And the winner is…no one, just yet.
Washington State initially planned to announce the winning bids for new cannabis consultant positions today but has pushed back its timeline to next week at the earliest. The reason? Chalk it up to an avalanche of applications – 112 to be exact. Some of those were duplicates or did not meet minimum standards, so in the end the state has had to pore over 98 bids.
“Due to the number of vendor submittals received … the evaluation process is taking longer than originally anticipated in the tentative procurement schedule,” the Washington State Liquor Control Board (WSLCB) – which is handling the process – responded to groups that inquired about the delay. “While the WSLCB is working diligently to complete the evaluation process as soon as possible, we anticipate that scoring should be completed next week.”
It’s a short delay in the grand scheme of things. But excitement over the positions are high, so days can feel like months for applicants.
The state announced in January that it is seeking cannabis consultants who will provide advice and guidance to officials as they develop regulations on the production and sale of marijuana for adult use, as stipulated in the voter-approve legalization measure Initiative 502. A key task for the consultants will also be to help the state develop realistic market estimates, such as number of potential customers and average cannabis consumption levels.
Brian Smith, a spokesman for the WSLCB, said the vetting process is extensive, similar to what the state uses to select contractors and other companies for big projects.
“There’s a misperception about what we’re doing,” Smith said. “I think it’s been construed as we’re going through resumes and cover letters. But what we put out was a Request for Proposal that asks people to tell us how or why they are qualified. It’s the same system we use if we’re constructing a building. We’re using a transparent scoring system so we can show how and why we came to the decisions we have.”
Smith said the deadline to attach a score to each bid is Monday night, and an official decision could come as early as – but not before – March 13.
The other erroneous perception is that the state is looking for an individual to essentially oversee all decisions about recreational cannabis.
“No single person will have all of these (responsibilities); it will likely be people with various expertise in different areas,” Smith said. “Some people have the perception that we’re hiring an employee to sit on a golden throne and provide all the answers about marijuana.”
The state could select several separate applicants with varying backgrounds and expertise or a groups of cannabis experts who applied as teams.
Chris Lindsey, a medical marijuana professional who submitted a joint bid, said the delay is understandable.
“Given the broad range of criteria the liquor control board included in its request, I would assume they have a lot of fairly technical proposals to review and compare,” Lindsey said. ” I do not envy them that project.”

New York Medical Marijuana Bill on Horizon, Lawmaker Says Support ‘Growing by the Day’

A Democratic lawmaker plans to introduce a bill soon calling for the legalization of medical cannabis in New York, reigniting the MMJ debate in a crucial market for the marijuana movement.
New York State Sen. Diane Savino told Medical Marijuana Business Daily that the measure is being drafted and will be ready for introduction in the next few days. She is extremely optimistic about its chances, saying that support is “growing every day” in the Senate, where previous marijuana-related measures have died.
“I’m hoping the bill will be ready by the end of week, and if not then the beginning of next week,” Savino said, adding that identical measures will be introduced in the state Assembly and Senate simultaneously.
The measure would set up a strict regulatory framework covering medical marijuana production and sales, using MMJ programs in states like Colorado and Connecticut as models. The industry would be subject to heavy oversight and numerous rules covering everything from security to permits and registration. The bill also would require comprehensive inventory tracking, from the time the seed is planted to the time cannabis is harvested, packaged and sold to patients.
“What we want to do is adopt the best practices and reject the worst to put forward a bill that will stand up to public scrutiny,” Savino said. “We also want to do everything possible to avoid aggressive intervention by the federal government, and the best way to accomplish that is through a tightly controlled statute that doesn’t allow for a lot of wiggle room.”
Under the bill, dispensaries could be either for-profit or nonprofit. The list of qualifying medical conditions would be very specific, including diseases and aliments such as HIV/AIDS, cancer, diabetes and multiple sclerosis. The idea is to avoid vague conditions like “chronic pain” that have inflated patient numbers and led to criticism in some other states.
Patients would have to buy medical cannabis from approved dispensaries and would not be able to grow their own.
It’s an important bill for the medical cannabis industry. New York is seen as an important state for medical marijuana because of its size – more than 19 million residents – and influence on the national stage. The market would be somewhat limited, with perhaps just tens of thousands of patients qualifying for MMJ cards initially because of the short list of qualifying conditions. But legalization in NY would still create hundreds of new business opportunities and give the industry even more clout, which could help convince other states weighing medical cannabis measures to follow suit.
The bill could sail through the Assembly – which has passed similar measures before – and Savino said she believes there’s enough support in the Senate. If the proposal clears those hurdles, it would wind up on the desk of New York Gov. Andrew Cuomo.
Getting his stamp of approval could be a challenge. Cuomo has said he is against the legalization of medical cannabis. But he has softened his position recently and agreed to explore the issue further. The governor is also pushing to decriminalize the possession of small amounts of marijuana.
Savino said she is confident that supporters can convince the governor to give the bill the green light if it passes the Assembly and Senate, though she admits it will take some work.
“Some people in his administration seem amendable to this, but we’d need to sit down and talk through this with the governor,” she said.
Lisa Reid – a senior associate at Patricia Lynch Associates, which is lobbying lawmakers to adopt MMJ laws on behalf of a Colorado company – said the bill stands a much better chance of passing than previous measures in part because it calls for extremely tight regulations.
“Our Republicans friends here in the Senate have found themselves far more comfortable with this model” than others, Reid said. “The fact is that Colorado has the best model, and that model is best for New York.”
She said the biggest fear in New York is that a huge black market will develop. “When you have a tightly regulated system…government oversight, a bar code issued from the time to plant is viable to a bud getting into patients’ hands, you essentially eliminate the black market to the best of your ability,” Reid said. “And when you have a for-profit model, everything is transparent, nothing is underground, and you have the least amount of intervention by the federal government.”
The current legislative session ends June 20, so it’s possible New York will become the 19th state to legalize medical marijuana by summer.

Medical marijuana is already legal in the nation’s official capital (on a local level, that is). This summer, it might also be legal in the nation’s cultural and financial capital.
As we wrote about last week, a New York senator plans to introduce an MMJ bill in both the state Assembly and Senate within the next few days. Sen. Diane Savino said support among lawmakers is strong, adding that her measure could potentially even clear the Senate – where previous marijuana bills have died – if a vote were held today.
If her assessment of the political winds is accurate, New York might very well become the 19th state to legalize medical marijuana by the time its current legislative session wraps up on June 20.
While many medical marijuana proposals are on the table across the country this year, the effort to legalize MMJ in New York is of particular interest to the cannabis industry given the state’s influence nationally – and even internationally.
Legalization in the Empire State wouldn’t create a huge market, at least at first. The bill will suggest a fairly limited list of qualifying medical conditions, meaning patient numbers would likely total in the tens of thousands, Savino said. That would put it way under the estimated 750,000 to 1 million in California and even the 100,000-plus in Colorado, Michigan and Washington State.
Still, New York’s program would likely rank alongside Oregon and Arizona in the second tier of MMJ states in terms of patient numbers, and it would generate tens of millions in revenue and create hundreds of business opportunities. Just as importantly, it would mean a great deal to the MMJ movement in general, as it could sway lawmakers and voters who are on the fence about medical marijuana in other states. And New York has the potential to grow into an industry powerhouse if the list of qualifying conditions is expanded or if this paves the way for recreational legalization sometime in the future.

Also last week, we wrote about how the Department of Justice plans to officially address marijuana legalization in Colorado and Washington. Attorney General Eric Holder said the DOJ will outline its policies soon after it finishes an in-depth review of the situation.
Couldn’t he have just said that from the start? The federal government has been extremely vague about state-level legalization and how it will respond when retail marijuana stores start opening in Colorado and Washington, leaving the cannabis industry on pins and needles. In fact, the government hadn’t given any indication at all of when it would respond, until Holder’s recent comments.
Both states are already well into the process for establishing rules covering recreational marijuana. It would be a colossal waste of time and resources if the government decided to challenge the marijuana laws after officials and communities have spent so much time on the issue so far.

$RFMK Marijuana Tourism Could Generate Billions in Extra Revenues for Colorado Cannabis Industry
Opening up Colorado’s emerging marijuana industry to tourists rather than just residents would boost revenues from cannabis sales exponentially, creating business opportunities on an enormous – and historical – scale. But it would also invite unwanted federal scrutiny and could lead to other unintended consequences.
A task force charged with proposing regulations covering marijuana production and sales in Colorado agreed this week that out-of-state visitors should be able to buy limited amounts of cannabis from retail stores. The group will add this suggestion to its official list of recommendations.
If the state actually adopts this proposal, the initial market for marijuana would skyrocket beyond initial estimates of $1 billion , possibly doubling or even tripling that number and leading to thousands of new jobs.
The possibilities are endless in such a scenario, as visitors from all over the country – and possibly from all over the world – would flock to the state specifically to purchase and use marijuana. Cannabis could easily become a top tourist draw, pumping hundreds of millions of dollars in sales tax into state coffers and rivaling Colorado’s $2.5 billion-$3 billion skiing industry. Visitors would not only buy cannabis and related products, they would also spend money on hotels, food and entertainment.
The task force will recommend that only Colorado residents can open retail marijuana stores. Anyone wanting to actually produce or sell marijuana for adult use, therefore, would have to live in the state for at least two years to gain residency. That would keep most of the profits in-state. However, there would be plenty of opportunities for other entrepreneurs and companies to capitalize by offering ancillary products and services to both retail shops and consumers.
It sounds almost too good to be true, and in fact it just might be: The proposal is sure to create a huge amount of controversy and debate, and the state could very well shoot down the recommendation. Locals are worried about the impact on crime, quality of life and other issues. Allowing out-of-state visitors to buy marijuana with little to no restrictions would also invite heavy scrutiny by the federal government. The Obama administration would no doubt be concerned about the diversion of marijuana to other states and the likelihood that Colorado would become a hub for global marijuana tourism similar to the Netherlands. Even if the state approves cannabis tourism, the feds could intervene and prevent that from happening.
To offset some of these concerns, the Colorado marijuana task force recommended that the state set a limit on how much marijuana visitors could purchase from any one dispensary. Doing so, task force members say, would make it more difficult and time-consuming to stockpile large amounts of marijuana to sell in other states.
Expect opponents of the idea to poke many holes in this notion and the idea of marijuana tourism in general. But the fact that a task force that includes law enforcement and political officials wants to move forward with the idea is significant.

The first medical marijuana dispensary in Washington DC plans to open its doors this April , kick-starting a new market that has been beset by delays and challenges for several years.
Capital City Care – one of four dispensaries planning to open in DC – says it should be ready to begin serving patients with MMJ cards by April. It recently obtained a cultivation license and is currently growing the marijuana it will sell this spring.
Talk about irony. The opening of a dispensary in the nation’s capital – just miles away from the agencies charged with enforcing the country’s cannabis laws – ranks as a huge milestone and an important symbolic victory for the MMJ industry given that medical marijuana remains illegal federally.
It’s unclear how the federal government will respond when dispensaries open in its backyard. But the feds will likely take a hands-off approach, given that they haven’t interfered with the process in DC so far.
Despite Capital City Care’s pledge to try to open by early April, some local MMJ professionals are filing this in the “Believe it When I See it” folder. Washington DC voters actually approved medical marijuana in 1998, yet local officials put it on ice for nearly two years before enacting a modified version of the original law. Dispensaries have been in the works since the spring of 2011, but the drawn-out, difficult permitting process created delays that has pushed back the timeline.
While the skepticism is warranted, it appears that DC’s medical marijuana program is actually making solid progress , and Capital City Care has cleared all of the major licensing and permitting hurdles needed to open. In fact, three other dispensaries – Metropolitan Wellness, Takoma Wellness Center and Herbal Alternatives – could open around the same time or soon after.
The consumer base in DC is expected to be quite small – an estimated 1,000 patients or less initially – due to strict regulations on who can receive cards. Unlike some MMJ states in the west that allow residents to get cards for general ailments like chronic pain, DC’s program covers only a few qualifying medical conditions, including cancer, glaucoma, HIV/AIDS, multiple sclerosis and health issues that lead to persistent muscle spasms.
Medical Marijuana Business Daily estimates initial sales of between $1 million and $3 million annually when the four dispensaries are up and running.
