Violent Crime Has Dropped In Border States With Legal Cannabis: Study

A new study suggests that legalized cannabis may already be reducing violence in states that border Mexico, where U.S.-bound drug trafficking has caused countless deaths and raised trillions for cartels.
Published this month in The Economic Journal, the study "Is Legal Pot Crippling Mexican Drug Trafficking Organizations? The Effect of Medical Marijuana Laws on US Crime" examined the crime rates of states along the Mexican border in relation to states' decisions to legalize cannabis for production and consumption.
According to the study, violent crime in such states has fallen by an average of 13% since legal cannabis was put on the books, and at even higher rates regarding homicide. Researchers suggest that the drop can be attributed to cannabis users no longer having to rely on black-market products from Mexico, which has been providing the bulk of cannabis products consumed in the U.S. for decades.

Economist Evelina Gavrilova, one of the study’s authors, explained to The Guardian that cannabis laws in these states have allowed local farmers and dispensaries to provide users with the products they need in a legal way, putting a direct dent in cartels' U.S. business.
“These growers are in direct competition with Mexican drug cartels that are smuggling the marijuana into the U.S. As a result, the cartels get much less business," Gavrilova told The Guardian. In turn, less violent crime seems to result from that smuggling — on our side of the border, at least, but hopefully both.
“[Cartels] compete for territory, but it’s also easy to steal product from the other cartels and sell it themselves, so they fight for the product ... and ensure there are no bystanders, no witnesses to the activities of the cartel," she said. “Whenever there is a medical marijuana law we observe that crime at the border decreases because suddenly there is a lot less smuggling and a lot less violence associated with that.”

To investigate whether violent crime rates had dwindled in border states in recent years, researchers Floris Zoutman, Takuma Kamada and Gavrilova looked at FBI uniform crime reports and supplementary homicide data from between 1994 and 2012.
Among U.S. states bordering Mexico that have medical marijuana laws (MMLs), they found that California saw the highest overall reduction in violent crime, at 15%, and Arizona the lowest, with a 7% drop.
Overall, robberies fell by 19% in border states with MMLs, murder dropped by 10%, and homicides related to the drug trade fell by an impressive 41%.

In recent years, numerous studies have sought to quantify the impacts of MMLs in the growing number of U.S. states that have created them. Among other things, researchers have probed potential changes in teenage use, driving under the influence, and hospitalization for cannabis use.
The long-term effects of cannabis legalization have yet to be shown, but data suggest that Mexican cartels have already been feeling the pressure.
As The Guardian reported, experts believe that some cartels may be trying to open their own legal operations in California, and speculate that others are working to "shore up their falling profits" through human trafficking, kidnapping, and cultivating more poppy plants for a heroin supply that's closer to home.

The study's authors also noted, "The reduction in crime is strongest for counties close to the border (less than 350 km) and for crimes that relate to drug trafficking. In addition, we find that MMLs in inland states lead to a reduction in crime in the nearest border state."
"Our results are consistent with the theory that decriminalization of the production and distribution of marijuana leads to a reduction in violent crime in markets that are traditionally controlled by Mexican drug trafficking organizations," the researchers wrote.

Right now there is a glut of MJ in the states that have legalized it and that supply will only grow as more and more states legalize MJ. Dispensaries are popping up like weeds(No Pun Intended) all over these states so the need for advertising there product and pricing grows as supply exceeds demand, even though demand is large. So a company like MJTK can advertise there particular product strain and cost to the general public of MJ users. It's all about competition amongst the growers and sellers who want that MJ dollar from buyers. The more supply the more competition. We are the metaphorical equivalent of the people who sold picks and shovels to the gold miners of the California 1800's Gold Rush (they made the real money), only now it's the Green Rush. I believe in this company and I think we will be one of the biggest gainers of them all. MJTK

In response to ongoing threats to the cannabis industry from the U.S. Department of Justice and Attorney General Jeff Sessions, lawmakers have prepared a bill meant to nip funding for federal interference in the bud.
Last week, Representative Barbara Lee (D-CA) introduced a house resolution aimed "to protect states and individuals in states that have laws which permit the use of cannabis, and for other purposes," entitled the Restraining Excessive Federal Enforcement and Regulations of Cannabis Act or REFER Act for short.
Cosponsored by Reps. Earl Blumenauer (D-OR), Don Young (R-AK), Dina Titus (D-NV) and Jared Polis (D-CO), HR 4779 would create protections for both medical and recreational cannabis by barring federal funding for any efforts by the justice department to interfere in states' laws when imposing its own.
That includes efforts which seek to “detain, prosecute, sentence or initiate civil proceedings against an individual, business or property that is involved in the cultivation, distribution, possession, dispensation or the use of cannabis in accordance with the law or regulation of the state or unit of local government in which the individual is located,” according to lawmakers.
Congresswoman Lee commented in a statement, “The federal government should respect the will of the voters in states that have voted to decriminalize cannabis. It’s time to stop wasting taxpayer money on the failed War on Drugs.”
Lee continued, “I’m proud to introduce the REFER Act, which would prevent the Attorney General and others in the Trump Administration from stifling the budding cannabis industry. If the federal government chooses to interfere in these state matters, it’s up to Congress to prevent this harmful overreach.”
In a release, the National Organization for the Reform of Marijuana Laws (NORML) praised the bill, which it helped Rep. Lee's team within drafting the language.

NORML noted that the appropriations-targeting bill would also block the federal government from taking punitive action against a financial institution "solely because [it] provides financial services to an entity" that is involved in marijuana-related activities that are sanctioned on the state level.
Dependable financial services have topped the legal cannabis industry's wish list for years, especially as federal pressure has continued driving many banks and types of investors to keep their distance.
As a result, legal cannabis operations around the country have been forced to get creative with how they manage, protect or just pay taxes on their cash-heavy revenues and products; when police raids, robberies, or even natural calamities happen, the losses that businesses and individuals incur can often be permanent, leaving otherwise growing businesses high and dry.

Justin Strekal, Political Director for NORML, commented by phone that the nonprofit is "incredibly pleased at the leadership that Rep. Lee has shown" in the marijuana space, including through the REFER bill.
"She truly understands that the federal government needs to get out of the way of states that are ending the absurd and racist policy of marijuana prohibition," Strekal said. "The REFER Act would go a long way to preventing cannabis bigot AG Jeff Sessions from cracking down on the states that have legalized cannabis."
"It’s a bill with a fun name and a serious purpose," he added.

In the past year, lawmakers from both sides of the aisle have helped introduce several pieces of new legislation (and some revamped, long-researched favorites) to address the booming fields of cannabis science, industry, and incarceration in a meaningful way.
As in prior years, recent attempts to change federal cannabis laws have explored different legislative routes to getting the DOJ to lay off while states work to figure it all out.

A new congressional bill would effectively prevent U.S Attorney General Jeff Sessions from cracking down on people who are following state marijuana laws. But it wouldn’t change cannabis’s status under federal law.
Instead, the proposal, filed in the U.S. House on Thursday by Congresswoman Barbara Lee (D-CA) and four cosponsors, would restrict the Justice Department and other federal agencies from spending money to “detain, prosecute, sentence, or initiate civil proceedings against an individual, business or property, that is involved in the cultivation, distribution, possession, dispensation, or use of cannabis” in accordance with state law.
The legislation would also protect banks that work with state-legal cannabis businesses.
The text of the bill has not yet been uploaded to Congress’s website, but Marijuana Moment has obtained it (see below).
The funding prohibition goes beyond the annual medical cannabis appropriations rider, commonly known as Rohrabacher-Farr, in a number of ways.
First, it doesn’t just shield medical cannabis patients, providers and laws; it covers everyone complying with a state marijuana law, including recreational businesses and consumers.
Second, it doesn’t just restrict the Department of Justice; it also applies to the Treasury Department, the Department of Homeland Security and every other federal government agency that could potentially go after people for violating federal marijuana prohibition.
Third, and perhaps most important, it is permanent. Unlike the existing medical cannabis rider, it wouldn’t need to be renewed every year as part of annual spending bills. If enacted, its language would exist in statute until a future Congress proactively changed it.
Last week, Sessions rescinded Obama-era guidance that has generally allowed states to implement their own cannabis laws without federal interference. A large number of members of Congress and state officials have pushed back against the move, which is also deeply unpopular with voters.
“It is time we expand the protections of Rohrabacher-Farr to ensure that no government agency targets marijuana companies and their partners in ancillary businesses,” Congresswoman Dina Titus (D-NV), one of the cosponsors of the new bill, told Marijuana Moment via an email. “Taxpayer dollars should not be used to crackdown on law-abiding taxpayers operating legally in states.”
If the legislation passes, the most significant practical marijuana policy and enforcement reform to date would be accomplished without actually changing cannabis’s status under the schedules of the Controlled Substances Act.
