Just checking in. Doesn't look like much has changed since last week aside of the Judge rulling in Daic's favor to strike Markle as an expert witness. Anything else of note come up?
Markle is well known and respected in the Texas legal system and no doubt has plenty of connections of his own. I have full confidence that he is aware of all the options related to what seems to shareholders as a conflict. We don't need to go bum rushing the BOD and his law office informing him of something I am sure he is already quite aware of.
Furthermore - isn't the state case a jury trial?
Sure they must disclose all lawsuits, past, present and expected.
But it is a lot better for T-mobile if the trial is still in settlement talks then if it was in full swing in federal court. Or if the marksmen hearing had occured. Especially considering the potential for damages.
That would have been me and to clarify:
I called the court and spoke with both the person in charge of scheduling the docket and the court clerk. Both said that that it was up to the sole discresion of the Judge as to whether or not the stay could be extended. This typically comes in the form of an official filing with the court. The clerk noted that the Judge could also grant a verbal extension to both parties if there was material evidence as to why a written extension would not be advantageous for the parties.
I've sent numerous emails to the company and have not gotten any information regarding the status of the stay with t-mobile.
With the introduction of the AT&T buyout, the extension of the state case, and other variables, I suspect that one of the following two scenarios apply:
1. There is a substantial reason why either t-mobile or calypso wants to wait to proceed until the state court case is resolved and they have requested that the federal case be on hold until then.
2. Because of the proposed buyout from AT&T, t-mobile requested an extension so that they could postpone anything that may have drastically impacted their share price in the first quarter of this year. This would ensure the highest possible offer from AT&T.

Looks like things are heating up for seamless switching. Good thing AT&T read the writing on the wall and is aquiring T-mobile, who has a very healthy wifi hotspot presence.
I agree with other folks here. I don't see this impacting the current federal case very much. AT&T has stated publically that it will take a year or so to complete the details of the merger. AT&T also needs to get permission from the feds as well.
Just because a potential merger was announced doesn't mean the federal case is dead.
Current and potential lawsuit damages are factored into merger and acqusition valuations. If anything, it may mean that AT&T already has a figure in mind for settlement and included it in the total buyout. T-mobile is on the hook to disclose any liabilities. This is a positive for us.
I wouldn't want to be off this band wagon when the markets open tomorrow. Pull out your sell stops if they are anywhere close to 20 cents a share.
A friend of mine also has a micro cell from AT&T in a rural area where he does not get very good service. He has been using it for a long time and has similar complaints about it.
AT&T is clearly committed to this kind of offloading - especially considering the data demands on their network due to increased smart-phone sales and higher consumer demand for streaming multi-media content.
There is also an increased consumer demand for cloud based music / video and file services accessed from mobile devices and a push from corporate clients for seamless mobility solutions.
This was a perfect time for this purchase considering that AT&T scored very poorly in overall quality and customer service in Consumer Reports January 2011 cell-phone provider report.
They are clearly looking to improve their image, strengthen their customer service, improve call quality and give themselves more spectrum options.
This is so exciting. I feel like a 5 year old in a candy store.
I don't recall any testing history with ATT but I could be mistaken. I've only been following Calypso since 04'.
After the dust settles on all of this, the longs should all get together on some island and spend a month writing a book about this drama. It is a real page turner.
I step away from the forums for a few days thinking that it is going to be smooth waters until the end of may or so and BAM - T-mobile gets bought out by AT&T.
So my thoughts on the whole thing:
I think a settlement with Calypso is probably part of the merger negotiations.
What I think is VERY interesting is that AT&T came to market not to long ago with a cell phone paired with satellite capabilities in a sleek blackberryish handset.

With this new acquisition and the partnership that is already in the works with Cisco. This is a very good move for AT&T and I would expect that they would look to implement ASNAP as soon as possible across their product offering.
Keep in mind, AT&T has been offering MCELL routers to people for their homes for quite some time now to offload traffic from their network. This is a perfect step for them because of T-mobiles huge wifi hotspot network here in the US. They are making a play big time right for Verizon.
I gotta say... I didn't see this one coming.
Tomorrow is going to be an EXPLOSIVE day in the market for this stock though. The whole game has changed and it could mean a settlement at any time.
Still here. I echo everyone elses thoughts on the matter. Flat water, slow going - nothing has changed. I've actually appreciated the break from refreshing this site every 10 minutes and scanning the "hot sheets" every day to see if some new plot twist is in the works.
The bit about Markle seems interesting. If I were a judge, that would kind of piss me off more than anything. But hey I guess it must be worth something to someone.
Not a whole lot going on before the trial I guess. No updates on the federal case. Nothing on the state case site. No email responses from the BOD. Nothing really to talk about that hasn't been talked about before. I guess I could put together another survey for people to take. Who wants a new survey?
Still here hanging out. Hadn't seen much worth commenting on. I scaled back checking the board to once a day until we get closer to the state case. Of course we could settle out of court with T-mobile any day or see an official reason why the stay was extended which may impact share price significantly. I never know with this stock.
Yeah I ran into the same thing on my end. My saving grace is that my holdings average out to .041 so we are still doing fine. Buying more simply isn't an option for me right now.
Really?!?! The last 10 or 15 posts I read were dumpers and smashers. The only thing that has changed since .15 on Friday is that the case may not happen for a few more weeks due to scheduling issues on the court docket - which happen to everyone all the time. Some people are not comfortable with waiting and sold because they thought they were going to catch the wave.
I dropped an email to the 269th trial coordinator to see if Markle's other case is going to be wrapped up this week. If so, maybe we'll have a shot at being on the docket next week.

Does anyone know what the case number / court that Markle's other case is in? I spoke with the trial coordinator at the 333rd today to see if she could provide me with a date when we'd be going to trial and she said that it would probably not be this week and also stated that she thought Markle was still in trial. Anyone have any additional DD about his other case?

As far as we can see now, a building up before the trial. No news has been released as usual. Typically of this stock. But there you have it.
I think the volume and the increase over the last three days has attracted some attention. CLYW has been popping up on quite a few boards lately.
I agree with you that big money comes in with the T-mobile settlement. But with absolutely no word on the stay that was negotiated in September, no news of a settlement. Resolution in the state court case and a settlement announcement could come at essentially the same time.
I completely agree with Highrider. If we are on the docket for Monday, there is going to be NO time to get in at these levels while the trial progresses. Today is the day to get in if you aren't already.
We have NEVER been closer to a resolution with these unscrupulous parties. Strike while the iron is hot!

I called and spoke with the 333rd this morning again and left a message for the trial coordinator. The woman I spoke with said that she is currently in the courtroom and will be available this afternoon. I'll let folks know if I hear anything from her.

I've been here. Just been keeping tabs on all the posts. I could throw my pie in the sky shareprice estimate out there, but I find that most of the time Highrider and I agree on this point so I don't tend to repost the same thing to muddy the forum.
I did have some time this morning to check out the Kineto offering. I read quite a few articles regarding the technology and the following quote from Steve Shaw of Kineto's marketing department appeared in a PCWorld article on January 31 2011:
"Per the investor conference, I think there was a very strong, top down message that Wi-Fi Calling is strategic for T-Mobile. Obviously the goal is to have WFC preloaded on devices at launch. I think that will be the case with devices coming out in 2011.
I also think that last year femtocells became the shining new object on the block, and got lots of coverage at a time when T-Mobile was completely mum on Wi-Fi Calling. Femtos are okay, but as I mentioned, we have an App that turns any Wi-Fi AP anywhere in the world basically into a femto. How cool is that? I’ve also had discussions with T-Mobile that Wi-Fi Calling is a unique advantage they have in the crowded US market. Wi-Fi calling lets their subscribers solve their own coverage problems. It is really cool.
Either way, I think T-Mobile finally sees WFC as a competitive advantage for them, which is great news for Kineto. We’re working with Orange in Europe, who’s moving slower, but did bring the LG Optimus 1 to market in 2010. They have a couple more devices on the way in Q1. It’s starting to take hold."

We still have heard nothing from either side or the court for the federal trial- they must be waiting on the outcome of the state case. We could see the state case resolved and the federal case resolved with a settlement in a matter of days. I think that this stock could go much higher than .25 in the next few weeks.

Read the whole thing and didn't see a whole lot about seamless roaming. Some mention of going after corporate / enterprise customers. There was a picture with wifi supplementing cellular offerings. Wifi calling was mentioned but nothing about seamless roaming.

Yeah I searched my records quickly to see if I could find it as well, but wasn't able to and didn't have the time to dig it up. That case could have been rescheduled too.
I spoke personally to a woman in the 333rd court this morning a few moments before my last post who said that the case was not going to happen today. I tried to call just now and the court clerk was not available and it went to voicemail. I'll let folks know what I hear when I call back later.
Just called the court and spoke with a woman in the courtroom who said that the trial is not occuring today. She said that it was up to the trial coordinator to contact all of the attorneys and reschedule the trial. She indicated that our case was on a two-week docket along with 10 other cases.
So in short - not today ladies and gentlemen.
I suggest all of the longs represented on this board send the BOD an email encouraging them and letting them know that we are behind them.
As of Friday, the BOD was still proceeding to prepare as if the trial was going to occur on Monday. I was not able to get any additional information about what would happen if Markle was called to show for both trials. I suspect that the BOD will cross that bridge when they get there. As many have already stated on this board, court room schedules are difficult to predict. The Judge could choose to hear the case before other cases if he likes. The last thing the BOD wanted was to not be prepared if the trial were to proceed.
Some folks on here seemed to suggest there was a possibility that it wasn't a trial by jury... I was just clarifying for some of the new folks that stepped in since that conversation.
