The one thing Hodges DID accomplish at the hearing was raising the bar on his accusations, including ranting about terrorist organizations being involved.
Judge Selna is probably expecting a detail account of the accusations for the sake of national security, after all Hodges did assert that Homeland Security Dept was part of the "sting operation". lol

The only people that are made accountable are the ones who committed crimes against them, even though it was never a crime because naked shorting was legal in Canada while CMKX was trading and there was a grandfather clause in effect till March of 2007.

This is the bottom line, and I have a thirty year rcmp officer consulting on this, it is the rcmp's duty to investigate crimes that are preventing the completion of Al's Bivens lawsuit. He has said he represents all 50000 shareholders and I one of those as are you. If a lawyer that represented me said crimes were happening that he had proof of that were preventing the completion of a court case, ie jury tampering, it is the duty of the authorities to investigate these allegations. Not investigating them is a dereliction of duty, straight from my consultant. Remember Al is a direct witness to the crimes happening against us, directly involved, we don't have to go back to proving the sting.
I do not have to prove the particulars of Al's case, the bottom line is Al has said our money was agreed to be released about twenty times, and that serious crimes are preventing that from happening and preventing the conclusion of his case, a case that involves our money.
It is every single shareholders right to demand the authorities, RCMP in Canada and FBI in the United States, investigate the crimes that are preventing the release of the funds held for them.
The fact alone that the government has said the would release the money set aside in this sting operation validates that the money is there, again proving the details and particulars of who, when, where, and what is not necessary at all. And this is not a deal made by Al so we can get our money, our money is already there, he is only suing to get it released, it is not as if he can negotiate a better deal or anything. He is simply suing to release the money already there, the government has agreed to release it or Al is a liar, and that is not the case in my opinion.
I will be putting out a template and directions that every single shareholder can join this complaint and demand the authorities do their duties and investigate the allegations that crimes are being committed against us right now.

please get ready for action, it is time to get interactive and say your in your own words what you think, ie if you don't agree with everything I have done you still can enter your statement.
I will give a template that is easy to use, but if you don' t agree with the what I have done that is fine, you can say just that. I don't agree with everything the coalition has said but I do support the public investigation of Mr. Hodges allegations that directly affect his Bivens lawsuit, which directly affects me. I support the investigation of the crimes that are being committed that prevent the conclusion of that Bivens case and which are preventing me from receiving my money set aside and placed in frozedn trust for me.
Or any words you like, it will be your personal statement to the authorities, and will be on the record, it will make a difference.

Problem is, Hodges never provided extensive evidence proving a sting operation, settlement trust, or a NSS in CMKX. Anyone that shows an interest in this story will most certainly read the lawsuit plus the Motion To Dismiss and discover Hodges entered only hearsay. Gus is a moron if he believes the folks he wants to investigate this matter are too dumb to figure things out that these are merely unproven allegations by plaintiffs. There's the rub right there! The plaintiffs themselves have publicly claim they have NEVER SEEN ANY EVIDENCE!!!!!!!
Between June 1, 2004, and October 28, 2005, a total of 2.25 trillion phantom shares of CMKM were allegedly sold into the public market.
Between March 2004 and August 2006, Robert A. Maheu, with assistance of others and on behalf of CMKM, allegedly reached a settlement with the perpetrators who had engaged in illegal naked short selling and cellar boxing the stock of CMKM. The US government promised that it would not prosecute the perpetrators in exchange for the promise of the perpetrators to pay negotiated amounts to a frozen trust for disbursal at a later time to CMKM shareholders.
This timeline is another problem. NSS were legal in Canada before Reg SHO was implemented in January 2005. All NSS before that were Grandfather in until October 2007 well after CMKX was revoked. Maheu had NO LEVERAGE to bargain with.
And why would the previous Canadian Attorney General along with other Canadian authorities care if CMKX was NSS when it was legal in their country at that time?
Take the case of Hedge Fund manager Jeffrey Thorp for example. He was charge with prematurely shorting stocks in PIPE deals he was involved with. It is known he was NSS in Canada where it was legal to do so. He could not be charge because it WAS legal at the time. What was NOT legal was trading on inside information.
If Thorp was not charge with NSS, then why should all these allege bad guys who were NSS CMKX worry about it? Again, Maheu had NO LEVERAGE to force a settlement.
Their tactics included selling shares short without borrowing them, a practice known as naked shorting. But that shorting was done in Canada, where the practice is legal, and no charges were brought over that.
Instead, the charges dealt with fake or prearranged trades intended to make it look as if the funds had bought other shares to cover their short positions.
A Troubling Finance Tool for Companies in Trouble

When a company goes the route of PIPE's, you can bet that it is in trouble, unable to raise funds through conventional routes. But such companies can often raise millions of dollars, thereby postponing disaster.
PIPE stands for private investment in public equity, and providing such financing can be very profitable, even if the companies later go bankrupt.
Yesterday, in penalizing a New York hedge fund and its lead trader a total of $15.8 million, the Securities and Exchange Commission laid out one — illegal — way that investors get rich on such deals.
Jeffrey Friestad, an S.E.C. lawyer, said the penalty was the largest ever imposed in a PIPE case. "It represents our ongoing commitment to stamp out fraud and ongoing abuses in the PIPE market," he said.
While details vary, PIPE deals usually allow the buyer to buy shares — or securities convertible into shares — at a price below the market price of the stock. The catch is that the shares are not registered with the S.E.C. Buyers are required to sign statements promising not to sell the securities until the registration statement is effective.
The market price usually sags after a PIPE deal is announced, and any investor who buys such an investment and waits for the shares to be registered, usually within a matter of days, risks discovering that the market price of the stock will have fallen below the purchase price.
To avoid that, it is good to short the shares as soon as possible. But to do that in the United States, a trader is supposed to first borrow the shares. And, the S.E.C. says, it is illegal to use the shares obtained from the PIPE to repay the shares borrowed, since that would amount to having sold the PIPE shares too early.
The investor is supposed to buy other shares to cover the short position, and then sell the PIPE shares separately. If the shares are illiquid, there is a risk that prices will move, leaving the trader with a loss.
In addition, the S.E.C. says, it is illegal insider trading to sell the shares short if the seller knows a PIPE deal is coming, but that fact has not been announced to the public.
The complaint against Jeffrey Thorp and three hedge funds he ran — Langley Partners, North Olmstead Partners and Quantico Partners — says that in 22 deals, PIPE shares were improperly used to cover short positions, often with elaborate ruses aimed at making the tactic hard to discover. In six of those cases, and one other, Mr. Thorp was accused of illegal insider trading by shorting the stocks before the PIPE deal was disclosed to the public.
Mr. Thorp, 42, of New York and the funds settled the case without admitting or denying the S.E.C. allegations. Mr. Thorp also agreed to talk to the S.E.C. when asked.
No phone number could be found for Mr. Thorp or his funds. His lawyer, Andrew G. Gordon of Paul, Weiss, Rifkind, Wharton & Garrison did not return a telephone call.
The S.E.C. allegations indicated that unnamed brokers in the United States and Canada worked with Mr. Thorp to cover up what he was doing.
Asked if the brokers would face charges, Mr. Friestad of the S.E.C. said the commission would "look to see whether brokers had any responsibility for this and bring charges if appropriate."
The S.E.C. said that in the PIPE trades from 2000 to 2002, the defendants realized profits of $7 million. Their tactics included selling shares short without borrowing them, a practice known as naked shorting. But that shorting was done in Canada, where the practice is legal, and no charges were brought over that.
Instead, the charges dealt with fake or prearranged trades intended to make it look as if the funds had bought other shares to cover their short positions.
The S.E.C., in its complaint, described the PIPE market gently, saying companies issue such securities "when more traditional means of financing, such as a registered repeat offering, are for various reasons impractical."
One thing that limits the size of the offerings is that buyers are reluctant to place large orders, out of fear that they will not be able to legally short the shares in time. But the S.E.C. said the tactics Mr. Thorp used led him to seek very large allocations.
Few buyers of PIPE securities invest because they believe in the long-term prospects of the company, so the burden ends up falling on those who buy common stock.
They rarely do well. Of the 23 PIPE deals covered in the S.E.C. complaint, it appears that in 21 cases the common stock is now trading, if it is trading at all, at a price below that paid by the PIPE buyers. Since that price was below the public price at the time, the common shareholders did even worse.
There was one major exception, a company known as HealthExtra. It prospects grew worse, and its sale price fell, in the months after the PIPE deal was sold in 2001. But its business later improved and the share price has risen sharply.
But the rarity of such good outcomes explains why it is usually a good strategy to sell any investment in a company that issues a PIPE as soon as the deal is announced.

Obama Administration Puts A Price Tag On Constitutional Rights

We should all just sell every stock we own right now, whether in cash or retirement accounts. The financial system in the U.S. is little more than a game of three card monte. If you are an average working class American, you cannot win. The odds have been stacked against you. The promises of President Obama during his campaign for greater market visibility and market reform have been trashed. He lied to you. The dirty windows which obscured the public’s view of the stock markets were just painted over with thick black paint, rather than cleaned or replaced.
The recently signed into law FINREG bill has granted the Securities & Exchange Commission (SEC) what amounts to immunity from for any wrong-doing. Ironically, the bill contained no such language as it passed both the House of Representatives and The U.S. Senate. At some point between being passed by both Houses of Congress and President Obama signing it into law, section 9291 was added which specifically excludes the SEC from providing information under the Freedom of Information Act.
Why would someone go to so much effort to put this unpassed provision into a bill before it was signed by the President? The answer lies in trillions of dollars that are at stake from shareholders suing the SEC for negligence and other wrongdoings. Most people are familiar with the Bernie Madoff scandal, which ignited lawsuits across the country against the SEC for negligence. The story of CMKM Diamonds however, makes the Bernie Madoff scandal look like a grocery store robbery by comparison. This one peice of added language may enable the U.S. Government to steal $3.87 TRILLION from the shareholders of CMKM.
Asking me to speculate on what will happen on a case that involves an attorney with a screw loose is not productive

Thank you for the warm welcome. It has been some time since I posted. When I learned of the corruption going on inside the Company, I walked away. For some reason the dummies can't figure out Brit is the best person to take to the finals because most believe she is a spoil brat that doesn't deserve the money. Kathy and Enzo will campaign in the jury house for Brit not to get the money. Lane may have a clue Brit won't win the money which may be his reason to keep her.
She also needs to hear from her family at this point.

Hayden throwing the challenge was definitely a smart move
His "let Matt do all the dirty work" strategy may cost him the win though, unless he is up against Lane who has the same strategy.
However, the HOH (Brit) can't compete next week so she may follow Brendan
That's what the Brigade is pushing for, including Lane.
There is always a strategy to bring Brendan to the end though because he is so hated, that anyone going up against him would win the $500,000.
Depends on who Brendon will be up against. He will have Kathy and Rachel's votes. Matt told the Brigade if they bring Brendon to the Final two he will vote for Brendon because he earned it. Brendon would need one more vote. If they vote on game alone, Brendon could pick up another vote.
With that said I think Brit will put up Brendan and Enzo but I hope they talk her into putting Ragan up
Brit knows Ragan will never put her up. Ragan is the only one who thinks Hay is shady. He will put Hay and Lane up before Matt and Brit.

Matt has too much blood on his hands already. He knew he never had Kathy's vote to begin with and everyone was in agreement that Kathy had to go after the Sab's note to Enzo (even though Haydon secretly wanted Kathy to stay). So Matt thought it was the best move to secure another week in the house. He knows Enzo wants Brit out of the house more than him.
Enzo wanted to win HOH badly last night to get Brit out. Today Enzo won't even look at Brit. His attitude toward her is for certain going to get him on the block. He will use that next week as an excuse to Lane that Brit must go.
Funny enough, if Enzo wins HOH next week, Matt will be safe again because Enzo will put Brit and Ragan on the block. Last night Matt went to Enzo and told him he is 100% in his corner and will vote Brit/Ragan out. Enzo seemed please and told Matt he had doubts about him, but it's cool now. The main problem for Matt is Haydon getting into Enzo's head to get Matt out.

Lane was fuming last night because the DR kept calling him and others in there to talk about Brit's boyfriend Nick. The DR wanted them to make comparisons between Lane vs. Nick. Lane had a reaction to Nick's photo in Brit's HOH room and BB is trying to make a story out of it. Lane fears they will make him look pathetically jealous on the show.
Matt openly says that he HAD to keep it a secret and that BB pushed for this to happen
Hayseed got into Lane's head last night that Matt screwed them because Kathy was to be in the final four. What the dummy can't figure out is Hayseed wanted to keep both Kathy and Brendon because that is who he wants a final two with. Hay wants the Brigade in the jury house for votes.
I believe Matt wants Enzo out so the Brigade is down to three members so they will decide to keep him. The idiot still trusts Hay, which will be his downfall in the game.
