Dean14, pretty confident the big supermarket chains with California locations are awaiting the final verbiage before putting ingestibles on their shelves. GNC stores got out in front of ingestibles, with some risk, but the brands they carry are leaders in safety standards.
California AB45 verbiage is due to the governors office within the next 105 days.
“This bill would require a manufacturer of dietary supplements and food that includes industrial hemp to register with the State Department of Public Health and to be able to demonstrate that all parts of the plant used come from a state or country that has an established and approved industrial hemp program, as defined, that inspects or regulates hemp under a food safety program or equivalent criteria to ensure safety for human or animal consumption and that the industrial hemp cultivator or grower is in good standing and compliance with the governing laws of the state or country of origin.
This bill would state that a dietary supplement, food, beverage, cosmetic, or pet food is not adulterated by the inclusion of industrial hemp or cannabinoids, extracts, or derivatives from industrial hemp if those substances meet specified requirements, and would prohibit restrictions on the sale of dietary supplements, food, beverages, cosmetics, or pet food that include industrial hemp or cannabinoids, extracts, or derivatives from industrial hemp based solely on the inclusion of those substances.”
“This bill would require the Department of Cannabis Control to prepare a report to the Governor and the Legislature outlining the steps necessary for the incorporation of hemp products into the cannabis supply chain, as specified. The bill would also require the Department of Food and Agriculture and the State Department of Public Health, in consultation with the Department of Cannabis Control, if necessary, to develop a process to share license, registration, cultivar, and enforcement information to facilitate compliance and enforcement against unlicensed manufacturers or the sale of hemp that does not meet specified requirements. The bill would make communications shared between these agencies and local law enforcement for this purpose exempt from the California Public Records Act.“
Nah J. YCBD is trash. Look at the financials reports compared to CVSI. , their marketing/spend and their books were all out of whack. I dug into their business, including false trademark claims and lawsuits a year ago and mentioned on this board they were destined to depreciate. I took a substantial short position and held it for about a dollar drop to around $3.70. While I made money I wish I still had that position.

Last weeks action seemed to be people who sold for a loss in nov or through mid dec 2021 getting back in after the 30 day wait period. Those and the ones holding from the 4 & 6 dollar SP days know this will make a comeback in the near future. I predict breakout to .50 or upon Cali AB45 rulings, and the wild card with 007 or acquisition.
Based on the last week of buying action combined with the Cbda/Covid studies when CA announces Ab45 framework CVSI is going to .40 or more with ease.

Hemp 12399 big revenue growth is possible if the AB45 rulings requirements are very demanding. Self GRAS requirement would be ideal. This would knock out 99% of the brands doing business in California and make way for CVSi ingestible products to hit the shelves of +3000 California retail outlets. There would also be huge potential for providing white label and selling our CBD to larger food and beverage conglomerates so their products could be considered GRAS.
We’re betting on Tomc that he can be effective with California DFA and DPH. Ab45 terms are in their hands.
After a search of the California DFA, it’s clear that GRAS is common terminology in many of their publishings.

I think it is very positive message that the ABC states they no longer are patrolling the CBD section of California retailers.
Regarding AB45. A concern for many of the large natural, grocery and drug chains was the California ABC (Alcohol and Beverage Control). They were the ones demanding the natural chains remove ingestibles back in 2018. No large, multi-outlet retailers wanted to risk their liquor, beer and/or wine license for carrying a smaller category(CBD ingestibles). The California ABC has backed off the California retailers for the time being and deferring to the DPH and DFA. See below. The ABC is very clear on no industrial hemp products mixed with alcohol.
With GNC, these stores do not have a license to sell alcoholic beverages so if the DPH and DFA do not respond to GNC carrying the Plus CBD ingestibles you may see additional California retailers begin to carry Plus CBD ingestibles prior to AB45 rulings. Really depends on Tomc and the sales team putting together a very full proof selling story for the California specific outlets and those outlets being able to convey the message to their corporate office.

5. Are industrial hemp products regulated like cannabis products?
Each are uniquely regulated. The definition of cannabis within Section 26001 of the MAUCRSA expressly does not include industrial hemp. The Department of Cannabis Control is charged with regulating cannabis products while the Department of Food and Agriculture and the Department of Public Health have oversight responsibilities involving industrial hemp products. Thus, industrial hemp products are not considered cannabis products pursuant to California Law and any products manufactured, sold, or consumed are subject to regulation and approval by the Department of Food and Agriculture (“DFA”) and the Department of Public Health (“DPH”). If an industrial hemp product has been approved by DFA and DPH, the restrictions applicable to cannabis products do not apply.
7. Am I allowed to sell or use at my ABC-licensed premises industrial hemp products?
AB 45 (Aguiar-Curry, Chapter 576, Statutes of 2021) established a state framework for the inclusion of industrial hemp derivatives in food, beverages, and other types of products under the direction of DFA and DPH. This law maintains the existing prohibition of including industrial hemp derivatives in alcoholic beverages. If a nonalcoholic beverage or other product containing industrial hemp is manufactured in accordance with the Sherman Food, Drug, and Cosmetic Law, an ABC licensee can sell or use these products on their licensed premises.
It is the ABC licensee’s responsibility to ensure all products they sell or use are legal industrial hemp products outside the regulatory authority of the DCC. If an ABC licensee is selling cannabis products requiring a license by the DCC at an ABC licensed premises, this constitutes a violation against the ABC license. (See Question 2) In addition, no industrial hemp products may be added or infused to alcoholic beverages manufactured, sold, or consumed on the licensed premises as this also constitutes a violation against the ABC license. (See Question 6)

I've been part of many acquisitions/mergers and they averaged 14 months from the start of talks to the announcement. CVSI continues to respond to trademark and patent offices(requesting extensions on a few key ones) so they are not throwing in the towel and just resting on current portfolio sales to consumer/retail.
I have to remind myself in 2018 when the charts were predicting CBD industry growth the runway was always until 2023, 24 or 25. Just a terrible collapse with this situation. When we see this through whether good or bad outcome we will have endured a helluva ride.

Amazon is not hard to manage so not sure why YCBD wants an additional middleman in the process. They have screws loose over there at YCBD. Still are in trademark lawsuit over the cbdmd brand usage. Told everyone here to short them at $4.31 less than 8 months ago and look where they are trading now. Out of our top 5 relevant competitors they are the weakest house of cards.
CVSI may have a offer(s) for acquisitions that are standing(for the time being). This might insure the .26 floor for the convertible note. I feel the Plus brand is viable long term and the multiples for natural cpg brand make this feasible.
Not sure what to think on next steps for 007/cantine. That John’s Hopkins study was extended through June 30 2022, but would be a helpful catalyst in determining/supporting the potential of the product.

Now I still believe our packaging designer copied Targets Good and Gather private label branding. Hopefully our account manager calling on Target was requested to create mock for potential placement at Target. Thus these were the results. AB45 is going to do wonders for our Sleep and Calm sales and California distribution.

I’m with you Untuned. I receive daily emails from various sources covering CBD/cannabis industry. They mention all new product news and updates and I rarely see a mention of cvsi. A marketing intern could build a more effective PR campaign. No news ever, in an industry in consolidation and free fall you have to be a squeaky wheel. They’re LinkedIn announcements and Instagram get 5-20 likes per post:( What happened to the content with the road biker or other endorsing athletes? Now they’re back to a rather predictable “influencer campaign.” Build some awareness, make some noise, do something bold or out of the box, be the squeaky wheel we need from a marketing standpoint.
