I like to use being behind on payment as an example. When I have to make quarterly payments on something, they could say that every time I miss my payment is another reason to start a case against me for not paying.
This is a hypothetical situation.
Now, on the first time I missed my payment, I told them that my accounts have been frozen as part of a lawsuit. I can show them I got the money, I can show them that I'm not going to lose as much as the money I got, and I can show them that the lawsuit will be pending for 1 to two years max.
So I talk with the creditor, and they are willing to wait until the lawsuit is over. In that case, they would wait, even though they see that I've missed another payment. Because they know the reason and they have promised to give me that time. And I've promised to pay them.
Back to GERS. They've missed on their filings. They might have been invited by the SEC to come over and talk about it (like they did with BTZO) GERS might have went there, and have explained them about the pending lawsuit. Also that if this lawsuit ends, it might be of huge influence on already filed numbers, because they might receive millions of royalties over the past years, that they need to calculate into the past numbers.
They show the SEC that the case is in its final stage, and that their might be reason enough not to publish any numbers pending the lawsuit.
The SEC might accept that and gives them time as long as the lawsuit is pending. In that case, it wouldn't matter if they missed another filing. Yes it might ring a bell, but then they probably look in the file of GERS and see the reason, so no reason for nw action.
That would mean that even if you file a complaint, it wouldn't matter. Just go ahead and file it. If you're right, and the SEC picks it up, it might be that GERS moves to the grey market and you and I probably all lose most of our investment.
And if you're wrong, We'll probably hear nothing about it. Like the last few times, and we can chat about what happened over and over again. Because in the end we'll never really know for sure.
“I expect to see PEIX's full-year 2018 results posted soon.”
Full year and 4th quarter is within 90 days of the closing of the year. So they have until March.
Pretty common with penny stock to have such a spread.
Is it from the Wallstreet Journal? Business week? It must come highly recommended, since you value it so highly.
I didn't read that article here, or anywhere else. So please provide a link to put it in perspective.
I don’t see where this quote is from, and how it fits into our discussion.
You can assume the worst, but I assume that they are hired as consultants by Mexus and that the way they did so is within the law. Until proven otherwise, everything else is pure speculation incriminating them based on nothing but a feeling.
I know, a countersigned contract would do wonders here, right? Or not, because who knows there might be more then that contract shows, right? It's never enough. They can never proof they are working within the law this way.
It's always nice to bent the facts around and re-label stuff so that it seems like Mexus is hiring finders in a fraudulent way, when in fact they are hiring consultants in a legit way. Its pulling wool over everybody's eyes.
Saying they are finders and probably receive finder fees is just fake news criminalizing them.
“That isn't the case? Now who is issuing fake news? You are. Stating as fact that these guys are not receiving finder's fees is pure speculation. What is your source for that?”
Cut the BS. They aren’t hired as finders. First proof that they are finders, then proof that they are getting paid for it.
The only facts we got are stated in the PR. They entered into an agreement on consulting. Everything you make up to criminalize them by saying they are finders and could be receiving fees for that is just made out of air.
“How do these "consultants" get paid? That's what matters, not what title you give them. “
No it doesn’t matter if they are a consultant. Not in a way that is important here. I expect them to cost money like any expertise they hire. I’m not questioning how mexus pays for the drilling company also.
“And you keep bringing up the C word (criminalizing). Is this a sensitive subject? “
Yes, like I stated before. I don’t think its a positive thing to put them down as criminals, because it harms the investirs, the company and simply isn’t true.
“I have shared no fake "news". “
You have, you’ve posted it as if it was a fact that mexus hired investor finders and that they pay them a fee for that. And then posted that they have been re-labeling them to consultants. Which isn’t true. They aren’t re-labeling, you are.
“I am simply suggesting that the way the "consultants" get paid, and their roles with the company, are important.”
It’s only important if mexus would lie about their roles, and would pay them as consultants, but in fact they are finders and they receive a finder fee. And since that isn’t the case based on the facts, it isn’t important.
All other stuff is just like speculating that warren buffet will buy the company for billions. Plain BS. And in the latter sutuation, it wouldn’t even be criminalizing.
“Re-labeling a finder as a "consultant" does not change anything. “
You are doing the re-labeling. They did state consultant in their PR. They never stated investor finders, and you are re-labeling it to investor finders, acting like that’s what they are. Criminalizing them and Mexus. Without any proof.
You can twist it at much as you like, but that doesn’t change a thing or makes it right to post bs.
Sharing fake news like this about a company harms the investors and the company.
“I am willing to listen to how you define their role and duties as a consultant any differently. What exactly does a consultant do, that an investor finder wouldn't do?
IMO, the difference is immaterial.”
The Finra makes the difference between them for a reason, saying a consultant doesn’t need to be licensed. You better ask them what and why that is.
If it was immaterial, they wouldn’t do so.
“So, they're consultants paid by the hour, got it.”
Where did you read that?
All I’m saying is that saying they are finders getting payed to bring new investors, without being licenced to do so, is saying they are doing something criminal.
So if you say thay, you say they are criminals.
They are getting paid, but they are consultants. And that isn’t illegal. That makes a huge difference to what you are implying.
It is, if you say they are getting paid for it, but aren’t registered at the finra. That’s what you told us before.
“The only reason for the investment finders to visit the mine is if they can drag some potential investors along to see things for themselves.”
You’re calling them criminals again based on pure speculation.
In case you say it is law braking, but not a criminal act, read this article:
https://www.google.com/amp/s/m.huffpost.com/us/entry/us_596e350be4b05561da5a5aed/amp
“The SEC is authorized to seek civil penalties and injunctions for violations of the broker-dealer registration requirements. Egregious violations can be referred to the attorney general or Department of Justice for criminal prosecution.”
“Is the dilution machine back on, price has been falling steadily.”
With 11.000 shares sold? At the time of dilution dups where much higher. And Kevin explained what caused dilution to stop. That hasn’t changed, so no dilution until filings are up to date.
“stagnant share price”
Up almost a 100% in the last two weeks. No reason to complain here.
Yep you’re right. I did notice that on this question too: “https://investorshub.advfn.com/boards/read_msg.aspx?message_id=146031316”
It seems to me that hiring people to sell your stock in a way that isn't allowed by law, is stock fraud, which is a crime. So is somebody accuses Mexus of doing so, he's basically saying that they are criminals.
In the past few posts you’ve been saying that it is illegal to work as a finder if you’re not registered as broker. And that these guys are hired to do so.
Illegal is the same as criminal
of course, you're right!
What’s the use of looking at today’s events and events of the future, if all that matters are events from the past. And even then, you are calling them a criminal based on pure speculation. When was mexus convicted for criminal behaviour? Are you saying that when you don’t get all the information you needed on one subject, it makes them a criminal, and all other things they do are criminal too?
What show? Lawsuit appeal is still pending. That's the show we all came to see. The show that makes the money. That show isn't over until the judge says it is.
“It may be speculation, but you are speculating too when you say there is nothing illegal about it.”
C’mon, I’m sticking to the facts.
Since you like to refer to rules and principles, I would like to show you this one: https://en.m.wikipedia.org/wiki/Presumption_of_innocence
I was talking about him stating that they are doing something illegal, while everything stated in the PR points to legally hired consultants, in no way conflicting with the FINRA rules. It came to as that what Mexus did was in no way allowed by the FINRA, but reading into it, it seems that there is nothing illegal to it. So pure speculation, or even fake news. Criminalizing Mexus with made up information.
So it’s all speculation?
Can you quote me where it says that Mexus hired them as finders?
Because all I read is:
There are a lot of ways, but most likely it involves money. Money raised by income, stock sell or by loans. Money today, money in the future of somewhere down the line. That's my guess. I don't know which other compensations exist, but feel free to add more.
Bringing in promoters might mean they got some good news coming up, which they want to promote properly.
Nice to hear from you again. It seems that this will be the year!?
You’re giving a good professional too little credit. One should listen to what someone has to say before jumping into conclusions. He will make sure he knows what he says and does.
Trying to take down gers while owning them, just months from the moment I have been waiting for for years, is a bit like a tv show where I am on this island with all those beautyful woman. I only need to keep my hands to myself for one more night and then I would earn a million and save my relation with the girl I love. LOL
Yep, that’s another thing that has been consistant for years.
It’s a cliffhanger isn’t it?
Be sure to tune in at the Interview with Mexus Gold’s Stan Berk on January 31st, 2019
