Good post, PetemanTX. It puts things in the right perception. It shows that what was going on behind the scenes by ERHC management resulted in Chad and Kenya. While I continue to be VERY sceptical of Chad, it sure looks like Kenya will be a winner. It proves the ERHC can do there thing and basically get something of value for a song and a dance. Although all the details are not known, what ERHC did appears to be something that will turn out to be very profitable.
I had my doubts about what if anything ERHC management has been doing all the years, but finally something is very visible in Chad and Kenya. However, there is still the money issue and this brings much fear to the Mr. Market and results in a low SP. One would think with Chad and Kenya on the books, the SP would be in the 20's or 30's. Certainly in ERHC had $45 million in the bank and these assets to develop, the SP would be MUCH higher.
I can only hope the money issue is resolved soon so the SP can go on a tear. I can only hope that those 75 cents 2 yr options held by ERHC management will be exercised this year or next. Doesn't everyone here think about why these options were put in place at such a high strike price when the share price was about a dime.
Pete, even though I thought you post was spot on, can you, at this point in time, honestly tell me you would recommend buying ERHC to a close friend or a family member. I, personally, can not do that. I need to see proof of the financing before, I am a true believer and would recommend buying the stock to a friend.
Is anyone here now recommending ERHC to friends and family or is everyone already been burnt by past recommendations?
Troy, if and when I sell my shares, since everyone has to sell at some time or die first. If I sell lots of 10,000 shares each trade, I would need 150 trades at $8 a trade with TDAmeritrade. That's over a thousand dollars in fees, versus zero with Wells. I believe saving $1200 is worth it. Don't you?
My Wells account gives me 100 free trades, but i am not sure if that includes BB stocks like ERHC. That zero cost is better than TDAmeritrade @ $8/trade.
There is always something when it comes to ERHC. Recently I decided to consolidate my stock accounts into one. I have TDAmerictrade and Wells Fargo Brokerage Accounts. My ERHC shares were in TDAmeritrade and when I requested Wells to transfer all my holdings from TDAmeritrade, the ERHC were rejected and not able to be transferred. ERHC was on the restricted list and this stock was not eligible to be transferred into Wells. I followed up with Wells and after speaking to several advisers I finally got to the bottom of it. According to Wells in 2007 ERHC had some (amount not given) unregistered shares issued in the form of certificates. These shares were not purchased through a regular brokerage house and now most if not all brokerage houses will not take in these unregistered shares for trading (to be sold). My shares were purchased normally and therefore Wells would now allow my ERHC shares to be put into my Wells account for trading.
The unregistered shares from 2007 still remain a mystery. Has anyone else run into this problem?
I cannot believe why this discussion about something that happened 6 years ago continues. The fact that ERHC was cleared of ANY WRONGINGS is all that matters. I appreciate the compliments I have received for making getting official clearance from the DOJ,, but let's all drop this discussion.
Let's talk about the SP. since the SP shot up to over 15 cents on Tuesday, there was some retracing to the 13's on Wednesday. However, today the SP has returned to the 14's and appears to found a strong base. It looks like the SP is ready to continue back to the 15's by the end of the week.
Even this 14-15 cent range will only be a staging point if good news is released. I know we hope and hope for something positive to be released. Will it be Sinopec announcing the go ahead to Phase 2 as some news about the JDZ is way overdue? All we can do is sit and wait and hold on to our shares with tight hands.
Although the DOJ official clearance was great news, it is now several months old and should have been reacted to months ago, if at all. The real good news about the investigation was when the boxes of "evidence" were returned. At that point in time it was evident that the DOJ had "given up" it's investigation.
Troy, you know how hard I worked to an official closure by the DOJ and am very happy it occurred, the years it took to occur somehow lessened the impact of the "official news" and had little effect on the SP.
Middy, all of us here have witnessed the quick runups followed by the gradual return to where the runup started. The best example of this is when Chad was first announced and the SP shot to -13 cents and then gradually fell back to -10 cents over the following weeks. This happened about a year ago.
The question is will this weeks runup be any different? IMO, this runup is/was based on the PRs released by ERHC concerning progress on Chad and the Kenya news. It took about a week or two for the market to digest this news and react accordingly. It took awhile for the market to accept this as good news since funding was/is a VERY big issue.
IMO, there should not the gradual SP fallback to a dime like has happened in the past. Even without additional news the SP has likely found a new basis and should hold in the14-15 cent range for a while. Of course, any new good news will propel the SP much higher. But I cannot predict the release of good news. I can only hope for an announcement that the JDZ Phase 2 is a go or Total hit lots of oil in Block 1, or funding is available for Chad/Kenya or best of all there is buyout offer on the table for a nice price (above 50 cents) or the results of Phase 1,Blocks 2,3,4 is better than 5 dry holes (commercial gas?).
I do not think anyone here is considering selling at this point in time, so we can all sit back and wait for some good news to propel the SP higher.

TOB, I really appreciate that complement from you as you usually pick apart everything I write. I have fought with you in the past, but I have now found some common ground we can agree on. I still lean more towards Middy than you though.
Krom, you ask why we are up 20%? Actually since the open on last Monday when the SP was at 10 cents, we are up a whopping 38%! This must have to do with Chad and Kenya, since no news on the JDZ/EEZ has been forthcoming. If you recall I predicted the SP would be 14-15 cents by the end of this week when the SP was 10 cents (a week ago). It takes quite a bit of balls to predict a 40%-50% increase in a two week period, but I felt the Chad/Kenya momentum starting to really kick in. And it finally has.
One must ask why would Peter N put a plan in place to spend $6 million on Chad and untold millions on Kenya utilizing a very large portion of the company's remaining cash. If a source of funding was not available wouldn't the company go bankrupt and Peter lose his fat salary? Peter MUST know something or he would not be doing this spending and cutting his own throat (pay check) or would he? He would be a fool to endanger his own job by implementing a plan that drains the company of most of its cash without knowing that more money will be coming in from somewhere. If there was no source of new money, wouldn't Peter preserve the present cash and not spent any money to assure his OWN salary for the next 5+ years? It make sense to me that Peter must know something about future finances.
The problem I have with Peter is his lack of communicating the source of funding. Peter may not be able to disclose this funding for business reasons, but it sure makes me worry as anyone can see the company is fast running out of cash as it meets it's financial obligations in Chad and Kenya. I do not want to guess about the funding and only hope Peter knows what he is doing. He is obviously a very intelligent man and recently has made deals for ERHC in Africa that will very likely produce oil and make money for the company. Krom, I too am changing my opinion of how competent Peter is. I know from Middys many posts on how Peter has screwed up in the past caused me to question Peter's abilities. However, his accomplishments in Chad and Kenya may save the company from all his past screw ups I still have my doubts, but I am beginning to have faith that everything will turn out okay.
Maybe my recent well reasoned posts will earn me some more member instead of most here ignoring me and considering me just a degenerate gambler.

IMO, for years and years most here "believed" in the JDZ was THE reason for investing in ERHC. This belief is still being fostered by many here and will NOT go always that easily. IMO,your belief that if ERHC loses Sinopec is not that important is the minority viewpoint.
Up until about a year ago, Chad and Kenya were never heard of as prospects. All those investors at that time had hopes that the JDZ or the EEZ would produce oil at some point in time. Adding chad and Kenya has not really changed the share price over the past year or so.
My reference to a 6 month extension from march 15, 2012. Was preferenced by an "IF" it happened. Do you understand that if a six month extension was granted on March 15, 2012 that we would already be over 4 months into that extension and it would be over in less than 2 months. Reread my post if you do not understand.
Your views on the decision resting with the JDA, are also not held by many here. The decision to spent 100s of millions of dollars to drill is on the shoulders of Sinopec, not the JDA. It's a financial decision.
It has been over 4 months since the March deadline for the Phase 1 decision by Sinopec. It is less then 2 months away, if Sinopec WAS already granted a 6 month extension. What have we heard about this situation? NOTHING. Why is this? There must be something going on, some talks or discussions. But when will some news of what is happening be released? That is anybody's guess. This news whether go or no go is VERY critical to ERHC and to the share price.
The good news is that the Sinopec decision has been overshadowed by the events going on in Chad and Kenya. I have indicated I am not a big supporter of Chad and believe this will eventually prove to be a money pit with no results for many many years. But right now Chad is providing a distraction from the JDZ phase 2 decision.
Kenya appears to be a much better prospect and most importantly less money upfront and MUCH more likely to find a partner. Kenya also provides a great distraction from the JDZ decision.
The point of all this discussion is that the share price will continue to stagnate until the JDZ decision is made. Chad and Kenya are only distractions and keep the share price from falling further while the wait for a phase 2 decision becomes intolerable and share holders finally give up and sell.
The other thing I think about is when I should change my closing tag line which has been there for way over a year. Sinopec PLEASE PLEASE make a decision soooooooooon!!!
It appears most here are happy with Kenya although all the details are not available. I was never happy with the hanging "Chad" and as it has turned out, Chad is still hanging. I hope the same thing does not happen with Kenya. The big question still remains, which is where is the money coming from to get these projects moving?
I would hope Peter N gives shareholders some indication soon about the funding or the partners.
In any case the outlook on this board has turned positive and that should relate to a positive outlook in the share price very soon. I am predicting a rise in the SP this week or next, IMO we will hit 14 - 15 cents by the end of two weeks.

Arnim, your exchange rate on the Euro / $ is way off. It has ranged between $1.20 and $1.45 over the past several years, NOT a $1.60 as you claim. Lately it has been closer to $1.20.
PeteTX, I agree, partners in deep water vs land drillers are not the same. But Peter has had no success in finding either. Chad in basically similar to Kenya and Peter has not found a partner for Chad after a full year of searching. Are th seimics any better for Kenya than Chad? Oh, I forgot what seimics! Where is the money coming from to do the seimics? It's been a year and Peter has done NOTHING with Chad. Is that $ million $ out the door? When will Peter ever accomplish anything worthwhile? Is anyone really happy about what Peter did in Chad? Is appears to me that Chad was more money down the toilet. Will the same thing happen in Kenya? Only time will tell and ERHC has little time before they run out of money.
Well now that the Kenya news is official and the PSC have been signed, Peter can go looking for a partner to drill the project. Let's see Peter has lots of experience with looking for JV partners for the EEZ and Chad but to date no success. So will Peter be calling those same people that turned him down where he approached them about the EEZ and Chad or does he has some new clients to call? I think Peter has to approach those same few companies that are capable of doing this kind of drilling and are willing to work in Africa. How many can there be? A dozen would be a high estimate. How many of those are sick of Peter's ideas to make money by going in partners with ERHC. is Peter bringing anything new to the table or does he still want the partner to pay for the privilege of giving ERHC a free carry? Do these future partners still even want to consider what Peter has to offer after turning him down on the EEZ and Chad!
Think about it, can Peter really "sell" Kenya and find a viable partner after his failing to do so with the EEZ and Chad? How many doors are still open to him after his past contacts with future partners have not panned out ?
Can Peter really find a partner for any of ERHC assets? If so, how long will it take and at what cost?
For the first time I have sold some ERHC stock. The reason is that my 92 year old mother had 40K shares (in at ~ 31 cents at my encouragement). Now she needs cash for living expenses and was forced to sell at these low levels. Yesterday, she has an all or none sell order in for the 40k shares at 10,5 and it did not go through. A 75k buy at 10.75 went through to my disbelief. Today the same order was put in at 40k shares all or none at 11.0 and sold at 11.1!!!! Makes no sense.
Just to add some more comments on the way the PR was worded.
Note it was stated: HOW TO PROCEED with the next step, not IF THEY WILL PROCEED with the next step.
I would hope Peter thoughtfully considered the wording of the PR and realizes what he said.

The most important thing that is on my mind about what is going on with the company involves the progress in the JDZ.

What the statements indicates it first and foremost is that meetings are taking place. Although we all assumed that was/is happening, it is now definitely stated. But what are the meetings about?

Analysing this statement would indicate that there WILL BE a next stage of exploration, but how that exploration will proceed has not been decided. Isn't this good news? Where did you come with the word "withheld" in your posts, since it does not show the proxy that was posted. I clearly remember seeing the word "withheld" on the ballot and you have quoted the wording "withheld" as well. Let 's find out where this word was.

What you both posted showed was the "proxy" not the actual voting ballot one would have mailed in to vote. I do not see the wording "withheld" on that proxy and I clearly remember the word withheld on my ballot.

TOB, I had a feeling you would not put up a poll that you could not show a bias towards your view point. You are afraid that the results will show that most of those here did not in fact vote FOR the present BOD.
What you stated confirmed my belief that a HUGE number of shareholders votes were either withheld or just did not vote FOR the BOD. There was about 230K less votes cast in the BOD election then in the Auditor election. My guess would be that most of these votes would have been NO votes if there was that choice on the ballot. The only alternative to to voting FOR the BOD was to WITHHOLD. IMO, withholding your vote and not voting for something are the same thing. That would indicate over 200k non votes did not want to vote FOR the BOD.
If SEO votes are removed from the total amount of votes, it is OBVIOUS that most shareholders did not want the BOD back.
Why don't you put up the poll to find out for yourself. This will prove one of right and stop the bickering about the votes. Maybe Krom will do it for me if you don't.
I can not figure out how to post a poll (and I have tried), but here is a poll question that should be created that is fair and I would hope most members here can answer.
At the last AGM, my vote on reelecting was (or would have been):
A: In favor of reelecting the current BOD
B: Against reelecting the current BOD
If I recall correctly, on the ballot from ERHC, one could only vote FOR the current BOD or withhold your vote, there was NO CHOICE for a vote AGAINST reelecting the BOD. Was that how the ballot read? If so, then all the votes that were withheld were actually AGAINST reelecting the BOD. It should be easy to subtract the total votes for the BOD from the total votes cast (like for the Auditor) to calculate how many voters withheld their vote which in fact would be voting to NOT reelect the BOD.
Wasn't there many, many millions of votes FOR the new Auditors, while several hundred millions less votes for the BOD. When will the actual results with hard numbers be published? Has anyone asked Peter or Dan for these numbers?
Below is one of five letters I wrote to the DOJ. I firmly believe my content pressure on the DOJ to formally close the investigation definitely helped in the DOJ's decision to do what they did. It is not often that writing to the government gets anything done, but it this case it worked. ERHC indicated that the DOJ's actions were highly unusual, so something must have caused the DOJ to formally close the investigation. I do not mind if Peter takes the credit for this event, but in my heart, I know what I did certainly helped. Note format gets screwed up in the cut and paste process.

Dear Mr. Jarrett,
I have written to you several times over the years regarding the DOJ investigation of ERHC Energy Corp.(ERHC), a five employee oil and gas asset company. On May 4, 2006 your agency, the DOJ, executed a search warrant on ERHC’s Houston’s office confiscating all of ERHC’s records and documents. During the entire four year investigation, ERHC has fully cooperated with the DOJ by providing any and all information requested. The affidavit was under seal and remains under seal to this day, so the actual reason for the raid still remains unknown to ERHC. This “raid” by the DOJ has caused the company to include the following in its regular SEC filings for the past four years:
“The Company anticipates that these investigations may be lengthy and does not know when they will conclude. If violations are found, the Company may be subject to criminal, civil and/or administrative sanctions, including substantial fines, and the resolution or disposition of these matters could have a material adverse effect on its business, prospects, operations, financial condition and cash flows.”
Recently, ERHC recently added the following statement to the above comments:
“In January 2010, all the documents taken by federal investigators from its corporate headquarters in May 2006 were returned. A total of 106 boxes containing original archival records from the Company’s inception until 2006 were returned.”
In the past, in answer to my correspondence to you, you have indicated you can not comment on an ongoing investigation, however at this time your office has returned all of the original records that were seized during the May 4, 2006 raid. As an attorney, it is my understanding that only the original documents can be used as evidence in a criminal matter. Your department has returned what appears to be all of the evidence that was gathered during the raid. Your department no longer has ANYTHING that can be used to prosecute ERHC. However, your department has not sent any official correspondence to ERHC to indicate that the matter is no long being investigated or that no criminal charges will be brought against ERHC. Over 7 months have passed since the DOJ has returned the documents, and I believe it is way overdue for your department to inform ERHC about the status of this investigation. Without any written confirmation from your office concerning the status of the investigation, ERHC must continue to include this negative information about the DOJ raid in its SEC filings.
The present uncertainty of this investigation depresses the stock price because ERHC continues to report this situation as a “pending investigation by the DOJ” in the company’s SEC filings. At present the company can not even publicly respond to the investigation because the company does not know what is/was being investigated because the affidavit continues to be “sealed”. The DOJ is holding ERHC “hostage” to this moribund investigation because the DOJ is doing nothing and appears to not care what harm it does by not acting. Your department is causing ERHC and its shareholders (most of all) to suffer. This is not fair and the DOJ’s non action is what upsets me.
Now if you or your department can honestly state that the investigation is actually continuing forward and efforts are being made by your department to prosecute ERHC, I will be satisfied. But, if in fact your department is no longer pursuing this investigation and is just keeping ERHC unjustly under the black cloud of your investigation, you and your department are not acting in the spirit of justice. Keep in mind the name of your department is the Department of Justice and if your department does just one thing, it should be to promote justice. The DOJ should do what is right and just. I believe it is long overdue for the DOJ to officially notify ERHC that the investigation is no longer proceeding forward and no formal charges will be filed and the matter is closed,

So, if I understand you right, for the total cost of 9 cents, one could buy one share of ERHC and have the right to attend the annual shareholders meeting. Not much of an impedance to keep out the riff raft.

When Peter says, "First drilling in Chad could be within the next 3 years", the first thing that comes to my mind is how "accurate" has Peter been on his past time frame estimates. So if Peter's past estimates are ANY indication of his present estimate of drilling in Chad, I personally would not rely on the three years being met. In fact, if "odds" were posted on BETONANYTHING.COM, my guess the odds would be 100 to 1 that first drill would occur within the next three years. I do not like those odds. I do not like Peter's estimates of when things will get done. He is ALWAYS wrong. So anyone indicating that the drilling in Chad is a long way off is more likely correct than Peter's first drilling in three years.

There is no question in my mind that the many letters I wrote to the DOJ (the DOJ guy in charge of the investigation and to Eric Holder) must have had something to do with the DOJs decision to actually send out official notice ending the investigation. I will post one of my letters over the next few days. I think I "shamed" the DOJ into closing out the investigation.

What is the difference between broadcasting the quarterly conference call where ANYBODY can call in and broadcasting this meeting, the AGM, about to take place. I see no difference and would think ERHC could broadcast the AGM as well. The cost is minimal and the coverage is worldwide. Why is ERCH not doing this?
It would make sense to compare the JDZ blocks with the EEZ blocks as far as "value". The signing bonus just announced for one EEZ block was $2 mil. If I remember correctly the signing bonus for each of the JDZ blocks was $25-$50 mil. Does that make the JDZ blocks worth many times more than the EEZ blocks or have the EEZ blocks "lost" value because of the five dry holes in the JDZ? Was the JDZ worth more prior to drilling because of more extensive seismic studies?
In any case in looks like ERHC will not likely get near the money and/or free carry that they got in the JDZ. Those that were expecteing a boatload of cash for ERHC when they "partnered up" in the EEZ will likely be disappointed.
Although I try to read most posts and ERHC updates I do not recall the company ever disclosing that the IRS audit was ever resolved or if it was resolved, how it was resolved. If I got the I the IRS off my back I would be happy to tell everyone. Does anyone remember ERHC ever reporting how the IRS audit was resolved? Is it possible the audit is still unresolved?
bmu, as far as your dream of the ERHC shareprice, I believe Martin Luther King Day was in January. Now is the time to believe in the Easter Bunny. Soon, Thanksgiving and Christmas will be upon us and all of us will still be dreaming.

Yes Troy, reading WildcatDriller's post on the Dune Board might speak highly Wensrich, but WD's recommendation to buy Dune was a disaster. The SP was actually $57 (shows 57 cents, but the company had a 100 for reverse split) and is now about $3.50. Talk about a free fall, wow! That fall resembles what has happened to ERHC over the same period. Have both stocks bottomed out? That is the REAL question.
Hopefully Wensrich can bring something to ERHC's table and help find oil.
Fitzman, you are spot on about giving ERHC's management kudos for including the soccer game in the PR. Yes is was a stroke of genius, not often done by ERHC. I can just see the smile on STP's officials' faces when they read the PR. What a great way for ERHC to become good friends with STP's officials. I am not sure if Dan K or Peter N was behind this, but whoever was deserves ALL of the shareholders praise. I am sure all the citizens of STP have a great deal of NATIONAL PRIDE in winning the soccer game. It was not just a game, but a NATIONAL EVENT.

Johnny, thank you for correcting the deadline to March 14, 2012. However, note that it took ERHC over 3 months AFTER the last deadline passed before any news was released about the an extension. Does anyone actually believe that any news will be released this Wed the 14th? This is Africa and it is on African time. I would hope nobody is holding their breath waiting for news.
IMO, the SP will remain under a dime until we here some news.
Less than a week away from the March 16 th deadline and the SP can not get above a dime. This shows there is no leaks of good news coming. It sure looks like the deadline will come and go with nothing reported. This will likely keep the SP under a dime until something (ANYTHING) is reported by the JDA or ERHC. Will this be in April at the AGM? We can only hope there is some news before that.

As far as TA is concerned, one MUST ask if this is a news driven stock (i. e. Events) or earnings driven stock. Since, as of yet, there are no earnings using TA is NOT appropriate. Predicting news is impossible and only guess work. All past jumps in this stock have had to do with "hope" that good news would be coming "soon".
Some posters here would "push" this hope to a frenzied level and drive the SP higher and higher. When the hope vanished, like in no oil, the SP would drop. This has nothing to do with TA and using TA on this stock is absolutely worthless IMO. The simple truth is, when there is good news the SP goes up, when there is no news or bad news the SP goes down. This CAN'T be predicted by using TA.
I bought in a few months ago after hearing the CEO on Kramer. The blood analysis future products appear to be amazing and should capture a huge market share once the product is finalized. The future looks great.
