as being an incorrectly applied PR assigned to RCC Holdings Corp.

In my opinion, the ruling didn't go far enough! It doesn't cover debt securities, only equities! Also of interest is "Credit for Early Close-Outs" page 34 While there was a decrease in Fails, it's now down to only $1.1 billion USD per day. Imagine making a billion per day!
In the Rule 204T Adopting Release, we noted that prior to its adoption, fails to deliver in non-threshold securities averaged approximately 624 million shares or $4.6 billion in value per day from January to July 2008.99 Since adoption of the temporary rule, and in connection with other Commission actions to address fails to deliver, this number has declined significantly such that from December 2008 to March 2009, OEA estimates that fails to deliver in non-threshold securities averaged approximately 307 million shares or $1.1 billion in value per day page 27

Why is it important to have a connection to universities? Perhaps its time to read the
stimulus money legislation that already passed, as well as the additional pending legislation.

So what is so important about the legislation you ask? The language contained within the legislation,
both passed and pending which Congress and the President of the United States of America, authorizing
the EPA to act as the Administrator, which has the power to oversee the disbursement and types of
projects implemented. Note, that the United States needs to replace an aging water/sewer system, and
upgrade/replace existing water treatment plants.
There is another underlying problem and that is, if I can borrow what Alvin Toffler described as the
Industrial Wave, an over reliance on bigger is better mentality. At one time, the economies of scale
dictated how an Industrialized Society conducted itself. However, retrofitting an Industrialized Society
isn't feasible first and foremost due to the enormous cost to tear up existing infrastructure to replace
aging water and sewer pipes, while not addressing the source of the waste in the first place. Thus the
legislation makes direct reference to the use and implementation of a decentralized wastewater treatment
plant for the purpose of treating the waste directly at the source.

For the uninformed investor, who hasn't bothered to research both the passed and pending legislation
and the importance of having the aforementioned credentials, I can see how they could be confused by
"Sammy's Septic System Service" sales pitch that the Environmental Protection Agency's, Environmental
Technology Verification (ETV) Program isn't any better than his "slighly used" septic tank, which has
been "deeply discounted" and get them "while their hot!"
In an era of post 9-11, the Department of Homeland Security has taken an interest in trying to protect
a few large industrialized water treatment facilities as there has been a threat to the water/sewer
system for a considerable amount of time. Treating water at the source, rather than at large industrialized
plants, is much more favorable for DHS for security reasons.
Perhaps its time to now review the legislation, both passed and pending and actually read what it says?
Or, have you already done that and that is the reason why you are defending "Sammy's Septic System Service?"
