Shimoda Attorney John Dodge reveals Xenavex source:

Despite Shimoda and Bolt's claims that they had several facilities in NW Arkansas, including a "Class 10" lab in Bentonville where they made their "pipeline drug" Xenavex, no such facilities can be found. Later, Bolt claimed that Xenavex was made in Behesda, Maryland. A recently unearthed letter from Shimoda attorney John Dodge to Ozelle Pharmaceuticals, revealed the true source: RUSSIA!

Excerpts from the letter:

"In fact, ShimodaAtlanticTM learned some time ago that it can purchase a finished nerium oleander L. pharmaceutical derivative, in liquid (solution Neriolini) (oleandrin 22 mg, alcohol 4 mL, distilled water to 100 mL)...from Russian manufacturers."

"...they have long since decided to go that route for the purposes of clinical evaluation of the drug in cancer cases."

That letter confirmed what was long suspected, and what had previously been referred to in this email from Shimoda to a leading research scientist who had conducted trials with oleander extracts:

“The Xenavex program has been more than we anticipated in terms of the challenges and outcomes.

First, the product we are working with is very similar to "solutio Neriolini." We have received sufficient input from the FDA regarding the history of this drug, their conclusions as to its prior inclusion in various pharmacopeias, etc., and how those findings are reconciled with Section 201(g)(1) of the [FD&C] Act as to proceed to a Phase II trial, using sublingual administration, all absent a formal Phase I study. We have prepared a Phase II Form 1571 to that end, and are awaiting IRB clearance. We had decided to hold back on the trial launch until a recently published paper was in fact published, describing the relationship between inflammation and NF-kB. Now that the paper has appeared in Cancer Cell, September 2004, we expect to pursue our IRB clearance shortly. I realize that you will probably find the foregoing statements to be vague, especially as to the regulatory side of things. The particular FDA regs and how they affect this unique project, are to a great extent proprietary at this time…”

It should be noted that, in keeping true to form, the only Alex Harcastle to be found in NW Arkansas is an 86 year old man that doesn't have a clue about Shimoda.

Three big problem areas on Bolt's FAX:

First, the FAX forever put the lie to claims by Bolt and Shimoda that Bolt was not and had never been connected to Shimoda.

Second, and I think this could be HUGE, the FAX reveals a proposal for "quid pro quo" arrangement whereby Shimoda would complete Ozelle's annual reports for three years to bring them into compliance in exhange for being able to refer to the IND (Investigative New Drug) number that was assigned to Ozelle by the FDA in BLOCK NINE on FORM 1571 so they could use Ozelle's data and not have to provide their own. Ozelle maintains they never gave such permission and is infact investigating the matter. Shimoda refuses to reveal what they put in BLOCK NINE on FORM 1571. Ozelle has also sent a cease and desist letter to Shimoda citing several actions of Shimoda that Ozelle finds objectionable.

Third, the FAX of a year ago mentions a PPM and brochure they are going to use "to make the first pass at investors". That PPM later was discovered and it clearly linked Bolt to at least 50% of the ownership of Shimoda through the 25% ownership of his Chronicle Media Group and the 25% ownership of the Vandergracht Trust (the maiden name of his wife). But that was a year ago and was only a $250,000 fundraising effort. Shimoda's website and documents reveal that an additional $5 Million dollar fundraising effort and a $10 Million dollar fundraising effort were to follow, much of it in the first half of this year, which is now two-thirds complete. Since GECC was identified as the shell company Shimoda planned to use to go public and the fact that Shimoda's website was radically updated only weeks ago, the possibility looms large that another, newer PPM is already out there. What that PPM states could be more devastating than the first.

One of the more damning bits of evidence

Is the FAX Jim Bolt sent a year ago on Shimoda letterhead, the text of which is:

After much thrashing about with the FDA, they faxed me the form in question which turns out to be an ordinary Form 1571. In order to be able to "refer" to Ozelle's IND number in "Block 9" we have the send the FDA a letter from Ozelle containing the following words or words to the same effect:

"Ozelle Pharmaceuticals, Inc., permits ShimodaAtlantic Oncology BioSciences LLC to reference IND number 58345 for the purpose of referencing same in block 9, Form 1571."

Here's the rub. If Ozelle is deficient in filing their annual reports since 2001, and we heard they are, then it may be necessary for someone to prepare the annual reports for Ozelle to file.

As part of the quid-pro-quo, assuming Ozelle is delinquent in their annuals and further assuming they lack the resources to file them, we would, on a "best efforts" basis, agree to prep the reports for Ozelle at no charge. All they would then need to do to get reinstated or current is send in the reports. We'd defray the costs associated with all that.

Since there has not been any activity in the IND since the Cleveland Clinic study, preparation of the annuals is probably not a big deal.

I've attached a copy of the form that the FDA faxed us with "Block 9" highlighted.

I'm sending you the first-half of the Investigator's Manual tonight.

A difference between our approach and Ozelle's is that we plan to do the studies in-house rather than use a CRO. We'll finish the second half of the manual over the weekend and I'll send the other half along at that time.

I'll also be sending the "brochure" we're planning to use to make the first pass at investors. It took forever to get our Japanese associates to sign photo releases which has been an unforeseen but major holdup until yesterday. The PPM document should also be ready to send to by Monday night.

We'll go ahead and prep the physician's form 1572 and the form 1571 for the current situation. If Ozelle consents, we'll transmit it via fax to the FDA duty officer who handles these things on nights and weekends.

The story of Tmark1217, Jim Bolt, GECC & Shimoda

The real Tmark1217 (whom I shall call Tmark) and not to be confused with the Jim Bolt alias of Tmark12170 at Raging Bull, is a writer, naturopathic health researcher and would-be entrepreneur who lives in the Dallas, Texas area. For over five years he has worked researching ways to help people live longer, healthier and happier lives. Tmark's dream has been to someday put up a website aimed primarily at addressing the health, wellness and recreational concerns of the aging baby boomers, of which he is one. Last year, Tmark found that his cousin, life-long best friend and running buddy had been diagnosed with stage 3 melanoma, and so Tmark turned his attention to cancer and possible remedies that might save his beloved cousin's life. This led him to join a handful of cancer related forum groups on Yahoo.

One day his research led him to a medicine named Anvirzel, an oleander extract based on a 2000+ year old Turkish folk remedy that had been discovered by Doctor H. Z. Ozel around 1960 and used successfully for over 40 years in Turkey. This discovery led Tmark to join the Anvirzel forum, where he encountered an alias named Boris Batenov, who was engaged in a wild vendetta against the company that manufactured Anvirzel, Phoenix Biotech, while promoting a new Anvirzel drug named Xenavex made by a company named ShimodaAtlantic Oncology Biosciences, LLC.

Another forum Tmark joined was named Oleandersoup the name of a homemade version of the extract made much the same way it has been made for countless centuries. Boris also attacked the homemade version. Since it appeared that an oleander extract might offer promise for his cousin, Tmark decided to investigate the accusations that were flying back and forth and found the ones made by Boris to be bogus. He also found and verified many instances where both the patented Anvirzel and the home-made remedy had cured late stage and hopeless cancers. In the course of doing this, Tmark ended up with well over 200 emails to him or the group from "Boris" and his other alias of "Natashya" and less than half that many from the President of Phoenix. When Tmark determined that Phoenix was in the right on the issue, he was promptly labeled an agent of Phoenix by Boris and company. Ultimately, the acrimony and lies led to the Anvirzel forum being shut down, much like the GECC board has been shut down at RB.

Later, at another forum group named Cancer_Alternatives, Tmark again encountered Boris. When Boris began to make posts attacking Phoenix and the home-made oleander remedy, while again promoting Shimoda and Xenavex, Tmark told the forum about Boris and posted some excerpts from his vicious attacks on other forum sites. He also made passing mention of something he had seen on another forum site: that he had heard that ShimodaAtlantic might be a pump and dump scam. This was on or about March 17th of this year. The next day, Tmark received a private email from "Boris" saying "well played" and then threatening him with Shimoda "suing the snot" out of him.

By Monday March 20th, Tmark had received a number of threatening emails from someone representing themselves as Shimoda's in-house counsel threatening to put him in jail and demanding that he sign a voluntary injection against any further posts. Likewise, the forum moderator received a series of emails from the person who was supposed to be the president of Shimoda demanding the posts be removed and that Tmark be suspended from the forum, in addition to threatening to sue both the moderator and Yahoo. The topper, however, was that bright and early that same day two people showed up unexpectedly at the office of a company Tmark had recently done work for. One identified himself to be a representative of ShimodaAtlantic, and the other said he was a U.S. Marshall! They demanded a physical description of Tmark, his phone number and address, and information on the make and model of car he drove. They mentioned that the FBI was involved and that Tmark had even been turned in to Homeland Security.

Tmark was dumbfounded, to say the least, but he immediately knew that something was wrong with the whole scenario. First of all, no legitimate company reacts in such an overboard manner over a couple of objectionable lines in an obscure internet forum group of less than 200 members. Second of all, Tmark knew that it was not in a real U.S. Marshall's list of duties to help a private company try to locate someone who posted information they objected to, and that no government agency would react so swiftly. Nevertheless, he responded to the so-called counsel for Shimoda to the effect that he would gladly retract what he had posted and apologize if only they would point out what they found objectionable and prove that he was wrong. He also warned them to leave him alone, pointing out that had no connections whatsoever with Phoenix, as they alleged, but that he did happened to have over 15 years experience in investigations as well as a background in journalism, and would not be a wise choice of adversaries.

The Shimoda response was to keep threatening Tmark and continue trying to find him, including sending emails to previous co-workers as well as friends who had received a Xmas email that also went to "Boris" before Tmark knew what kind of character he was. Once again, Tmark informed Shimoda that he had no connections with Phoenix and again warned them to leave him alone. When they refused to listen, Tmark decided that instead of buckling under he would fight back, and so he began to investigate "Boris Batenov" and Shimoda.

He soon discovered ties to GECC and to a three time convicted felon named Jim Bolt, who was wanted on a bench warrant from Oklahoma City for failure to appear in the Terry Nichols trial. He found the connections to LEC and Operation Uptick and the east coast crime syndicates, and to a white supremacist militia group in NW Arkansas. Quite frankly, he found himself scared ----less and spent many nights jumping at things that went bump in the dark! But he pressed on, determined not to give in to the forces of darkness that appeared to be after him.

What Tmark did not find was the touted class 10 lab nor any other facilities for ShimodaAtlantic other than a small office in a retail strip center in Springdale, Arkansas that had been taken over from John Culbertson who was alleged to have images of the Murray building in OKC immediately before, during and after it was bombed. Neither did Tmark find any proof of Shimoda ever working for the Department of Defense, or for Hughes Aircraft (now Raytheon), as alleged on their website. Or contracts with Wal-Mart. Or any real people who actually worked for Shimoda, other than Jim Bolt whom he ultimately found to have ownership connections to at least 50% of Shimoda on a damning PPM that turned up along with a FAX from Jim Bolt on behalf of Shimoda. He even discovered that the photos on the Shimoda website had been lifted from image reseller websites and the "copyright" watermarks poorly airbrushed out.

Ultimately, Tmark also found that the so-called FDA trials touted by Shimoda had never been applied for nor granted and that the drug itself was actually imported from Russia. As his reward, Tmark got to see his name posted on the G E C C forum board literally hundreds of times with false allegations of a criminal background, child pornography, trading drugs for sex with elementary school students (taken from a sarcastic post he made wondering what kind of slander was coming next), drug use and drug running, deviant sex, and on and on. He even had the horrifying experience of seeing a Jim Bolt alias try to lure kids to an internet forum group he hosted about oleander soup and get them to make their own oleander extract, mix it with vodka and mainline it - which would likely have been fatal. Just so this despicable man could strike back at Tmark. Fortunately, Tmark discovered the evil plot in time and tragedy was averted.

But eventually the truth was found out, Bolt and his many aliases were identified, including "Boris" and "Natashya" and the fake in-house counsel for Shimoda. Much to Tmark's relief, he also found that the felonious Jim Bolt was just a criminal version of the great Wizard of Oz, living in a travel trailer while his cancer ridden wife had to work to support him and the family while he plotted his schemes and attacked his opponents.

Now because of the efforts of Tmark and many others who have long followed the schemes and misdeeds of Jim Bolt, all of the information mentioned here and much more has been turned over to more federal and state agencies than Bolt can imagine, and these agencies are not sitting on the information, you may rest assured. Judgment day is coming and it will not be kind, I believe. All because Jim Bolt continued refused to listen to the truth and listened only to the inner demons that drive him to commit such misdeeds and whisper in his ear that he is much smarter than he really is and that he should attack all who oppose him unmercifully. Just like he attacked Tmark, who stood firm against the attacks and fought back for truth and justice.

Today, Tmark is sleeping much better while simultaneously working on a book about Oleander, a book about how to live longer, healthier and happier and the dreamed about website with the same purpose - thankful to have played a part, however small, in bringin justice to Bolt and others who deserve it and he is profoundly thankful to all of those who have helped him.

And that, my friends, is not only my humble opinion, but is also the true story of Tmark and how he helped contribute to the demise of Jim Bolt, no matter how many times or how often Bolt might try to say otherwise under his many aliases and false posts.

Some busy cooks in that Shimnoda/GECC kitchen!

What has been happening is that the felon Jim Bolt dreamed up another investment fraud and put a website up the Shimoda Atlantic website for a company the was supposed to have a class 10 lab, various other facilities in NW Arkansas, a new investigational drug called Xenavex, previous history as a Department of Defense contractor, existing contracts with Wal-mart, and all kinds of good things. In truth, they merely have a little office tucked away in a darkened breezeway in a retail strip center in Springdale, Arkansas, appropriately next to an Hispanic AA meeting room (probably where The Hispanic Fisherman hangs out these days). Their drug turns out to be imported from Russia. And they have been caught with pants around the ankles and hands in the cookie jar. How tasty!

Of course this is a longtime favorite recipe of Mr. Bolt's. He tried making the same dish back in 1982 when he was convicted on two counts of mail fraud and two counts of making false statements to a federally insured bank in federal court in Oklahoma. During the 1985 conclusion to that case, USA v. Bolt, the 10th Circuit of Appeals had this to say:

“Our review of the evidence establishes that Bolt was involved in elaborate schemes to defraud various companies and individuals. These schemes were built upon a fictitious business enterprise known as Saturation Systems ... The government has aptly described this business as being an enterprise which included a group of imaginary products and services, located in various imaginary locations in the United States, Scotland, Norway and other overseas locations.”
