In case some of you haven't seen the official FDA notice regarding PMA requirements for non-thermal diathermy devices the link is below. It looks to me like, if a final rule is issued, BIEL would be required to file a PMA for all of their devices, including for the class III indications for which it already has approval.

Seriously, why would he deny sending that email? If he thinks you are taking it out of context, which is possible, then that's all he would need to say. However, given some of the companies he has done IR for in the past it doesn't surprise me that he wouldn't have a problem bending the truth.
To be clear, I am 100% confident he sent you that email Imrich, just don't understand why he'd deny it instead of just giving additional details on what he meant.

Well, that's fine to have that opinion, but the fact remains that every PEMF device to date has been classified as a Class III device. Whether that's right or not is obviously a matter of opinion, but the FDA doesn't seem to be budging on this topic.

Yes, they all report gross profit. They may term them as gross income or gross revenue, but the number is the same. You don't need to make any deductions yourself, the company does it for you right there in the income statement, and the result after those deductions for expenses are made is listed right there in plain site as NET LOSS. Seriously, your failure to understand how to read an income statement does not equate to the company misleading anybody.
Here's a link to Apple's financial statement. Do you see line 3 of the income statement, Gross margin? That is exactly the same as what BIEL reports as Gross profit. They are synonymous.

You still have to deduct the rest of their expenses to get down to their Net Income which is synonymous with Net Profit (or loss in BIEL's case).
Ummm...yeah, they're losing money that's not exactly news. My views on the ineptment of management is well documented as well. My problem is with your assertion that gross profit is both misleading and irrelevant. It's simply not true.
LOL, nobody is putting lipstick on a pig, they're preparing the financial statements according to GAAP. That means you report both gross income and net income. In general, most non-operating expenses are either fixed, or relatively stable, so increasing your gross margins generally result in better net income. This is not always the case, if you're forced to add significant salary for instance. You might consider taking an accounting 101 class as it might help you understand how to analyze a balance sheet and income statement.

The suit was settled with both companies agreeing to go about their business, but yes there are other products on the market with very similar functionality to the Medipendant.
Well, hopefully it works out for those of you who have stuck with this so far. Personally I think management has bungled this thing to the point that it is beyond recovery, but there is always a chance. It is disconcerting that the rate of dilution has increased since they gagged the TA and their financial position is becoming more and more precarious each passing quarter. The fact that they have begun overdrawing their bank accounts is never a good sign. GL.
Honestly, I haven't seen any recent news on BIEL. I don't really follow them much any more, but saw that they had released updated financials. However, TBH I wouldn't expect much as they've launched several campaigns in Europe over the last few years and none have resulted in appreciable sales. Maybe this time will be different, but I would keep expectations low. I still say this is a FDA or bust play.
Well, you can tell that the non-free trading shares increased from 68.6 million to 140 million during the 2nd quarter, or an increase of 71.4 million. There's not way to tell which shares were restricted or who they were issued to however.

If you had done any "DD" on this company you would see that they have all of the markings of a share-dillution scam. I was referring to drinking 36 ounces of soda right before going to sleep. Makes for a wakeup or two I would hazard to guess.
Also, you can get a bottle of 120 10mg pills at Walmart for $11. The 1 mg bottle is $4. Why pay $2 a can for something that's going to make you have to get up and go to the bathroom at night?

A short-term spike in PPS does not indicate a thriving company, at least not for long-term investors. Whether you believe in the technology or not, there is no arguing with the fact that their financial situation is perilous.
12.2 was not the all-time high pps, but I believe it marks their highest market cap. It traded .50 back in 2005, but the OS was 50-60 million at that time.
As to the rest, MEH, my views on the ineptitude of BIEL management are well documented, and I think if Mary Whelan is their fallback plan then they're in trouble. Still an FDA or bust play IMO.
Any time a PR specifically addresses PPS it sends up red flags to investors.

I concur with this. It is unprofessional for an IR person to get caught up in the stuff that takes place on these boards. They should be crafting PRs and answering questions via email/phone.
