I like to use being behind on payment as an example. When I have to make quarterly payments on something, they could say that every time I miss my payment is another reason to start a case against me for not paying.

This is a hypothetical situation.

Now, on the first time I missed my payment, I told them that my accounts have been frozen as part of a lawsuit. I can show them I got the money, I can show them that I'm not going to lose as much as the money I got, and I can show them that the lawsuit will be pending for 1 to two years max.

So I talk with the creditor, and they are willing to wait until the lawsuit is over. In that case, they would wait, even though they see that I've missed another payment. Because they know the reason and they have promised to give me that time. And I've promised to pay them.

Back to GERS. They've missed on their filings. They might have been invited by the SEC to come over and talk about it (like they did with BTZO) GERS might have went there, and have explained them about the pending lawsuit. Also that if this lawsuit ends, it might be of huge influence on already filed numbers, because they might receive millions of royalties over the past years, that they need to calculate into the past numbers.
They show the SEC that the case is in its final stage, and that their might be reason enough not to publish any numbers pending the lawsuit.

The SEC might accept that and gives them time as long as the lawsuit is pending. In that case, it wouldn't matter if they missed another filing. Yes it might ring a bell, but then they probably look in the file of GERS and see the reason, so no reason for nw action.

That would mean that even if you file a complaint, it wouldn't matter. Just go ahead and file it. If you're right, and the SEC picks it up, it might be that GERS moves to the grey market and you and I probably all lose most of our investment.

And if you're wrong, We'll probably hear nothing about it. Like the last few times, and we can chat about what happened over and over again. Because in the end we'll never really know for sure.
