12/12/2014 Minutes of proceedings [non-document] before Judge Sara Lioi. On December 12, 2014, the Court conducted a telephonic status conference upon the joint request of counsel for all parties. Attorneys Justin Nelson and Jordan Talge participated on behalf of plaintiff Zecotek Imaging Systems. Attorneys Tracy Quinn and Kip Bollin participated on behalf of defendant Saint-Gobain, and attorney Neil Duchez participated on behalf of defendant Philips Healthcare. Previously, the Court had granted the parties' joint motion for an extension of time until December 12, 2014 to file dispositive motions so that the parties might pursue settlement discussions. (See Doc. No. 286 and Non-document Order dated December 5, 2014.) At the status conference, counsel updated the Court on the status of their settlement discussions. Counsel represented to the Court that settlement of the entire lawsuit is contingent upon the signature of defendant Philips to the terms of settlement between Zecotek and Philips, and that Philips is expected to execute the required document on December 15 or 16, 2014. The Court instructed counsel for Philips to immediately e-mail the document to all counsel upon its execution, and to inform the Court's law clerk by e-mail (Sandra_Denman@ohnd.uscourts.gov) that Philips has executed the required document. Counsel advised the Court that execution of the required document by Philips effectively settles the entire case, and the Court will thereafter file its standard entry that the case has been settled. By December 31, 2014, the parties shall file their own dismissal entry, which shall supersede the Court's standard entry. the way I understood it was like this..
.. Casper ruled the way she did was because the cert of correction came after the suit was filed.. so if they wanted to include the earlier date, they would need to dismiss and start over. That would add another 2 yrs to the case (or so I read), so it is in both parties interest to just go with the cert of correction date. If Activation wanted to start over they would be on the hook for all past damages, and worlds doesnt want to add anymore years to a already drawn out process.

realistically I think ACTI will offer WDDD 150 million to make this go away, but they will want 1 bill.. Im thinking willful is key, we may see judgement for 300 m and triple or willful could be thrown out/dismissed you just never know.
I hope for 4-5 pps.. but I will not load up or unload completely on any news. Im more likely to play the ups and downs.. will sell some on any pop from the markman. I hope to be able to hold a core position to keep my ave down just in case we get swings like VRNG had during its 3 yr case vs goog. If you play the swings right you can play for free.

settlement talks still on the table.. maybe thats why we get an uptick today.. I would think that item #1, loss profit claim being thrown out would hurt share price thou.

Attorneys Tracy Quinn, Matthew Frederick, Kip Bollin, and Kirsten Rydstrom participated on behalf of defendant Saint-Gobain Ceramics & Plastics. Attorneys Robert McBride and Brian Rosenthal participated on behalf of defendant Philips Healthcare Informatics. Prior to the status conference, the parties filed a joint status report. (Doc. No. 261 .) The Court specifically discussed with counsel certain aspects of the report. The first point discussed was the statement in paragraph 1 of the joint status report that plaintiff Zecotek was withdrawing its claim for lost profits. Zecotek has not formally filed a separate document in this regard, but confirmed that it was withdrawing the claim. Zecotek's withdrawal of its lost profits claim is duly noted by the Court and the claim is hereby deemed withdrawn. The second point discussed was the parties' consideration of the whether and when a settlement conference might be useful. The possibility of a settlement conference remains under consideration by the parties. Should the parties wish to mediate the case through a court-annexed dispute resolution process (see Local Rules 16.4 through 16.7) or with the assistance of the assigned Magistrate Judge, they shall file a joint notice requesting same. The third point discussed was defendants' intention to amend their counterclaims and invalidity contentions. Any motion by defendants for such leave to amend must be filed by September 5, 2014, and any response by plaintiff must be filed by September 19, 2014. Lastly, the parties discussed with the Court the page limitations and manner in which dispositive motions will be filed with the Court on December 5, 2014. Any proposal the parties wish the Court to consider for submitting dispositive motions outside of the normal requirements of the Local Rules must be filed by November 7, 2014. this is a legit company, that will make (yes, in time) legit $$$.
this is a trading vehicle, and we see lots of swings that allow traders to target this stock.. best to keep a long term core position and then use other funds to buy the dips and sell the pops.
