As indicated, the Company will be more vocal, when guidelines, settlement and legal precedents are established. Sony is the leader of the legal direction and effort, as we all understand, they are moving faster than expected.
Most importantly the Company is accomplishing very much, for the post legal environment and needless to say, working very close, with their customers/partners.

Greg, It is true, the press release on csn indicated short term, this did not happen and someone will lose their job over it!
The attorneys and accountants are not the problem. The financing is what took so long, you see the funds must all be raised prior to going into the quiet period or at the point of the s-4 filing. A large part of the money came in and we are seeking to complete the process.
The most interesting part of this opportunity is that it looks better for 2006, why?
Kevin and sony/bmg have a great bond in their working relationship, this accentuated at the point of the fall out of f4 and Kevin coming over, you see, Kevin championed copy-protection and he championed mediamax, in sony's view, Kevin was correct and helped design a GREAT product! Now, Kevin is looking to turn his VISION into reality and this vision is VERY CLEAR TO SONY, which is commited to protect lost money from piracy.

Rox, Thanks for your question, however computer programmers don't file s-4's, besides your mixing two completely different departments, we want to satisfy the anti-copy-protection crowd, regardless if we think its a nit-pik or not because copy-protection is going to emerge as a viable industry in 2006 and we want the anti-crowd to concede to this reality with a semi-content, state of satisfaction. The s-4 is being worked on, the attorneys have been appropriately retained.
Felton and Halderman seem to be subjectively against, copy-protection.
They are subjectively against our fix, no one else including the EFF is complaining about the "fix". We will however fix the "fix" just for EVERYONES satisfaction. This is being done in real time. We will be successful!!! sony/bmg is committed to US and copy-protection. This too shall pass and we will be standing. We will not die only get stronger with every step.
Problems are opportunities! The fallout of f4 and Kevin Clement joining Mediamax at the same time has created a huge opportunity of exponential possibilities! It will intensify a good relationship and make it GREAT! Why?
The various copy-protection technologies will now be more scrutinized because no company will take the risk of another f4. Therefore the merits of the mediamax product will be highlighted and thus embraced, by a management(Mr. Clement)leadership, that has an evolved relationship with Sony/Bmg. yellow, The final numbers are not known because we are in the high selling season and will go to re-print on big sellers, to put additional cd's on the market, the new release's are out but production is still in gear,the quarter is not over.
I have no evidence of 145m projection being close, this projection was a positive assumption number with forecast's from the record industry, that expected the apple switch turned on and therefore, a 2nd major, to ramp up, this did not happen, YET!

Its not the MOST relevant issue, the new CEO and 2006 is the most relevant issue, right now. Management sets expectations, the expectations were not getting the appropriate traction and action has been taken...we had a MANAGEMENT SHAKE-UP, this is a FACT! The new CEO of mmxt will bear his fruit and the results will begin to show and be revealed in early 2006 or perhaps prior to the new year.
The 4th quarter results are out of our hands, whats in the hopper is in the hopper....the stock trading at the mid .02 cent range and has grasped that fact, the point now is the new CEO Kevin Clement and 2006, this is the reality that most have come to grips with.
That is not to say the 4th quarter numbers won't be good, we have a good amount of good names that should sell, well through December and into post Christmas sales.
The 4th quarter numbers are not whats most relevant at this point in time...its the direction of the copy-protection industry for 2006. In other words the buyers and sellers are placing their bets on the 2006 year.
The stock @ the mid .02 range is not betting on the 4th quarter numbers....the prevailing idea is if in 06 the business begins to accelerate(which I clearly expect and believe the stock offers TREMENDOUS value) than its a GREAT buying opportunity.
The merger is a very high priority and is proceeding forward with vigor. Have a good Evening.
The psychology in scmi's stock including the buyers and sellers, are of two schools of thought:
1. The f4 fallout is "GREAT" for scmi because:
a. We are the better product left standing.
b. Hesse wants copy-protection 100% by March of 2006.
c. Mr. Kevin Clement has a very, very Good relationship with Sony/Bmg.
d. We lost zero business because all the Christmas release business has already been released and on the shelves. The high shopping season has arrived. Re-prints based on demand will occur. Thus the reason why berg has not annouced new stuff.
e. The copy-protection industry needed this "fallout", it needed to happen and so now Sony/Bmg could strike their "guideline" appeasement in full settlement with consumer groups.
f. Sony/Bmg wants to go worldwide with copy-protection.
g. The rest of the industry and apple will enjoy the fact that the industry has established, a legal precedent, through guidelines and appeased settlement.
h. macrovision's product will begin to receive more review.
i. mediamax will emerge as the new name in copy-protection.
2. The f4 fallout is bad for scmi because:
a. the copy-protection industry is going to fold up and go away despite the fact that hundreds of millions of dollars are being lost worldwide.
We move forward from here on every front! with Kevin Clement taking a lead role! He is the right guy at the right time! I believe we have a stronger relationship with Sony/Bmg because of Mr. Clement and the xcp fallout, combined.
We have some of the best developers in the Phoenix market working for scmi/mmxt, look for our DVD product to make huge strides over the next 2 to 3 months, we are talking to the big players in that business and they want copy-protection too!

Its tough to dis-agree with SOME of what you say, yes, we have a fine product for cd's despite the anti-copy-protection sentiment and yes, part of what were setting out to do is have a great dvd product as well(no apologies). The current "ISSUE" that exist's is that the anti-copy-protection crowd, has got a "full court press", effort, out in droves, against, copy-protection, therefore against, the better product or leader(mediamax).
This is pure exploitation, of the first4 debacle and also a slight thorn in the total copy-protection effort, that Sony-Bmg has innovated and initiated.
The solution, is in the response of making every possible correction and obtaining additional guidelines, in an effort to win over, "the consumer", yet sticking to the copy-protection objectives.
This in my opinion will initially entail more "doing", followed by appropriate, product public-relations communications. mariomax

I would estimate that in terms of the "compatibility" statement in regards to Macrovision and ipod/itunes, that it would logically have come from Macrovision.
Oh so correct! EMI wouldn't have made up those comments, historically and suggestively, it would have been information from, macrovision communicated to EMI.

I want to take a moment to thank Matt and all the scmi moderators for taking the appropriate action on friday and also for accepting my prompt return. If one was to read all the adamapple posts, one would realise that although I used an occasional dual identity, in adamapple, I certainly did not deceive anyone ever, with the specific's of the post's, but simply defended my company, my product and myself only at a time when I felt it was urgent for me to do so and only when I was at a remote site. I would have done the same as mariomax. I have always disclosed through mariomax, who I was, what my position was and what my ownership interest is.
I will only continue to work towards communicating and defending the entire scmi/mmxt family, always with good intentions, I will now be fully cognizant, of all rules of IHUB.

Howdy, The usage of the word "probably" is incorrect although it is possibly a grey area because of the point that it is "legaly inconclusive".
It is inappropriate of me, I have no hard evidence of "cash flow positive" or not. I have not discussed this with our CFO and I don't know if we will or won't be cash flow positive and what the probabilities truly are. I do know that everytime I go to the record store, I see more and more albums protected by mediamax and of course more big names are being announced through sunngrams.
I apologize for making such a statement and officially retract it. Thank-you kindly for pointing it out and I will attempt to be more careful in the future of using such language, despite its lack of conclusiveness which can be debated, I in no way want to mis-lead any shareholder, that this company, Sunncomm/Mediamax, will or won't be cash flow positive in the 4th quarter.

Buddy, Thanks for your reply question, I am a big believer of copy-protection and the protection of property rights for artists. I embrace the CEO PJ's vision which has resulted in our superior(opinion) mediamax product. I also believe this industry is ready for take-off(opinion). My suggestion of "cash flow positive" being probable is a personal OPINION not an official statement by the company. The company has made its "official statements" public on the "cash flow matter" through forecast's and is part and parcel of the OPINION in which I have come to, also discussions with other personnel have allowed me to be optimistic with my opinion of this company but it is discussion and dialogue with this board in which I share my opinion.
I do not have a crystal ball only an opinion and that is not an official opinion, just an opinion in which I share.
