09/01/2023 Notice to Substitute Attorney. Ryan L. Blansett Added to Case. William G. Cross Terminated From Case. Filed by Ryan Blansett on behalf of Federal Deposit Insurace Corporation, as Receiver for United Western Bank.
Y/W Bob
I believe this chapter seven Bankruptcy will close soon with nothing coming to shareholders, if the definitive FDIC closure of this "rare" receivership changes this zero outcome is IMO another story (https://investorshub.advfn.com/boards/read_msg.aspx?message_id=172714889)
nothing changed since the final trustee's report imo, after that bk has been just formalities 100%
In my view:
at least 48,3 million (in unsecured claims) ahead of commons if anytin comes from the definitive FDIC _ R closure [ https://investorshub.advfn.com/boards/read_msg.aspx?message_id=172318943 ]
depositors (pending amount $144,334,000) are also ahead of us (common shareholders):
https://closedbanks.fdic.gov/dividends/bankfind/Dividendindex?fin=10331]
-------------------------------------------------------------------------------------------------
So : $144,334,000 + $48.301.121,6 = $192,635,121,6 ahead of common shareholders
----------------------------------------------------------------------------------------------
3.5 Assets Not Purchased by Assuming Institution
3.5 (l)Excluded Securities
the securities listed on the attached Schedule 3.5(1)
$256,846,259.85
3.5 (p)Excluded Loans
the loans listed on the attached Schedule 3.5(p)
$228,251,513.08
[https://investorshub.advfn.com/boards/read_msg.aspx?message_id=107063828]
how much cash from those 256,8 + 228,2??
--------------------------------------------------------------------------------------------------
sealed agreement in exchange of 5TH amendment ?? possible, probably probable, but really dunno
--------------------------------------------------------------------------------------------------
Sterling LIBOR (how much ??)
------------------------------------------------------------------------------------------------
thanks so much Eli :)
Wells Fargo, as per final trustee's report, is already entitled to :
$34,751 + $43,943 (0.4% of their claims, see page 29/30 : https://www.docketbird.com/court-documents/United-Western-Bancorp-Inc/Chapter-7-Trustee-s-Final-Report-Reviewed-by-Brittany-Eichorn-Filed-for-Trustee-Simon-Rodriguez-Filed-by-US-Trustee-US-Trustee/cob-1:2012-bk-13815-00747)
as you say, the new address is needed for the checks to reach them, but the amounts are from Lilliput :(
I wanna be wrong, but I don't see anything else here, at least for now until FDIC-R is closed
Interesting, thanks
My pleasure LG

It was disclosed in
https://www.docketbird.com/court-cases/United-Western-Bancorp-Inc/cob-1:2012-bk-13815
Regarding its meaning, wells fargo was one of the big names in the final Trustee's report ( https://www.docketbird.com/court-documents/United-Western-Bancorp-Inc/Chapter-7-Trustee-s-Final-Report-Reviewed-by-Brittany-Eichorn-Filed-for-Trustee-Simon-Rodriguez-Filed-by-US-Trustee-US-Trustee/cob-1:2012-bk-13815-00747 ), and very probably it is mandatory within BK rules to report that it has changed its address,
Let's see if this ends in the not too distant future, fingers crossed

Thanks BOB
I was convinced, really convinced at the beginning, after so many years I'm an ocean of doubt and wanna reach port after so long sailin', sailin' with AHAB ain't a simple thang
Fingers crossed
Yes BB
I believe the chapter 7 may close soon, but it is not going to be meaningful (in $ terms IMO); if anything comes will be after FDIC_R closes this thang
But it is an important step in the right direction, even if we get nutting I prefer this thing finished (if that is not too much to ask ...)
I found it curious that closing this "took" almost as much time as closing the wamu Bankruptcy and wamu was literally thousands of times more complicated, and involved thousands of times more funds to distribute...
What do you think, will we get something? I know they were caught etc., but if we are gonna get something why all this paid (IMO) narrative control for so many years?
Fingers crossed
Thanks so much Eli

08/02/2023 Certificate of Non-Contested Matter Filed by Simon E. Rodriguez on behalf of Simon E. Rodriguez (related document(s):[748] Chapter 7 Trustee's Application for Compensation).
Thanks so much for your answer
I DO NOT KNOW either, but I believe that if money will show up no matter what, creating a false narrative does not make as much sense as if some actions by the beneficiaries of the pending assets (in order to receive those assets) are required
Cash in your trading account, new stock in your trading account, check in your mailbox, in the COOP balance sheet do NOT require actions by the benefcial owners but to unlock assets in a Delaware Statutory Trust DST beneficiaries MAY have to individually engage in some form of action [ https://delcode.delaware.gov/title12/c038/sc01/index.html ] to receive what is due to them, and maybe HF, UW, etc are doing that and retail are not, and if this were the case, creating a false narrative of nothing coming makes perfect sense
I agree 100%
Will monies come depending on actions made by the "escrow holders" or will they come no matter what??
If depending on actions, which actions in your opinion? are those actions being made? If coming no matter what, what do those engaged in the 24/7 lying gain with lying relentlessly for so many years?
TIA
Sadly, it is difficult not to agree with MARY F. WALRATH on this:
"In contrast, FDIC proceedings are cloaked in secrecy. The
seizure of the bank, and sale of its assets, occurs entirely in
the dark. This inevitably gives rise to a feeling that there is
something to hide. Secrecy never instills confidence in the
process."
