If forced to trial ... i beileve that the the omitted peices of the valuations will be addressed to show the true worth of the infringement.

I was referring to all 13 not just cox, including royalties.

However, my main point that may have been lost in the numbers, which was that the value of the infringement is not the amount that we will get with a settlement. We may get 1/2. (Which is still 50x the PPS even if its 800m)

In a trial we have a better chance of getting closer to the true value of the infringement and the potential of getting willful infringement from the largest defendant (3×)

You are correct IND has not failed...just delayed

My estimates are that the infingement is worth beween 2.5 and 5B. Willful infingement against the largest defendant could push it to 7B.

That being said I think in a settlement I think we get between 1.5 and 3B. If it goes trial more...maybe 2.5 to 4B.

I think its a good trade to push back the cox trial in exchange for scheduling the others now.

We have known that the 13 defendants will do anything they can to stall and delay...its the only card they have left to play.

The Covid situation is just a convenient excuse, and one that may be hard for the judge to dismiss, eventhough he knows that covid has nothing to do with their desire to delay. I hope i am wrong.

The only arguement that i can see helping us keep the trial scheduled for aug 18, is that it is very likely that the covid situation will be no better in nov than it is now, miggt be worse... so let get this bs over with.

When IND is submitted and accepted, the tune will change from "scam" in order to drive the PPS down to "going to 5+ dollars". people are currently trying to suppress PPS as they accumulate and will try to inflate it when they are trying to sell

We are discussing assest sequestation.

In this case we are talking about freezing the assets of the defendant so that the cannot squander them and claim inability to pay

Just be patient. Its very likely that the longer we wait for a settlement the higher it will be. Personally....i am torn between wanting a settlement during the trial and wanting the jury to decide. Jury award would be $3-5 per share....but dont want to deal with appeals and think could settle around 2 maybe higher if we let things play out. Just my opinion
