z4: Everyone is probably asleep by now, but, I have a few Qs in conjunction to your post #184755.
Do you think that mgmt. knows the identity of the hedge fund(s) are who are behind the NSS and creating the air shares, AND who the brokerage firms are which handled the hedge funds' air share transactions?? Your best guess, a yes of no would suffice.
And would this/these hedge hunds be the same entities which came to mgmt. in 2008 or 2007? If you know -- or guess??
And if the entities creating the air shares are not hedge funds, do you think that mgmt. knows who they are?
Finally, do you think that mgmt. knows how many, if at all, of the air shares are created by transactions in the German exchange?
Actually, finally, do you think mgmt. knows approx. how many air shares in fact exist?

spongeboy: I would tend to agree with you but, when you consider xDrewx's #'s as to current float and O/S in 10k Subseq. Events Sec., then such #'s demonstrate that NSS are up a creek, that they will have to start covering. My reasoning is that the pps will go up after 10k to maybe $1 or so and that will quintuple pps with no downside, so that NSS will lose control completely of pps. And a forced buyin will begin out of financial necessity. Otherwise, more institutions will start to jump on spng at $1 and drive up pps further.
I don't know, maybe just my ignorance of the situation, including the I don't care attitude of NSS. Is this a stupid scenario?

A few Q's I have are (1) what gives you the impression that mgmt. will include the 300 institutional shares in its Subseq. Events Sec. of 10k? (2) Is such inclusion an unusual occurrence to include in 10k? (3) Is the 300 instit. shares inclusive of or exclusive of DF's alleged 300m shares?

The 10k will be filed when it is. they have filed a proper extension -- used by thousands of companies. None of us know why. And to start making negative personal statements towards spng mgmt. is not going to help you or any of us. The board is edgy enough. Please stay calm. No personal attackes on mgmt. Please. Carp: Did you see the PR just released by GETFUGU Books posted by conestoga, post #183727, a few minuites ago -- this hot new software designed by GETFUGU which allows spng to direct customers to closest stores re GPS for its products.
Another Genius Marketing move by MM/SM -- an expensive one, but one which will pay of in future revs. The creative ideas just keep flowing.... Amazing stuff! Spino
Carp: All one has to do is review D&T's client list, and it includes Berkshire Hathaway. Duh. End of story. Convinced 100% that spng is D&T client for reasons you indicated.
And one of my Schwab Trading Brokers told me during my 40 min. conversation with him as I laid out spng's case., that he's NEVER seen any OTC BB company advertise on TV or otherwise like spng.

1.As to your first Q, how high -- spongeboy has made various calculations as to that issue based on the O/S announced. Look up his name under search/members and find those. They are nice.
2. As to 2nd Q, I personally to NOT think a ss would occur no matter how good the 10k is. There would have to be something else -- like folks have been suggesting resulting in exchange of cert./new CUSIP # to force buyin. Spino

Carp: Just wanted to thank you for this post!! Just superbly worded and 100% logical for anyone who cares to think about it for more than a moment. As no_BS has said also, the hiring of D&T is bigtime news, much bigger than some of the seemingly other impt. PRs recently.

I love this company and its future. I can't wait until we can get rid of these damn shorts.
But, as somone else previously posted, the NSS have been a blassing in disguise in one sense for us in allowing us to add to our positions in massive ways. There is no way I personally could have afforded to purchase my # of shares if spng were fairly priced now, based on forward 2010 earninigs, per4 spongeboy's calculations. I just do not have that kind of funds available in my situation.

For example, if all on this board wanted spng in walmart/target and expressed thusly in posts -- and if such was not in MM/SM's marketing plan at the time, then there is no question in my mind MM/SM would go with what is their plan and would not be swayed one bit by what we think, wouldn't think twice about it. Because we do not know what else is going on in the company, etc., etc. We can express our opinions to mgmt., but it is their jobto micro and macro manage spng. Again, Just my opinion.
Back: I agree with Spongie.
Personally, I don't think that mgmt. has neither the time nor personnel, nor inclination to watch stock message boards -- whether this one, Yahoo's, Googles' or whoseever's. This board is completely unimportant to mgmt. IMO. I do not think mgmt. has the luxury to assign any employee the task of following this board; there is a 250m+ revenue per yr. company to run. They can't pay someone to watch us chatter back and forth about our theories, or whatever it is we discuss -- including arguments about whether mgmt. should have or should not have filed its 10k on time, etc. We do not have that status in mgmt.'s eye's IMO.

Fast: It is my strong opinion that we should let MM/SM take care of their own marketing and which retailers they wish to make deals with and when. It is not up to us to interfere. SM/MM have a plan and it has worked alright so far. They are the marketing geniuses -- NOT US S/Hs in my strongest Opinion!!!
When MM/SM decide it's time to move into Walmart and Target it isn't our decision, it's theirs -- and we should leave managing the company up to them. Sending such foolish petitions to either Walmart or Target, are both foolish and useless. My strong opinion.
If we trust MM/SM to run this company then we should let them run it. Period. Including where spng's products are. Spino

L2 is REALLY nice; did not know what I was missing. I have Schwab Street Smart Pro Software. Charting, graphs, L2, streaming quotes, etc., Trading Broker help with spec. phone # who picks up within 30-45 sec. He'll talk you thru any problem with software or give tips. That's a nice feature to talk to someone without a wait and going thru a long phone tree.
Under general settings of my software I set 8 hours as the inactivity timeout before it goes offline.
Spongie: WOW!! I meant it. sounds like you've thought about this and prepared for "early release" (ha) with your fam. doc., hosp. procedures, med. equip., meds for home. Cool. Will upi need at home nursing or PT? nd then followup Outpatient PT? I did with my knee. Also had to use walker for 2 weeks -- wow did that make me feel old.
spongie: It'll be up to your doc won't it. With so much pain meds on board, they are very constipating (everyone else is asleep now), so doc usually like you to be able to do that stiff prior to leaving. And, of course your mobility, healing -- and who is home to help, phsyical therapy at home, in home nurse care for awhile. If that is place it's probably a go. And do you have a walker fr home use?
