Yes it has and there have been no filings by either party which is leading many of us longs to below that a verbal extension was granted by the Judge to wrap up settlement talks or postpone an announcement.
You are correct. Calypso is fully in a position to exclusively litigate this patent based on this filing and others.
Thanks REFRMANIAC... I have been following this company for years and Calyspo shareholders have never been in a better position before. The fact that this stock is still trading at sub .10 blows my mind. I agree that as an outside /traditional / low risk investor, this stock is VERY unatractive. Company holding on by a string, two major lawsuits that could have huge implications on the success of the company, no earnings posted ever, no current income, lots of drama in management over the years. There are a hundred reasons why not to invest, but then there are those of us who truly understand the possibilities of this technology and see where the industry is headed:
- IPV6 standard
- Global smart phones equiped with wi-fi and some with satellite
- Unlicensed wireless spectrum changes
- Increased competition for licensed wireless spectrum
- Individuals / Enterprises looking to use technology to cut wireless communication costs
- Consumer and Enterprise VOIP solutions gaining traction industry-wide, reporting huge user base gains over the last few years
- More and More consumers giving up land lines and moving exclusively to cellular phones
- Demand for premium streaming content on increasingly more capable wireless devices / handsets
- Global adoption of 802.11 a/b/g/n
The time for this technology is now and that is why our current BOD is working their butts off! Cheers to them!
What you are seeing here is that T-Mobile is agressively positioning themselves with players in the industry that offer wi-fi services. They are trying to expand their global hot-spot network pending a major press release in the new year that they are going after deploying FMC to all of their network / devices.
It is NOT infringing on our patent technology for a cell phone to use a wi-fi connection to transmit voice or data traffic. The infringment occurs when a voice or data connection seamlessly switches between different transmission technologies.
The writing is on the wall:
1. Calypso partners with T-Mobile to demo their products and switching technology. Management issues at Calypso and a laundry list of problems and drama result in nothing getting done.
1. T-mobile comes to market with the Hot-Spot @ Home product, which is incredibly successfull using Calypso's patented technology without a license.
2. T-Mobile gets put on notice by Calypso and takes the Hot-Spot @ Home product off the market.
3. All mention of fixed mobile convergence and seamless switching dissapear from T-mobile's website and they purposely go out of their way to communicate in promotional material when wi-fi calling was released for the android that it was NOT seamless.
4. T-mobile and Calypso come to the table in Sept. for a settlement disscussion in good faith.
5. During the 90-day stay, T-mobile releases PR saying that it has been working with Cisco to come to market with an enterprise level solution for FMC that it has been quietly testing with several clients.
6. T-mobile agressively persues business relationships with wi-fi providers to expand it's globabl hot spot network.
7. 90 day stay is up, not a peep from the court, our lawyers or their lawyers, nothing filed, nothing released.
If that doesn't say settlement announcement pending, I don't know what does.
You are right... Storm is on the hook for these filings. I was thinking about the state court case and listed the wrong attorney in my post.
You are right. I had read the holiday schedule wrong. Well if the markets are open on Friday, your guess is as good as mine as to whether or not it is Friday or Monday. I'm leaning more towards Monday.
While market makers tried to shake out some folks today and a whopping 2295 shares have exchanged hands at the open. Doubtful you will see anything in the .07 range if a settlement has happened. T-mobile appears very eager to hit the ground running with this technology and since Calypso has full rights to negotiate a license deal, there is no reason for T-mobile to wait for the state court case.
I see them closing this up either Friday or Monday with a lean towards Monday.

If T-mobile and Calypso have agreed on a settlement, the best possible thing for T-mobile would be to wait until Friday or Monday depending on which year they wanted to take the cash hit in. Friday would be my guess. This also explains why there may not be any official filings to tip share holders off.
That's another good point. Since the markets are closed on Friday, they could release a PR on Friday and complete the settlement then and there wouldn't be a chance for shareholders to react until the new year. This could be a very good strategy.
I called and spoke to the clerk of courts this morning and she stated that there has not been any filings since the origional requested for a stay. She indicated that it is at the discresion of the Judge to extend the stay or not and that we may not actually see a filing to this effect. The Judge may extend the stay verbally upon an agreement of all parties.
This is good news actually. Markle would have filled with the court if the settlement talks were over.
I suspect that T-mobile is going to wait till the end of the fiscal year to release any news of a settlement so that it does not impact their share price negatively or skew their year end numbers before the close of the quarter.
If it is going to happen before year end it will be today or tomorrow. I guess with the holiday and all people are just out of cash for buying. Interesting how the ask was .10 just prior to open and then dropped to .91 a few minutes later. Some short sellers trying to get folks to pop up to .10 so they can make some money. I am looking forward to the days where this stock isn't so easily manipulated by a few people.
I checked my hot sheets this morning and I have nothing. Has anyone been able to get ahold of anyone at the Eastern District Court of Texas / Marshall division. I've tried every extension listed on the phone system a few days back trying to get to a person to speak with. Does any of the longs have a contact there that they have formed a connection with?
I don't think it would be all that difficult to prove to a Jury that t-mobile stole this technology from Calypso. Seamless roaming isn't all that difficult of a concept and the benefits of this technology are pretty clear. Calypso and T-mobile also partnered up to test the technology on their network so the evidence is rather surmountable.

I think Cisco saw the writing on the wall as well and saw a great way to bring significant cost savings to its enterprise customers while further cementing their hold in the communications sector.
They have already integrated this technology into their products and are ahead of the competition. Enterprises and tellcoms will have no problem standardizing their FMC deployments using Cisco branded technology. They are clearly a leader in switching and routing network technologies and this is a good move for them. Doubtful they'd make this move without some kind of licensing deal.
I have a feeling that T-Mobile, Cisco and Calypso all are working out a settlement that will mutually benefit everyone for the next decade. T-mobile is itching to expand its wi-fi calling platform and with wi-max rolling out all over the place, they could improving their service offering while reducing costs and be first to market with FMC.
I've reviewed the patent many times and it is foundational. It covers the seamless switching of data and voice packets on short range and sattelite wireless technologies. Some have pointed out that because the patent mentions bluetooth as an example of short range communication that it only applies to this technology. That is simply false. If you've even glanced at the patent documents for two seconds you wouldn't come to this conclusion.

In 1999 a bunch of companies (now totalling over 300) got together and formed a conglomerate to standardize the new "Wi-Fi" technology. The Calypso patent was filed in 2000. Now keep in mind wireless laptops and smart phones were not available for several years later. Fixed mobile convergence has only been on lips of the communication industry for the last two years. The Calypso patent pre-dates all other patents like it and accurately describes exactly what Cisco and T-mobile are doing.
If you compare the image on page 2 of the patent filing document to the image on the Cisco URL above, they are very similar.
Also, keep in mind that T-mobile and Calypso worked hand and hand to demo this technology several times. It is clear that T-mobile is benefitting from Calypso's patent technology. Cisco is among the worlds largest communications / network infrastructure company and if there would be a way to get around Calypso's patent, they would have figured it out. It doesn't appear that they've taken a novel route with their offering.
For being the last day to trade before a three day weekend and the only thing holding the news up may be a delay in court filings posting to the website, I thought there would be WAY more trading going on today. Even in the 11th hour, this investment amazes me.
The trading volume is earily low today. Everyone is holding their breath.

What's nuts is that the day before a potential settlement announcement, this stock is only trading 137,000 shares with no movement.
I guess everyone who cares to take the risk is in as far as they'd like or can afford to be.

Nothing else really to say for now. He probably checks it but doesn't have anything to add that hasn't already been said. I'm sure he'll check back next week.
Judging from our most recent survey, the majority of investors on this site are optimistic that a settlement agreement will be reached by the deadline next week.
It is entirely possible that we won't reach a settlement and we will go to trial. It is also possible that both sides are waiting until the end of the stay to announce the settlement. Perhaps because of the concurrent project between T-Mobile and Cisco. I disagree that T-mobile is waiting for the resolution of the state court case, but this is also a possibility in which case the stay may be extended.
There are a lot of options on the table. This stock isn't trading in huge blocks now and a significant amount of consolidation has occured in the last few weeks. If I were Dave, I'd probably wait until the last minute and then give everyone an early Christmas present.

Plantiff2000 defacted to Yahoo awhile back. I miss him. He always had some good points to make and did a lot of his own DD. We didn't always agree but he was thorough and I appreciated his opinion. Would love to see him make a come back tour.

Part of this that is perplexing is, the Judge instructed both parties to notify the court as soon as there was a break down in settlement talks so that the case could proceed. Wouldn't Calypso have done precisely this if it seemed clear that the case was not going to go to settlement? And then there is the issue of the huge insider buy a few weeks back.
And finally this news of a joint T-mobile and Cisco project that was already deployed and in use. Think about it, T-mobile and Cisco must have been collaborating for months or years even on getting the neccesary technology embedded into their products. T-mobile must have notified Cisco of the potential problems with doing business with them. The settlement stay makes complete sense if you consider that T-Mobile is looking to break into a completely new industry / communication paradigm. First to market in the corporate sector with seamless roaming. Save companies 30-40% a month on their wireless communication bills. The revenue stream for this is huge.
I am still quite optimistic of a settlement announcement before Wednesday. Markle wouldn't be screwing around with us and we'd see court docs and forward movement otherwise.

Keep in mind that regardless of how this thing plays out moving forward. T-mobile is definately on the hook for past damages for their hotspot @ home solution.
Of all the wireless carriers, T-mobile has the most experience with seamless roaming and partnering with Cisco is an excellent move for the future of this technology. With both companies licensing our patent, everyone else would be lining up to take a number.
I suspect that a settlement announcement is emminent.
I can't WAIT to see how this is going to play out tomorrow on the share price once folks have a chance to digest this news.
This could fall a couple ways:
1) T-Mobile and Cisco have figured out a way to do seamless roaming that works around the ASNAP patent moving forward (they are still on the hook for past damages for use with the hotspot @ home product)
2) T-mobile already worked out a settlement with Calypso and are moving forward on what is clearly the next big thing in communication.
3) Calypso is working with Cisco to test and license the patent and we have a little three-way negotiation going on for the past damages.
4) T-mobile doesn't care and stole the technology and then got in bed with Cisco to bring it to market big time for the enterprise

I am also keeping an eye on it as well as my typical "hot sheets" for news.
Most of us have just been hanging around waiting for the result of the stay in the federal case.
Much of the laundry has already been put out on this board. Many of us are tired of summarizing the basics for new investors and / or responding to the unsupported claims of bashers.
We are watching the trickle down in the share price due to manipulation and all of us are hopeful for an early Christmas.
The folks who are in are already in for everything they can afford to put in and the folks who sold and took their profits are out. Dave and his crew on the BOD are working hard and we will all have some more news in less than two weeks.
The biggest driver in communication is the cost of transport. Carriers are moving towards a flexible model where your communications device will select the most cost-beneficial, quickest means of getting from point A to point B. If that means utilizing wifi to make a call, then so be it. If wi-fi is not available or bandwidth isn't sufficient, then it's off to 3g or 4g.
This model only makes sense if you can seamlessly switch between technologies and route communications and data between transport methods.
