Appeals court rules against Trump travel ban

A federal appeals court has ruled against President Trump's travel ban, upholding a nationwide injunction barring the administration from enforcing the executive order.
The ruling is the latest legal setback for Trump on the travel issue and, like several previous court rulings, the outcome rested heavily on his own words.
Trump's order restricting travel from six majority-Muslim countries "speaks with vague words of national security, but in context drips with religious intolerance, animus and discrimination," Chief Judge Roger L. Gregory of the 4th Circuit Court of Appeals wrote in his ruling.
The 10-3 ruling included numerous citations to campaign statements in which Trump called for a ban on Muslims immigrating to the United States. The plaintiffs who have challenged the travel order have argued that it is a disguised version of the Muslim ban that he called for during the campaign.
Trump's statements "provide direct, specific evidence of what motivated both EO-1 and EO-2," the court said, referring to ther first and second versions of the travel order: "President Trump’s desire to exclude Muslims from the United States."
The 4th Circuit, based in Richmond, Va., is one of two appeals courts that have recently heard arguments on the travel ban. A similar case is pending before the 9th Circuit, based in San Francisco.

Hours before German Chancellor Angela Merkel flew to Brussels to meet with President Trump and other NATO heads of state, she rekindled an old acquaintance with Trump’s predecessor, Barack Obama.
About 70,000 people packed an avenue by Berlin’s landmark Brandenburg Gate on Thursday to hear the two leaders speak, with cheers and chants of “Barack, Barack!” breaking out when the former president took the stage.
Without mentioning Trump by name, Obama spoke of the need for universal healthcare and a nuanced approach to immigration in response to security threats.
“This is a new world we live in — we can’t isolate ourselves,” the former president declared, with Merkel looking on. “We can’t hide behind a wall.”
Obama spoke of this week's deadly bombing at a pop concert in Manchester, England, saying leaders had to find ways to balance security fears and fundamental rights.
“One of the biggest challenges… is how do you protect your country and your citizens from the kinds of things that we just saw in Manchester,” he said. “And how do you do it in a way that is consistent with your values and your ideals?”
Making his first European speech since his presidential term ended, Obama told the crowd he had spent the last four months "trying to catch up with my sleep" and devoting more time to his family.
"I'm very proud of the work I did as president," he said to more cheers, adding that he considered healthcare reform a signature achievement. Republicans are now in the midst of trying to dismantle his Affordable Care Act.
"My hope was to get 100% of people healthcare,” he said. “We didn't quite achieve that, but we were able to get 20 million people healthcare who didn't have it before.”
Obama’s speech was not timed to coincide with Trump’s first visit to Europe as president, aides said. The invitation was extended before Trump’s trip to Brussels — the fourth leg on multi-stop tour — was scheduled.

U.S. President Donald Trump told his Philippine counterpart that Washington has sent two nuclear submarines to waters off the Korean peninsula, the New York Times said, comments likely to raise questions about his handling of sensitive information.

Trump has said “a major, major conflict” with North Korea is possible because of its nuclear and missile programs and that all options are on the table but that he wants to resolve the crisis diplomatically.
North Korea has vowed to develop a missile mounted with a nuclear warhead that can strike the mainland United States, saying the program is necessary to counter U.S. aggression.
Trump told Philippine President Rodrigo Duterte Washington had “a lot of firepower over there”, according to the New York Times, which quoted a transcript of an April 29 call between the two.
“We have two submarines — the best in the world. We have two nuclear submarines, not that we want to use them at all,” the newspaper quoted Trump as telling Duterte, based on the transcript.
The report was based on a Philippine transcript of the call that was circulated on Tuesday under a “confidential” cover sheet by the Americas division of the Philippine Department of Foreign Affairs.
In a show of force, the United States has sent the nuclear-powered USS Carl Vinson aircraft carrier to waters off the Korean peninsula, where it joined the USS Michigan, a nuclear submarine that docked in South Korea in late April.
According to the Times, a senior Trump administration official in Washington, who was not authorized to publicly discuss the call and insisted on anonymity, confirmed the transcript was an accurate representation of the call between the two leaders.
U.S. officials, speaking on condition of anonymity, have said Trump discussed intelligence about Islamic State with Russian Foreign Minister Sergei Lavrov and Russian Ambassador Sergei Kislyak at talks in the Oval Office this month, raising questions about Trump’s handling of secrets.
Trump also praised Duterte for doing an “unbelievable job on the drug problem”, the New York Times reported, a subject that has drawn much criticism in the West.
Almost 9,000 people, many small-time users and dealers, have been killed in the Philippines since Duterte took office on June 30. Police say about one-third of the victims were shot by officers in self-defense during legitimate operations.

For lies to successfully masquerade as news, they need help. They need accessories to the crime against truth.
In two ways that have the power to shock, even in this almost shockproof era, lies are getting plenty of help.
Infowars, that cesspool of destructive conspiracy theories, on Monday received a temporary credential to attend White House press briefings. Yes, the very organization headed by the repugnant Alex Jones — known to scream falsehoods at the top of his lungs to his radio and webcast audience — was entrusted by the executive branch to bring news to American citizens.
In the past, please recall, what constituted “news” at Infowars included the following: that 9/11 was planned and executed by the U.S. government; that President Obama was not an American citizen; and that the massacre of small children at Connecticut’s Sandy Hook Elementary School was a hoax carried out by actors.
Infowars’ inclusion (even if only temporarily) in the White House press corps is disgusting.

But no more disgusting than the lies that Fox News continues to spread about Seth Rich, a 27-year-old man who was shot dead last summer in Washington.
To hear Fox’s Sean Hannity tell it, this was an inside job by the Democratic National Committee, where Rich worked: retribution by the Hillary Clinton camp for his sharing insider emails with WikiLeaks.
The theory has been thoroughly debunked by Oliver Darcy at CNN among others, and Rich’s family has demanded that Fox retract and apologize. To the reported embarrassment of its own staff, Fox hasn’t done the right thing.
Quite the opposite, in fact: Former House speaker and Trump insider Newt Gingrich used Fox’s national platform Sunday to spread the lies further, using what remains of his own credibility to make respectable people think it might be so. (Police think it may have been a robbery gone wrong.)
Decent people should shun both Hannity and Gingrich.
The Seth Rich lie has become the new Comet Ping Pong — another Washington-based conspiracy theory that ended in January with a gunman walking into a family-friendly pizza joint and firing shots as he “self-investigated” a supposed child-molestation plot involving Hillary Clinton.
Crazy, baseless and dangerous.
But if these two situations weren’t so insane, you could have called them predictable.
Because we have in the White House a president who was the most prominent promoter of the “birther” lies against Obama, which set out to delegitimize a presidency and inflame racial hatred.
Trump’s own record of truth-support is far from exemplary. This is a president whose secretary of state has excluded reporters from his public activities repeatedly and with impunity. The same president who conjures convenient figures to claim the largest inaugural crowds in history.The same president who reportedly told the director of the FBI of his desire to jail reporters, who has called the mainstream press “the enemy of the people,” and who cozies up to journalist-jailing heads of state.
“Fake news,” as it is erroneously called sometimes, seemed like a curiosity only a few months ago — something that errant Macedonian teenagers spread on Facebook for profit, and which might or might not have affected the presidential election. (For example, the claim that Pope Francis had endorsed Donald Trump.)
Then it became the president’s favorite way to demean the reality-based press, and cast doubt on professional journalism.
“The speed with which the term became polarized and in fact a rhetorical weapon illustrates how efficient the conservative media machine has become,” George Washington University professor Nikki Usher told me earlier this year.
We know now that it’s far worse than that. Given tacit or explicit approval by the administration, this anti-truth movement — championed by Alex Jones, a Trump shill — erodes reason and reality. And those are the basis for a functioning democracy.
The growing absence of truth should worry every American citizen.
“If everybody always lies to you .?.?. nobody believes anything any longer,” said Hannah Arendt, the German American political theorist. “And with such a people you can then do what you please.”
So if you’re wondering why bottom-dwelling conspiracy theorists are allowed in the briefing room, or why Trump insiders promote lies about a young man’s death, you have your answer.

The Trump White House is collapsing

Donald Trump certainly seems like he's having a lovely time on his first international trip as president. He touched down in Saudi Arabia over the weekend and was given an over-the-top reception by his hosts. The Saudis presented him with a medal, projected his portrait onto the side of a hotel, and extended to him the finest treatment an oil-rich monarchy that just purchased many billions of dollars-worth of American-made weapons could muster for a U.S. president. For Trump, whose personal style is borrowed from the Bourbons, a king's welcome must feel pretty good.
Hopefully the president is enjoying himself as much as possible overseas, because back home, his administration is rapidly falling to pieces.
Just as Air Force One was lifting off to ferry Trump to Riyadh, The New York Times and The Washington Post each published seismically significant pieces on the White House's ever-expanding Russia scandal. The Times reported that Trump, during an Oval Office meeting the day after he fired FBI Director James Comey, told high-level Russian officials that Comey was a "nut job" and firing him had relieved the "great pressure" Trump felt "because of Russia." The Post, meanwhile, reported that the Justice Department's investigation into the Trump campaign's links to Russia has identified a senior White House official as "a significant person of interest."
Shortly after the Times and Post stories hit, CNN came through with another big scoop, reporting that Russian officials had boasted during the 2016 campaign that they could use former National Security Adviser Michael Flynn to influence Trump and his associates.
The Times piece in particular is brutal for Trump. At the time the president divulged to the Russians his motivation for firing his FBI director, the administration was still sticking to its ridiculous story that Comey lost his job because he botched the investigation into Hillary Clinton's emails. That means officials from an adversarial government knew the White House wasn't being honest about a politically explosive subject.
On top of that, Trump's comments to the Russians could become the focus of an obstruction of justice inquiry by special counsel Robert Mueller, who was tapped to assume control of the Russia investigation following Comey's dismissal. Trump had already told NBC's Lester Holt that the Russia investigation factored into his decision to fire Comey, and the Times report adds significant weight to the idea that Trump's primary motivation in sacking Comey was to neutralize an issue that was damaging him politically.
The Post report, meanwhile, feels like the first strong indication that the Russia investigation has the potential to cut deeply. The fact that a senior White House official is coming under scrutiny is obviously a problem for Trump, but the Post also reported that the FBI inquiry now "also includes determining whether any financial crimes were committed by people close to the president."
Trumpworld is well-populated with characters whose business dealings look pretty scummy — Michael Flynn and undeclared foreign lobbying money, Paul Manafort and his "black ledger" payments from pro-Russia political parties in Ukraine, etc. The president and his closest advisers have all gone to great lengths to keep their sources of income concealed, even as they make policy that could potentially affect their own finances. I suspect the last thing any of them want is a Department of Justice investigation into where their money comes from.
At a broader level, all of these new Russia scandal developments reveal just how dysfunctional the executive branch has become under Trump. The Times, Post, and CNN stories were all the product of leaks: from the White House, the Justice Department, and the intelligence community, respectively. Trump had been doing a bang-up job of alienating the people underneath him before he fired Comey, but his abrupt and unceremonious dumping of the FBI director has clearly exacerbated some already raw feelings and made life even more miserable for the people charged with implementing Trump's agenda.
Trump staffers are feeding stories to reporters about how life in the White House is a miserable slog and people are looking for exits. Others are giving anonymous quotes about how Trump looks like a "moron" and might get himself impeached. All of the administration's self-made crises are pushing the people on the inside to break ranks and feed dirt to reporters.
An administration cannot expect to function properly under these circumstances. The White House is just oozing poison at this point, and the growing toxicity is undermining everything the president and his aides are trying to do. The accelerating Russia investigation paired with Trump's penchant for political self-destruction guarantee that things won't improve any time soon.

MSNBC Reaches No. 1 for First Time in Weekly Primetime Ratings, Fox News Drops to Third

For the first time in its history, MSNBC ranked number one in both total viewers and the key adults 25-54 demographic during primetime for a full week among the big three cable news networks, according to Nielsen data.
For the week of May 15, MSNBC averaged 2.44 million viewers with 611,000 in the key demo from 8 p.m.-11 p.m., beating out CNN and Fox News in both measures. In total day viewership for the week, CNN has ranked number one in cable news among adults 25-54 for six straight days (May 14-19), marking the network’s longest winning streak in that measure in six years. Fox News finished first in total viewers with 1.5 million and second in the demo with 321,000. MSNBC was second in total viewers with 1.2 million total viewers and third in the demo with 281,000. CNN finished third in total viewers with 1.05 million but first in the demo with 353,000.
In addition, Fox News ranked number three in primetime in the key demographic for five straight days with 497,000 viewers, the longest streak at number three the network has had in that measure in 17 years, since June 2000. CNN finished second in the demo with 588,000. Fox was second in total viewers, however, with 2.41 million, beating out CNN’s 1.65 million.
Four primetime MSNBC programs were number one for the week in total viewers in their respective time periods: “The Rachel Maddow Show,” “Last Word with Lawrence O’Donnell”, “The 11th Hour” and the midnight re-air of “The Rachel Maddow Show.” Maddow had the top ranked non-sports program in all of cable for the week. On CNN, “Anderson Cooper 360” ranked number one in in the demo for five straight days at 8 p.m. This ties for the longest winning streak on record for the show in that timeslot.

Until recently, China and India have been cast as obstacles, at the very least reluctant conscripts, in the battle against climate change. That reputation looks very much out-of-date now that both countries have greatly accelerated their investments in cost-effective renewable energy sources — and reduced their reliance on fossil fuels. It’s America — Donald Trump’s America — that now looks like the laggard.
According to research released last week at a United Nations climate meeting in Germany, China and India should easily exceed the targets they set for themselves in the 2015 Paris Agreement signed by more than 190 countries. China’s emissions of carbon dioxide appear to have peaked more than 10 years sooner than its government had said they would. And India is now expected to obtain 40 percent of its electricity from non-fossil fuel sources by 2022, eight years ahead of schedule.
Every one of the Paris signatories will have to reduce emissions to ward off the worst consequences of global warming — devastating droughts, melting glaciers and unstoppable sea level rise. But the tangible progress by the world’s number one producer of greenhouse gases (China) and its number three (India) are astonishing nonetheless, and worth celebrating.
There is also a lesson here for the United States. Piece by piece, agency by agency, the Trump administration seems determined to destroy or undermine every initiative on which President Obama based his pledge in Paris to substantially reduce America’s greenhouse gases: his plan to close old, coal-fired power plants, his proposals to reduce methane emissions from oil and gas wells, his mandates for more fuel-efficient vehicles. The excuse given in every case is that these rules would cost jobs and damage the economy — the same bogus argument once used by Vice President Dick Cheney to persuade President George W. Bush to renege on his campaign promise to combat global warming.
China and India are finding that doing right by the planet need not carry a big economic cost and can actually be beneficial. By investing heavily in solar and wind, they and others like Germany have helped drive down the cost of those technologies to a point where, in many places, renewable sources can generate electricity more cheaply than dirtier sources of energy like coal. In a recent auction in India, developers of solar farms offered to sell electricity to the grid for 2.44 rupees per kilowatt-hour (or 3.79 cents). That is about 50 percent less than what solar farms bid a year earlier and about 24 percent less than the average price for energy generated by coal-fired power plants.
The shift from fossil fuels has thus been much faster and more pronounced than most experts expected. China has reduced coal use for three years in a row and recently scrapped plans to build more than 100 coal power plants. Indian officials have estimated that country might no longer need to build new coal plants beyond those that are already under construction. One other heartening fact: Electric vehicle sales in China jumped 70 percent last year, thanks in large part to generous government incentives. India is much further behind in this area, but the country’s minister of power said last month that all cars sold in the country should be electric by 2030.
China and India’s enthusiasm for cleaner energy arises in part from a wish to reduce the terrible air pollution that afflicts cities like Beijing and New Delhi; any move away from coal would make a big difference in public health. Investments in cutting-edge energy and transportation technologies would also bolster the economy as a whole.
There are, of course, formidable challenges, not least developing batteries to store the excess electricity generated by solar farms on sunny days and wind farms on windy days. And there are emissions from industry and agriculture to worry about. Still, Beijing and New Delhi — not, embarrassingly enough, Washington — are showing the way forward.

Here’s what just happened: Donald Trump and Israeli Prime Minister Benjamin Netanyahu were about to leave a scheduled press availability — the room was already filled with noisy chatter. Trump and Netanyahu are called back for one last handshake photo. The press gaggle, as it always does, continues to shout out questions, even though it seemed the time for answers has ended. Netanyahu calls out, “Intelligence cooperation is terrific!”
Then Trump offers up his own off-script pronouncement. “Just so you understand,” he says, quieting the press, “just so you understand — I never mentioned the word or the name Israel in conversation. Never mentioned it.” As he’s talking, a clearly horrified Netanyahu’s eyes dart everywhere.
“They are all saying I did,” Trump continues, unaware. “Never mentioned the word Israel.”
But actually no one had said Trump used the word “Israel.” The reports only said that during a visit in the Oval Office, Trump had casually discussed highly classified intelligence with the Russians that, it turns out, had been from Israel — and thus shouldn’t have been disclosed to the Russians without getting Israel’s permission first.
And no one in either administration — Israel’s or the United States’ — had officially confirmed the intelligence was in fact from Israel.
That is, until Trump seems to have done so just now.

Donald Trump is not fit to be president of the United States. He does not possess the requisite intellect and does not understand the significance of the office he holds nor the tasks associated with it. He doesn't read. He doesn't bother to peruse important files and intelligence reports and knows little about the issues that he has identified as his priorities. His decisions are capricious and they are delivered in the form of tyrannical decrees.
He is a man free of morals. As has been demonstrated hundreds of times, he is a liar, a racist and a cheat. I feel ashamed to use these words, as sharp and loud as they are. But if they apply to anyone, they apply to Trump. And one of the media's tasks is to continue telling things as they are: Trump has to be removed from the White House. Quickly. He is a danger to the world.
Trump is a miserable politician. He fired the FBI director simply because he could. James Comey had gotten under his skin with his investigation into Trump's confidants. Comey had also refused to swear loyalty and fealty to Trump and to abandon the investigation. He had to go.
Witnessing an American Tragedy
Trump is also a miserable boss. His people invent excuses for him and lie on his behalf because they have to, but then Trump wakes up and posts tweets that contradict what they have said. He doesn't care that his spokesman, his secretary of state and his national security adviser had just denied that the president had handed Russia (of all countries) sensitive intelligence gleaned from Israel (of all countries). Trump tweeted: Yes, yes, I did, because I can. I'm president after all.
Nothing is as it should be in this White House. Everyone working there has been compromised multiple times and now they all despise each other - and everyone except for Trump despises Trump. Because of all that, after just 120 days of the Trump administration, we are witness to an American tragedy for which there are five theoretical solutions.
The first is Trump's resignation, which won't happen.
The second is that Republicans in the House and Senate support impeachment, which would be justified by the president's proven obstruction of justice, but won't happen because of the Republicans' thirst for power, which they won't willingly give up.
The third possible solution is the invocation of the 25th Amendment, which would require the cabinet to declare Trump unfit to discharge the powers of the presidency. That isn't particularly likely either.
Fourth: The Democrats get ready to fight and win back majorities in the House and Senate in midterm elections, which are 18 months away, before they then pursue option two, impeachment.
Fifth: the international community wakes up and finds a way to circumvent the White House and free itself of its dependence on the U.S. Unlike the preceding four options, the fifth doesn't directly solve the Trump problem, but it is nevertheless necessary - and possible.
No Goals and No Strategy
Not quite two weeks ago, a number of experts and politicians focused on foreign policy met in Washington at the invitation of the Munich Security Conference. It wasn't difficult to sense the atmosphere of chaos and agony that has descended upon the city.

The Trump administration has no foreign policy because Trump has consistently promised American withdrawal while invoking America's strength. He has promised both no wars and more wars. He makes decisions according to his mood, with no strategic coherence or tactical logic. Moscow and Beijing are laughing at America. Elsewhere, people are worried.
In the Pacific, warships - American and Chinese - circle each other in close proximity. The conflict with North Korea is escalating. Who can be certain that Donald Trump won't risk nuclear war simply to save his own skin? Efforts to stop climate change are in trouble and many expect the U.S. to withdraw from the Paris Agreement because Trump is wary of legally binding measures. Crises, including those in Syria and Libya, are escalating, but no longer being discussed. And who should they be discussed with? Phone calls and emails to the U.S. State Department go unanswered. Nothing is regulated, nothing is stable and the trans-Atlantic relationship hardly exists anymore. German Foreign Minister Sigmar Gabriel and Bundestag Foreign Affairs Committee Chair Norbert Röttgen fly back and forth, but Germany and the U.S. no longer understand each other. Hardly any real communication takes place, there are no joint foreign policy goals and there is no strategy.
In "Game of Thrones," the Mad King was murdered (and the child that later took his place was no better). In real life, an immature boy sits on the throne of the most important country in the world. He could, at any time, issue a catastrophic order that would immediately be carried out. That is why the parents cannot afford to take their eyes off him even for a second. They cannot succumb to exhaustion because he is so taxing. They ultimately have to send him to his room - and return power to the grownups.

Former Fox News host Megyn Kelly, who has accused Roger Ailes of sexual harassment, was one of the two dozen woman Ailes' son Zachary called out during an eulogy for his father.
On Saturday, family and close friends of Roger Ailes gathered in Palm Beach, Fla. for a memorial service to remember the founder of Fox News, who died last week from a brain injury after falling at his home.
During the eulogy, Ailes’ 17-year-old son Zachary reportedly threatened to go after the various women who have accused his father of sexual harassment.

As President Donald Trump is getting hammered on the left for not using the expression “radical Islamic terrorism” during his speech in Saudi Arabia, he is also taking heat from his avid supporters who were drawn to him due to his anti-Mulsim rhetoric when he is in the U.S.
His crime?
Calling Islam “one of the world’s great faiths.”
That double hit — ducking “Islamic terrorism” while praising the religion — was not received very well on Twitter.
Trump’s latest troubles come following a night when Trump confidante Roger Stone tweeted “This makes me want to puke,” under a picture of Trump bowing before the Saudi king.
