I'm familiar with the literature. I will say this, when I called IR the answer was "it is not a cut and dry answer. Many factors go into it, not the least of which is the SP at the time of signing along with Market cap and percentage of shares held by retail VS TUT. There are a lot of variables."
This was vague and frustrating.... but again, I'm not smart or resourceful enough to decipher the outcome and opine on the matter.

Not necessarily. There are several different requirements and they are not simply black and white.
You can take a peak at the link posted below, however it will drive you crazy trying to make heads or tales of it. After several calls to IR and even more to two different brokers that I use... I am left with no discernible answer. In fact, one of my brokers actually gave me several examples of a particular banking institution that recently was at and below $2 a share, but due to its credit rating and several other factors, it was left to its own devices to correct itself and right the ship. So, the answer is, there is no answer. We will have to wait and see.

I wouldn't be too sure about that... investors who have been in VRNG, through delay after delay, are just going to take whatever profit, or most likely salvage the lowest loss possible, and just dump it into a company who was just delayed and sits in muddy waters? I'm not so sure. I'll revisit this stock if it hits the teens again. Until that happens I have a hard time acting before July.

NOW..... the fun begins with the pre-Markman run-up (it's legit now), potential future settlements prior to Markman and announcement of other suits filed. Cant wait to see where this company is this time next year. Not to mention.... there are still those on the sidelines waiting for the two companies to put pen to paper.

I've said it before, but I can't resist here.... I'm not a chartist. BUT, do I see a distinct inverse head and shoulders forming here? And for the Chartists out there, what comes immediately after that on positive news? This just be the boredom talking, but that doesn't make it incorrect. Not to mention we have been hanging around in the handle of this cup for a while now.

I'm comfortable with my position. Healthy common position from between 2.20-2.45, as well as some Dec $2.50 calls. I won't be adding (unless by some act of god it goes below 2.50).
I hope so.... I'm personally out of worlds at the moment. Made a very nice profit and used some for home improvements. The rest is back making money in the market. I may load up again upon a successful Markman. Until then I'm very excited here and with MAR* as far as specs go. Thursday will be a good day I have to believe.

As far as knowledge regarding investing in, and the navigation of legal proceedings to best temper expectations and shape targets, I'm a fan of Postyle and Flyershd in that regard.
LOL.... I have none buddy. I'm here just like everyone else. To learn as much as possible, follow trends/sentiment, find new investment ideas, and alleviate boredom during the lulls.
Seabrook is a great resource, as well as redangus. Between the two, they offer immeasurable legal insight.

They will.... And it will change.
Once this company makes it through a successful Markman hearing, it comes down to skilled litigators and ultimately a temperamental judge. It will truly be a catalytic, event driven investment at that point, of course baring settlement. Until then, however this company has an excellent business model and a revenue stream that no other patent assertion entity can boast pre-litigation revenue.
I just read the 75 page white paper by JP Moreno again, as well as the preface for the article by RedChip. I think it's a great read to maintain a level head and remain focused on what we and the company are trying to accomplish here. A few things I like to hold as a mantra while we wait:
1. "Analyst J.P. Moreno, one of the most influential experts in the IP litigation space".... “Although there are many businesses focused on managing and monetizing intellectual property…none are structured to provide the overall level of value, diversification, and favorable risk-return profile as DSS.”
2. JP Moreno low-balls a $50MM, worst-case scenario reward assuming a 1% royalty across the board.....
3. To piggyback on that.... Two companies have already settled for 4 & 5 times that amount respectively.
I maintain my resolve here and feel confident that many positive catalysts remain on the horizon.

There is above average volume today (not stellar, but above average).
I tend to agree with you that tomorrow and Wed. will likely be the heavier trading days prior to merger vote results. I'm just hoping they favor a northern direction in SP.

I agree. I would love to FINALLY enact our previously, privately discussed "perfect world profit roll-over scenario" for once. I should disclose though that I have been adding an obscene number of shares daily for the past two weeks and intend to continue doing so with funds from my core portfolio that I have recently decided to transfer to my spec portfolio. After re-evaluating my successes over the last 2 years in this arena I feel comfortable making a shift in percentages. If a current investment in a particular company pays off as I believe it will... I will be rolling over significant profits into this company and expect a VERY healthy return here by EOY.
This is by far (to this point) the most exciting year for Speculative investing that I have experienced.
I am literally laughing out loud right now..... you complained about me stickying the explanation regarding the RS on 5/22, stating that it needed to be taken down because it would deter other potential investors from entering this trade. So I did. Since then you have brought it up more than anyone on this board bar none.
I'm not attacking you here, but I have noticed this for a while and held my tongue. I'm not sure what you were expecting here, however the apparent quick fix is not here to be had. Holding until November however will likely make many here a lot of money IMO. Good luck with VRNG and best wishes. I hope to see you back here again in the future.
Agreed.... But devils advocate, I have to believe that every stock with a looming major catalyst has sideliners. As to how many, to what end and the means for which they command to escalate SP? Who knows. This is the fun part :)
Fair enough.... But as far as a rise in SP upon completion of the merger, no there is no fact to support it. However fact isn't fact until it happens, and what has happened as a matter of fact in the past is a drastic rise in PPS subsequent to innumerable mergers in the past. This is undisputed. One more week and we shall see how this shakes out.

Now that I would like to believe. Not to mention these two companies have 7 Million reasons to keep this SP above $5 for 40 days out of 90 in the coming year. There are a lot of dynamics that keep in excited for the summer.
I follow Hudson as well as Spang. It's always wise to follow smart money.
I just don't like connecting dots any further than that when comparing companies. I'm encouraged here and see good things to come. I also hope for the best for all invested in V.... I cashed out a while ago. I may revisit once more clarity is provided overseas. At this point I am focused on the 20th and July 1st with DSS.
If this is your string that connects the two, then are we to assume that because Warren Buffet invests heavily with Wells Fargo, Walmart, National Oilwell Varco and Directv that they all are similar companies?
Yes... This is nothing but coincidence. These two companies share no common thread aside from they both have executive officers, they both have affinities for attorneys and they enforce patents (one more efficiently than the other pending upcoming merger). Patent families are unrelated, business models are night and day and share price, if anything, shows weakness in one and strength in the other in the face of pre-merger revenues and potential upside in both near and long-terms. These two companies share nothing. I dare say no IP companies share similarities....much less with the DSS business model.
