Ok....I just googled every possible meaning behind "beware the 5".... The only one I am aware of is the 5 year threshold for tax deferred investment vehicles for withdrawal.
Please share before I lose my mind.
I hope you are right, we may still see some selling, but if the numbers jive by way of shares available (and encouragement by SEC financial implications) it will be short lived. Once the selling is in fact finished and the MMs step aside, this should be impressive. GL to you as well.

Agreed, however there is a reason. Whether, as you mentioned I believe, there is some entity that needs to dump shares for whatever reason, who knows. They are showing themselves by way of EDGX and have proven very capable to move this in either direction on a whim. Without solid fundamental news hitting the ether I don't see any reason for concern at this point.

This would appear to unfairly prejudice Bascom in their efforts to monetize their patents. I can't begin to say what the judge will think or rule (nobody can), however to effectively penalize a company for adding defendants to an assertion and indefinitely postpone and extend timelines would be extremely counterintuitive. I know just as little as you on this matter and will simply wait and see what happens.
As far as your opinion on relating cases and essential timelines necessary for claim construction etc. I should have added "IMO".... I thought it was obvious, but will be cognizant with future posts.
Unfortunately nobody can speak for the attorneys In this situation, nor is it in their best interest to share this information for public consumption. If it would make it easier for us (the investors) to make decisions, I imagine it would do the same for the defendants when making litigious decisions in court. The best we will have is motions and orders as they come after-the-fact via PACER.

Then again, 2 1/2 months seems more than enough for a company to manage their case and address claims construction. I'm sure they were put on notice some time ago that Bascom would be pursuing litigation should they not license said patents. Hopefully we can have our cake and at it too here, look for rulings in the coming days/weeks for the answer to this question.

More than anything I wanted to put this back out there for those that weren't on the board last night. Bascom is pushing the Markman process forward via Joint Case Management. Thanks to Chas and Postyle for posting, also stickied by Cooler in the comprehensive list of links.

Defendants proposed schedule will cause unnecessary delay defendants’ proposed schedule is an attempt to vacate the claim construction hearing and delay this case indefinitely. The Court and the parties have already coordinated their schedules and set a date for the Markman hearing. There is no reason to vacate that date now and delay this case even further. Defendants suggest a schedule that delays the claim construction process until both sides are satisfied with the contentions of the other party. Not only is this scenario highly unlikely, it is against the spirit of the Patent Local Rules. In most patent cases, plaintiffs and defendants disagree regarding the sufficiency of the other’s contentions. If both parties had to agree that all contentions were sufficient before moving forward, no case would reach trial. Furthermore, the Patent Local Rules specifically contemplate amending contentions after claim construction. Thus, predicating the claim construction hearing on contentions, as Defendants suggest, is backwards. Accordingly, the claim construction process should move forward as scheduled while the parties resolve their discovery differences, which is the typical process in patent cases in this District.

I doubt any single company can push a sector, much less an obscure OTC stock, randomly pumped by JoeNatural to promote a run-up. It was vague for a reason. For future reference please keep any post on this board focused on DSS or a direct comparison thereof. TIA

Regardless of the judgement on RR by Judge Jackson in the VRNG trial, the resulting "Pop" will be very subdued IMO and is probably largely baked into the price at this point. Both parties have already filed their appeals and this one will be at least another year before VRNG sees a dime from GOOG, likely 2.
As far as other investors coming in from other investments, it is possible. If there is a pop in SP associated with VRNG, minimal as it may be, maybe some jump ship and minimize there losses or even tweak out a small gain, but it's impossible to assume they will come here. Who knows the sentiment they will have at that point. I know just as many investors who have a majorly bitter taste in their mouths for the IP sector from mistimed trades and bag holding (all their faults I should add) and nevertheless won't be remaining in the sector moving forward. I am cut from the cloth of "I'll figure this thing out and beat it" mentality, but not all are. Also, I'm a member and the president of the "Wait and see" club. There is no way of knowing if this will come to pass. I hope so, but more importantly I hope this company continues to execute, monetize their patents, garner more quality press and associated major investor news outlet coverage, ultimately driving investor/consumer interest and resulting SP. Wait and see my New York friend. Take from a New Yorker who made it out and has traded taxi cabs for palm trees..... Relax, wait and see. We appear to be in a good position.
It will be very interesting to read what exactly is getting these guys to settle before Markman.
